RECOMMENDED ACTION:
That the City Council, by motion, authorize a closed session regarding initiation of litigation as
follows:
Based on existing facts and circumstances to discuss possible
litigation against the Carlsbad Unified School District pursuant to
Government Code section 54956.9(c).

Simultaneously, I learned on your website that a Special Meeting is being held to discuss possible litigation
against the CUSD, and the North County Times article stated that a number one (1 ) priority for the City will be
improving traffic congestion.
With that in mind, I would hope, that if the City is truly sincere, it will challenge the totally flawed traffic data and
overriding considerations in the CUSD FEIR. At the School Board Hearing on the FEIR, Your Assistant City
Attorney, Jane Mobaldi spoke of the City's concern about the Traffic assumptions stated in the FEIR. Your
Traffic Engineer, Director of Public Works and another City person were present.
I do not understand how a public agency, a School Board, in this case can certify a document that so incorrect
in many ways. How can they assume that College Boulevard Reach A will be built and operative when they
plan to build the new High School.
I think the City owes it to all citizens to "stand up and be counted" by challenging the CUSD FEIR through
