RECOMMENDED ACTION:
Adopt Resolution No. 2009-033 _, denying the appeal by Briana Cardosa, Managing
Member of Mr. Peabody's LLC, of the Carlsbad Police Department's recommendation that the
Department of Alcohol Beverage Control (ABC) deny an amendment to the liquor license for
Mr. Peabody's Pub & Grill to extend the hours of liquor service from 12:00 midnight to 2:00 a.m.
ITEM EXPLANATION:
In 1995, the State Legislature empowered the City Council to make determinations regarding
whether applications for alcohol beverage licenses for premises within the City serve the public
convenience or necessity. Through the adoption of Resolution No. 95-86, the City Council
delegated this duty to the Police Department, subject to the right to appeal to the City Council.
In 1997, the State Legislature empowered the City to comment on applications to modify or
remove conditions on existing alcohol beverage licenses for premises within the City. Just as
with issuing an alcohol beverage license, the City's primary concerns in modifying a license is
the potential effect on crime, noise, and other disturbances in the area, created by inebriated
patrons. Due to their expertise to assess these concerns, this duty was also delegated to the
Police Department, by the adoption of Resolution No. 2003-207. The Police Department
determinations regarding these applications are also subject to the right of appeal to the City
Council.
The owners of Mr. Peabody's Pub & Grill have applied to the Department of Alcohol Beverage
Control to extend the hours of liquor service in their establishment from 12:00 midnight to 2:00
a.m.. The applicants also applied to the Housing Redevelopment Department for a land use
permit to allow live entertainment at the restaurant. The request for the land use permit was
subsequently withdrawn. The Carlsbad Police Department evaluated the requested alcohol
license amendment on behalf of the City, and recommended that the Department of Alcohol
Beverage Control deny the request to amend the conditions of the establishment's liquor
license to extend the hours of liquor service. The recommendation to deny the extension of the
hours of liquor service was made "on the grounds that it will aggravate existing law enforcement
problems."
On November 25, 2008, the applicant was notified in writing of their right to appeal the Police
Department's recommendation to the City Council within ten days of receipt of the letter,
pursuant to the provisions of Resolution No. 2003-207. On December 5, 2008, the applicant,
Briana Cardosa, Managing Member of Mr. Peabody's LLC, filed an appeal of the Police
Department's recommendation in the Office of the City Clerk.

FISCAL IMPACT:
Denying the appeal would result in the possible loss of sales tax from additional liquor sales.
Granting the appeal and recommending that the Department of Alcohol Beverage Control
approve the request to extend the hours of liquor sales could result in greater police resources
being expended in this area.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) pursuant to
Section 15270 of the CEQA Guidelines. Section 15270 specifies that CEQA does not apply to
projects which a public agency rejects or disapproves. Should the city Council decide to grant
the appeal the project could be found to be exempt from CEQA pursuant to Section 15301 of
the CEQA Guidelines as a Class 1 exemption. Class 1 exemptions include the operation,
permitting, and licensing of existing facilities involving negligible expansion of use.

evaluation of our request to extend our hours of business.

About two years ago we were forced to reduce our seating capacity, not just a little, but by over half.

Yet we just kept working, and somehow have survived, but we are far from booming. Now, just holding on by a
thread. We are not contributing to the tax base like we were, but think we still can.
Our bookkeeper has discovered so far, that our revenue since the reduction in seating capacity has declined more
than $518,000.000 as a result. This has put a severe strain on us and a strain on our ability to contribute to the
community. Our first idea was to try to compensate for the revenue lost by spending ten months applying for an
"entertainment permit" which we were inexplicably denied? In light of the city's claims above: "A robust local
economy benefits everyone... " and a strong "business friendly environment"..? Why has this seemingly gone
away? Please, come to our place, you will find it agreeable in every way I am certain. We are the business you
want. So now we simply ask to be open two more hours, please, do not recommend against this innocent request.
We can generate a sustainable income and tax contribution again we think, or get close, if we can fully function just
two more hours a night, that's all. We are not asking you to do anything but to let us work a bit longer for you in the
exact same manner as we do in the current hours.
Seems easy right, seems like a no brainer to say heck yeah, stay open. We feel this fabrication about "fear of
increased crime" does not have any compelling basis in reality? Fear of increased crime as an opposition to the
easiest solution in the world, which is to simply let us do our thing for everyone? Let me show you the videotapes
of your "fears" or simply come by our place at any night you choose. You will see that you have nothing to fear
from us. Our neighbors have full hours, they are not family friendly and they are just bars. Our neighbors have
changed their licenses, extended hours, and have had no history of contribution like we have, they had younger
licenses and worse records.
Also, alternatively, if noise (of which we produce very little) is a concern weighing against our request during the
week. We ask that you might see your way clear to not opposing extended hours for solely Friday and Saturday
nights. Every bit will help.
We are Carlsbad and we want to help represent success here.

Dear Mr. Escobosa:
This letter is a follow up to the letter written to you and Ms. Cardosa on November 21,
2008 by the City's Housing and Redevelopment Director, Ms. Debbie Fountain. As she
stated, because your request for a land use permit to have live entertainment at your
client's restaurant has been withdrawn, the only recommendation for appeal would be
the Carlsbad Police Department's recommendation to the ABC that they not amend the
conditions of your liquor license to extend the hours of liquor service to 2:00 a.m.
As Ms. Fountain explained, the Department of Alcohol Beverage and Control makes the
ultimate determination regarding the hours of operation for your liquor license.
However, you can appeal the Police Department's recommendation of denial directly to
the City Council per City Council Resolution No. 95-86. Since it has taken some time to
clarify the applicable process, the City will consider your written appeal timely if it is filed
with the City Clerk within 10 days of the mailing of this letter. You will be appealing only
the Police Department's recommendation as set forth in Samantha Tubeville's letter of
August 22, 2008 to Robin Van Dyke. That recommendation to deny the extension of
the hours of liquor service was made "on the grounds that it will aggravate existing law
enforcement problems." As I stated above, the land use issue discussed in that letter is
no longer applicable.

Dear Ms. Cardosa and Mr, Esoobosa;
On July 28,2008, you submitted a petition to the State Department of Alcohol Beverage Control
(ABC) to modify conditions on your alcohol sales license to allow for live entertainment and to
extend your operating hours from ll:00pm on the patio and I2:00aro within your restaurant to
2:00am for both areas (as related to alcohol sales and entertainment). On August 13, 2008, the
Housing and Redevelopment Department forwarded correspondence to ABC requesting that
there be no modifications to your license until you received approval of a required land use
permit that would allow for entertainment. As we noted in our letter to ABC, your establishment
is approved as a restaurant only with the incidental service of alcohol. The establishment is not
approved for live entertainment or allowed to become a bar only at any time (where alcohol sales
are primary and no longer incidental to food sales) during operating hours, The land use
designation and related land use restrictions for your business establishment were shared with
you in correspondence dated on both May 14, 200? and August 13, 2008,
On August 8, 2008.. our office received additional correspondence from you indicating that you
would like to extend the operating hours of your restaurant to 2;00am for both the patio and
interior premises. Based on a subsequent phone conversation, we understood that you no longer
wished to add entertainment and simply wanted to extend the operating hours for your restaurant.
Our office responded to your request on September 29, 2008 indicating that we would support an
extension of your operating hours for the restaurant but were still not supporting any
modification to the hours for the sale of alcohol, as regulated and originally conditioned by ABC.
Because your ABC license indicates that the sale, service and consumption of alcoholic
beverages is permitted on the patio until 1 l:00pm and within the premises until !2:00am, we
indicated that you could extend food sales, service and consumption hours until 2;00am but that
no extension of hours on alcohol sales, service and consumption would be permitted. This
response was based on the conditions placed on your license by ABC, It should have been
additionally noted in our correspondence that ultimately the City has no authority/jurisdiction

regarding the issuance of ABC licenses and/or the related restrictions/conditions. We, together
with the Carlsbad Police Department, do provide input to ABC on the allowed land use and may
object to new licenses and/or modifications to existing licenses if we have concerns related to
alcohol related crime and/or related problems. ABC considers our input and/or objections, but
ultimately the jurisdiction and/or authority for issuing and conditioning licenses to sell alcohol
rests solely with ABC,
On October 14, 2008, you submitted an appeal of my (Housing and Redevelopment Director)
decision to object to a modification to your ABC license to extend the hours for alcohol sales,
This is an unusual matter for our Department because you appealed our input to ABC rather than
a denial or conditional approval of a land use permit issued by our office, and we had difficulty
determining the appropriate process for your appeal. Ultimately we agreed to process your
appeal. However, after further analysis/review and consultation with our legal counsel, we have
made a final determination that this is not a decision that can be appealed to the Design Review
Board and/or other legislative body within the City of Carlsbad, Our legal counsel has
determined that the appropriate agency for your appeal is the State Department of ABC. As I
noted above, ABC ultimately has the jurisdiction/authority to issue licenses, apply conditions
and/or modify/remove conditions, for the sale of alcohol. Although ABC must notify the local
governing body of any petition to remove or modify license conditions and our Department (as
well as die Police Department) previously objected to the requested modifications, the final
decision on the modifications ultimately is that of ABC. As the Housing and Redevelopment
Director, I have made no specific decision on the hours for alcohol sales which can be appealed
to our legislative bodies. Our Department objected to the modifications for the reasons set forth
within our correspondence to ABC. However, we did not make a final decision on your petition
for modifications to your ABC license, This is a decision that must be made by the ABC after a
hearing. You will need to argue your case and provide information directly to ABC which allows
them to determine that the grounds (including that an unconditional license would aggravate
existing law enforcement problems) upon which the imposition of the original conditions have
been satisfied and no longer exist, and therefore the conditions should be modified or removed.
Enclosed please find your original appeal form and cashier's check made payable to the City of
Carlsbad for $860.27.1 am returning this form and check to you since we are not able to process
your appeal and therefore did not deposit your payment. If you have any questions regarding this

The Carlsbad Police Department wishes to protest the modification of conditions on a Type 47
(On-Sale General - Eating Place) to Mr. Peabody's, located on 300 Carlsbad Village Drive STE
#202, Carlsbad, Ca 92008, on the grounds that it will aggravate existing law enforcement
problems.
On August 13, 2008, Debbie Fountain with the City of Carlsbad, Housing and Redevelopment
also submitted a denial to your office, because the request is not within Mr. Peabody's land use.
Until Mr. Peabody's land use application for modification is received and approved by The City
of Carlsbad, Housing and Redevelopment, Carlsbad Police Department will not permit any
modifications to their existing license. The Carlsbad Police Department would consider a
withdrawal of the protest to the conditions based on agreeable conditions set forth by the
Department of Alcoholic Beverage Control.
