RECOMMENDED ACTION:
Adopt Resolution No. 2009-043 amending Resolution No. 2003-120 to refer to the correct reference
for the powers and duties of the Beach Preservation Committee.
ITEM EXPLANATION:
On June 6, 1986, the City Council adopted Resolution No. 8596 creating and establishing the Beach
Erosion Committee.
On June 22, 1993 the City Council rescinded Resolution No. 8596 and adopted Resolution No. 93-178
setting new guidelines and establishing terms for the members of the Beach Erosion Committee.
On May 6, 2003 the City Council adopted Resolution No. 2003-120 renaming the Beach Erosion
Committee to the Beach Preservation Committee and inadvertently referred to rescinded Resolution
No. 8596 for a second time. To correct this error it is recommended that Resolution 2003-120 be
amended to refer to the correct Resolution No. 93-178.
FISCAL IMPACT:
There is no fiscal impact.
ENVIRONMENTAL IMPACT:
This is not a project within the meaning of CEQA and falls within the general exception of CEQA
regulations 15060(c)(3).

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, CREATING AND ESTABLISHING
3 THE BEACH EROSION COMMITTEE.

5 WHEREAS, the City Council has deemed the existence of a
6 Beach Erosion Committee to be in the interest of the City; and
7 WHEREAS, said committee shall serve in an advisory
8 capacity to the City Council, and more particularly its BEACh
9 representative; and
10 WHEREAS, the City Council has by motion decreed that this
11 committee shall remain in existence to render research activ-
12 ities, informational reports, and support to the City on beach
13 erosion topics.
14 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
15 City of Carlsbad, California, as follows:
16 1. That the above recitations are true and correct.
17 2. That the Beach Erosion Committee shall serve as an
18 advisory committee to the City Manager and City Council.
19 3. That the Beach Erosion Committee shall investigate and
20 report on topics or studies related to beach erosion as
21 directed by the City Manager and City Council.
22 4. Committee shall be comprised of a maximum of seven (7)
23 members from the citizens of Carlsbad with a minimum of three
24 (3) active members plus two (2) City staff members to be
25 appointed from the Engineering and Planning Departments.
26 Maximum term for any member shall be four (4) years. Members

5. Committee members are expected to attend all
meetings. Any member who misses three (3) meetings will be
replaced by a designated replacement to be selected by the City
Council.
6. Meetings will be held not less than quarterly at the
City Council Conference Room from 6:00 to 8:00 P.M. or more
often at the request of the City Manager or BEACh
representative. All meetings are open to the public. The
agenda for each committee meeting will be prepared by the
Chairman of the committee. Agenda packets are to be
distributed in advance of each meeting.
7. A committee report will be submitted to the City
Council and the City Manager following each meeting including
the committee minutes for that meeting.
8. Staff members shall be appointed by the City Manager
or his authorized representative. Any fiscal budgetary
requirements shall be brought to the City Council for
approval.
9. Committee shall be a standing committee which may be
terminated by the City Council if it deems the existence of the
committee to be no longer necessary to the City government.
10. Members shall serve on a volunteer basis with
reimbursement for expenditures authorized in advance by the
City Manager.

RESOLUTION NO. 93-178
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, RESCINDING RESOLUTION NO. 8596 AND RE-ESTABLISHING
THE BEACH EROSION COMMITTEE.
WHEREAS, the City Council of the City of Carlsbad, California did on June 10,1986 adopt
Resolution No. 8596 creating and establishing the Beach Erosion Committee; and
WHEREAS, the guidelines established are no longer appropriate for the functioning of the
Committee; and
WHEREAS, the City Council deems that the existence of a Beach Erosion Committee to
be in the interest of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That Resolution No. 8596 dated June 10, 1986 is hereby rescinded.
3. That the Beach Erosion Committee shall serve as an advisory committee to the City
Council and City Manager.
4. That the Beach Erosion Committee shall investigate and report on topics or studies
related to beach erosion as directed by the City Council and City Manager.
5. That the Committee shall be comprised of seven members from the citizens of
Carlsbad appointed by the Mayor with the concurrence of the City Council.
6. That the current members terms shall be staggered as shown in Attachment 1 to this
Resolution and made a part hereof.
7. That members are expected to attend all meetings. Any member who misses three
consecutive unexcused meetings will be replaced by a designated replacement to be appointed
by the Mayor with the concurrence of the City Council.

8. That meetings will be held at dates and times as set by the Committee or as requested
by the City Council or City Manager. All meetings are open to the public except as otherwise
provided by applicable law.
9. That a summary report will be submitted to the City Council and the City Manager after
each meeting.
10. That any fiscal budgetary requirements shall be brought to the City Council for
approval.
11. That the Committee shall be a standing committee which may be terminated by the
City Council if it deems the existence of the Committee to be no longer necessary to the City
government.
12. That members shall serve on a volunteer basis with reimbursement for expenditures
authorized in advance by the City Manager.
13. That the Committee may appoint subcommittees from their membership. Such
subcommittee meetings shall be open to the public except as otherwise provided by applicable
law.
14. That the Committee may adopt rules and procedures for the functioning of the
Committee when not in violation of this Resolution, the Municipal Code or State laws.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, RENAMING THE BEACH EROSION
COMMITTEE TO THE BEACH PRESERVATION COMMITTEE.

WHEREAS, on June 10, 1986, the Carlsbad City Council adopted Resolution No. 8596
5
creating a permanent Beach Erosion Committee and outlining its function and rules; and
6
WHEREAS, the City Council has deemed the existence of a Beach Erosion Committee to
7
be in the interest of the City; and
8
WHEREAS, said Committee serves in an advisory capacity to the City Council; and
9
WHEREAS, the nature of coastal awareness is shifting from strictly evaluating the affects
10
of coastal erosion to a more encompassing view of shoreline preservation; and
11
WHEREAS, the Beach Erosion Committee is requesting that the City Council rename the
12
Committee to the Beach Preservation Committee; and
13
WHEREAS, the name change does not alter the duties, roles, or reporting responsibilities
14
of the Committee as outlined in Resolution No. 8596.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
16
California, as follows:

1. That the above recitations are true and correct.

2. That the City Council renames the Beach Erosion Committee to the Beach
19
Preservation Committee.20

3. That the Beach Preservation Committee shall continue to serve as an advisory
committee to the City Manager and City Council as outlined in Council Resolution No. 8596.

10 WHEREAS, the on June 22, 1993 the City Council rescinded Resolution No. 8596 and
11 adopted Resolution 93-178 setting new guidelines for conducting Committee activities and
*2 staggering the terms of all members; and
WHEREAS, on May 6, 2003 the City Council adopted Resolution No. 2003-120 renaming

the Beach Erosion Committee to the Beach Preservation Committee to encompass a broader
15
spectrum of the Committee's functions to include both erosion and shoreline preservation; and16
Y] WHEREAS, Resolution No. 2003-120 renaming the Beach Erosion Committee to Beach
18 Preservation Committee inadvertently refers to the rescinded Resolution No. 8596; and
iy WHERAS, to correct this error it is recommended that Resolution 2003-120 be amended

to reference the correct Resolution No. 93-178.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
