RECOMMENDED ACTION:
Adopt Resolution Nos. 2009-070 2009-071 2009-072 and 2009-073 for
approval to apply for Federal Infrastructure Funding for Beech Avenue Sewer Replacement, City Project
No. 5512; Home Plant Lift Station Influent Sewer Replacement, City Project No. 3873; Tamarack Sewer
Replacement, City Project No. 5510 and Buena Vista Force Main Replacement (VC-4), City Project No.
5508.
ITEM EXPLANATION:
On January 27, 2009 staff presented a report as identified in Agenda Bill No. 19,705 to City Council
concerning the status of infrastructure project requests made for federal funds. The presentation provided
a list of the City's infrastructure projects to be considered for funding through the proposed federal stimulus
package. Subsequently, the American Recovery and Reinvestment Act (ARRA) of 2009 has been
approved, providing subsidy funds and low interest loans for the construction of infrastructure
improvements. The State Water Resources Control Board (State Water Board) under specified guidelines,
implements the disbursement of portions of said federal funds in the form of grants and loans, through the
Clean Water State Revolving Fund (CWSRF) Program. Applications are now being accepted for the
funding. Engineering staff has identified four City sewer replacement projects which may be eligible for a
grant or a 1% interest loan. Staff understands through correspondence with the Division of Financial
Assistance of the State Water Board that the funding is limited, and grant money will be distributed to lower
income communities and projects which had previously lost State grant funding. The City of Carlsbad has
a much greater chance of receiving the low interest loan than receiving grant funds.
Staff is requesting approval to apply for federal infrastructure grants and loans through the State Water
Board for the construction of the following projects: Beech Avenue Sewer Replacement, Project No. 5512;
Home Plant Lift Station Influent Sewer Replacement, Project No. 3873; Tamarack Sewer Replacement,
Project No. 5510 and Buena Vista Force Main Replacement (VC-4); Project No. 5508. Disbursement of the
funds is time sensitive, based on order of the application dates. If authorized by City Council, staff will
submit applications for grants and loans for each of the projects at the earliest date possible. The State
Water Board will determine if the individual projects are eligible for a grant. If grant money is not available,
the City will request the application be considered for the 1% loan.
ENVIRONMENTAL IMPACT:
The application for grant funds does not constitute a "project" pursuant to Section 15378(b)(4) of the
California Environmental Quality Act (CEQA) and no environmental review is required. The proposed
scope of work (repair and maintenance of existing facilities) for the Beech Avenue Sewer Replacement,

City Project No. 5512; Home Plant Lift Station Influent Sewer Replacement, City Project No. 3873 and
Tamarack Sewer Replacement, City Project No.5510 belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and are therefore
categorically exempt from the requirement for the preparation of environmental documents pursuant to
Section 15301(b) - Existing Facilities - of the State CEQA Guidelines. In making this determination, the
Planning Director has found that the exceptions listed in Section 15300.2 of the State CEQA Guidelines do
not apply to these three projects. However, per Section 15063 of CEQA a Mitigated Negative Declaration
and a Mitigation Monitoring and Reporting Program is required, and is being prepared, for the Buena Vista
Lift Station Sewer Force Main (VC-4), City Project No.5508. The mitigation measures will be incorporated
into the plans and specifications.
FISCAL IMPACT:
If awarded, the grants could provide up to a maximum of fifty percent of the construction cost which would
amount to approximately $2.5 million dollars. If the City were to receive loan funding at a rate of 1%, the
City could realize a net gain of approximately $1.5 million in interest earnings over a 20 year period based
on a $5.0 million dollar loan. The receipt of either grant or loan funding would reduce the amount of money
needed from the Sewer Replacement Fund.
