HEAD CITY ATTY. xd5^ CITY MGR. (V — RECOMMENDED ACTION: It is recommended the City Council introduce Ordinance No.CS-024 reducing the compensation of the City Council by 5%. ITEM EXPLANATION: The City of Carlsbad became a charter city as a result of the voter's adoption of the proposed City Charter at the special election of June 3, 2008. Under the California Constitution, the City Council has plenary authority to establish its compensation since it is a municipal affair. Therefore, the City Council is not bound by the provisions of general law establishing compensation to council members and it is not necessary to wait until following the election of 2010 to adjust the compensation. Currently, the City Council compensation is set at one thousand four hundred and sixty-two dollars ($1462) per month. If the Council wishes to reduce this compensation by 5%, which would result in a compensation of one thousand three hundred and eighjynine dollars ($1389) per month, its action is to introduce Ordinance No. CS-024. FISCAL IMPACT: The compensation of the Mayor and members of the City Council would be reduced by 5% unless and until a subsequent ordinance is adopted. ENVIRONMENTAL IMPACT: The adjustment in City Council compensation is not a project and will not result in any physical change in the environment within the meaning of CEQA and no further review is required. CS-024 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REPEALING EXISTING 3 SECTIONS 2.04.010 AND 2.04.020 AND ADOPTING NEW 4 SECTIONS 2.04.010 AND 2.04.020 OF THE CARLSBAD 5 6 7 as follows: 8 SECTION I: That existing section 2.04.010 is repealed and a new 9 section, 2.04.010 is added to the Carlsbad Municipal Code to read as follows: 10 2.04.010 Compensation.11 12 13 14 19 20 21 22 24 25 MUNICIPAL CODE, COMPENSATION OF THE MAYOR AND MEMBERS OF THE CITY COUNCIL NOW, THEREFORE, the City Council of the City of Carlsbad ordains (1) The compensation of each member of the city council shall be set at one thousand three hundred and eight-nine dollars ($1389) per month upon the effective date of this ordinance. Adjustments to city council compensation may be made from time to time by ordinance amending this section. (2) The compensation established by this section is exclusive of any amounts payable to each member of the city council as reimbursement for actual and necessary expenses incurred in the performance of official duties for the City. 16 SECTION II: That existing section 2.04.020 is repealed and a new 17 section, 2.04.020 is added to the Carlsbad Municipal Code to read as follows: 18 2.04.020 Elected mayor-Additional compensation (1) The mayor, elected pursuant to Sections 34900 to 34904 inclusive of the Government Code, shall receive additional compensation of one hundred dollars ($100) per month in addition to the compensation he receives as a member of the city council.
