ENG REJECT ALL BIDS AND AUTHORIZE THE CITY CLERK TO RE-ADVERTISE FOR BIDS FOR REPAIR OF PALOMAR AIRPORT ROAD BRIDGE OVER CARLSBAD BLVD PROJECT NO. 4700 DEPT. HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 2009-045 to reject all bids and authorize the City Clerk to re-advertise for bids for the Repair of Palomar Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700. ITEM EXPLANATION: This project will repair the damaged concrete areas and replace the corroded guardrails on the Palomar Airport Road Bridge over Carlsbad Boulevard. In addition, concrete repairs and deck treatment will be applied to the adjacent bridge over the railroad tracks. On December 9, 2008, City Council adopted Resolution No. 2008-326 which authorized advertising to receive bids for construction. Six (6) bids were received, opened, witnessed, and recorded on February 11, 2009, and the bids are listed in the table below. Contractor Name 1A. DRP Construction - Bid A IB. As shown in the table above, the apparent low bidder, DRP Construction, submitted two different bid schedules in their sealed bid package. A letter protesting the award of contract was received on February 12, 2009 from HAR Construction (attached) Based on the review ot the submitted bids, staff recommends that the bids be rejected and the City Clerk be authorized to re-advertise for bids for tne Repair of Palomar Airport Road Bridge over Carlsbad Boulevard, Project No. 4700. ENVIRONMENTAL IMPACT: This project is a Class 2 categorical exemption (replacement or reconstruction of existing structures or facilities) and is, therefore, exempt from environmental review pursuant to Section 15302 of the California Environmental Quality Act (CEQA). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City rejects all bids received on February 11, 2009 for the Repair of Palomar Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700. 22 3. Due to this discrepancy we find that the disqualification of DRP Construction Company is necessary.
