EMERGENCY FOR REPAIR OF THE SEWER LINE AT

City Council adopt Resolution No. _
declaring that the emergency has been abated.
ITEM EXPLANATION:
On March 17, Council declared a Local Emergency to complete urgency repair work of the sewer line
on Carlsbad Blvd. The rehabilitation of the sewer line is now complete and the emergency has
abated. Current law requires that a report be provided every two weeks on the status of the
emergency. The press of business did not allow for a report to occur within the 14 day report period
and therefore, this action is to retroactively cover the report period up to March 31, 2009 as well as to
terminate the local declaration of emergency, effective April 7, 2009.
ENVIRONMENTAL IMPACT:
Emergency projects are statutorily exempt from CEQA pursuant to CEQA Guidelines section 15269.
FISCAL IMPACT:
The City Council approved the estimation of funds by the Public Works Department at its meeting of
March 17, 2009. The contract services were provided at a cost of $37,500 and there are no additional
costs anticipated with this event.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, DECLARING THAT THE LOCAL
EMERGENCY IS TERMINATED FOR THE REPAIR OF THE
4 SEWER LINE AT CARLSBAD BLVD.
5 WHEREAS, on March 10, 2009 conditions of extreme peril to the safety of
6 persons and property arose within the City of Carlsbad caused by extreme corrosion of
an 8" sewer line conveying wastewater from the east side of Carlsbad Blvd. at Pine
8 Street, in Carlsbad, California; and
9
WHEREAS, the corroded pipeline created the potential for a sewer back up
10
which was a threat to public health and the environment; and11
WHEREAS, it was necessary to mobilize City staff and contractors to facilitate
13 the emergency repairs thereby eliminating the potential for a sewer spill creating public
14 health and safety concerns; and
15 WHEREAS, on March 12, 2009, the City Manager declared a state of Local
16 Emergency after the City determined that the damage to sewer lines created a threat to
public health and safety and met the criteria for an emergency as defined in Public
18 Contract Code Section 1102, and
19
WHEREAS, on March 17, 2009, the City Council declared a state of Local
20
Emergency and approved the estimation of funds by the Public Works Department for
21
the urgency repair, and
23 WHEREAS, the press of business did not allow for a report to occur within the 14
24 day report period and this resolution if effective nunc pro tunct to retroactively cover the
25 report period up to March 31, 2009; and
26 WHEREAS, said Local Emergency has been abated and there is no need for the
27 state of Local Emergency to continue.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. This resolution is effective to cover the reporting period from March 17,
2009 to March 31, 2009 nunc pro tune.
3. The declaration of emergency is hereby terminated according to State law.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 7tb day of April , 2009, by the following vote, to wit:
AYES: Council Member? Lewi?, Kulcbin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
