RECOMMENDED ACTION:
Adopt Resolution No. 2009-030 accepting the work in accordance with the contract for
construction of the City Library Learning Center, Project Nos. 3771 and 4001 as complete and
directing the City Clerk to record a Notice of Completion and release bonds in accordance with State
Law and City Ordinances.
ITEM EXPLANATION:
On June 13, 2006, the City of Carlsbad awarded a contract to Telacu Construction Management, Inc.
in the amount of $4,015,000 for the construction of the City Library Learning Center, Project Nos.
3771 and 4001.
Telacu Construction Management, Inc. substantially completed the contract work on August 23, 2008
and all punch-list work was completed October 24, 2008. City staff has inspected the work and found
it to be satisfactory. Staff recommends acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

The construction expenditures to date are the aggregate amount for all construction
related activities through the date of substantial completion (Contract Change Orders
No. 1-8 included).
Upon substantial completion of the project, Telacu Construction Management, Inc. filed a claim
requesting additional compensation related to project delays. Until the claim is settled, the total
construction expenditures remain unknown.

ACCORDANCE WITH THE CONTRACT FOR CONSTRUCTION
4 OF THE CITY LIBRARY LEARNING CENTER, PROJECT
NOS. 3771 AND 4001.

WHEREAS, the construction of the City Library Learning Center project has been
6
completed to the City's satisfaction by Telacu Construction Management, Inc.
7
on October 24, 2008; and
8
WHEREAS, the formal project Notice of Completion has been prepared; and9
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,11
California, as follows:12
1. That the above recitations are true and correct.

14 2. That the City Library Learning Center, specifically identified as Project Nos. 3771
15 and 4001, is deemed complete and is hereby accepted by the City Council of the City of Carlsbad.
16 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
17 execute and record the Notice of Completion for the City Library Learning Center, Project Nos.
