RECOMMENDED ACTION:
Adopt Resolution No. 2009-045 to reject all bids and authorize the City Clerk to re-advertise
for bids for the Repair of Palomar Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700.
ITEM EXPLANATION:
This project will repair the damaged concrete areas and replace the corroded guardrails on the
Palomar Airport Road Bridge over Carlsbad Boulevard. In addition, concrete repairs and deck
treatment will be applied to the adjacent bridge over the railroad tracks.
On December 9, 2008, City Council adopted Resolution No. 2008-326 which authorized advertising to
receive bids for construction. Six (6) bids were received, opened, witnessed, and recorded on
February 11, 2009, and the bids are listed in the table below.

The engineer's estimate was $760,000. As shown in the table above, the apparent low bidder, DRP
Construction, submitted two different bid schedules in their sealed bid package. A letter protesting the
award of contract was received on February 12, 2009 from HAR Construction (attached) Based on
the review ot the submitted bids, staff recommends that the bids be rejected and the City Clerk be
authorized to re-advertise for bids for tne Repair of Palomar Airport Road Bridge over Carlsbad
Boulevard, Project No. 4700.
ENVIRONMENTAL IMPACT:
This project is a Class 2 categorical exemption (replacement or reconstruction of existing structures or
facilities) and is, therefore, exempt from environmental review pursuant to Section 15302 of the
California Environmental Quality Act (CEQA).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, REJECTING ALL BIDS AND
AUTHORIZING THE CITY CLERK TO RE-ADVERTISE FOR BIDS

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6 necessary, desirable, and in the public interest to Repair Palomar Airport Road Bridge Over

10 Works-Engineering Department of the City of Carlsbad and are incorporated herein by reference;
and

WHEREAS, funding for said project has already been appropriated from GCC and
12 Proposition 42 Funds in the amount of $1,074,000 to cover all project costs; and

WHEREAS, the plans and specifications for furnishing all labor, materials, tools,
equipment, transportation, and other incidentals have been prepared and are on file in the Public
WHEREAS, six (6) bids were received on February 11, 2009 for the Repair of Palomar
Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700; and
._ WHEREAS, the City Council hereby finds it necessary, desirable, and in the public
interest to follow the provisions of California Public Contracts Code, Section 22038, and Municipal

Code Section 3.28.110, whereby the City, in its discretion, will reject all bids and seek new bids for
this project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the City rejects all bids received on February 11, 2009 for the Repair of
Palomar Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700.
22 3. That the City Clerk of the City of Carlsbad is hereby authorized and directed to
OQ publish, in accordance with State law, a Notice to Contractors Inviting Bids for the Repair of
Palomar Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700, in accordance with the
plans, specifications, and contract documents referred to herein.

Dear Mr. Davis,
Upon review of the bid package submitted by DRP Construction Company, it is noted
that they have submitted two sets of bid schedules of which the total amounts are different. Due
to this discrepancy we find that the disqualification of DRP Construction Company is necessary.
We respectfully request that you give due consideration to the facts and find HAR
Construction, Inc. to be the lowest responsible qualified bidder.
