I,LLA/ RECOMMENDED ACTION: Adopt Resolution No. 2009-079 approving operating and construction options for Alga Norte Community Park and Aquatic Center, Project Nos. 3837 and 3925. ITEM EXPLANATION: The proposed Alga Norte Community Park is located at the northwest corner of the intersection of Poinsettia Lane and Alicante Road (Exhibit 1). On December 17, 2002, the City Council adopted Resolution No. 2002-371 approving the Alga Norte Community Park Master Plan featuring an aquatic center, three baseball fields, a dog park, a skatepark, basketball courts, playgrounds, open space, and parking. The aquatic center includes a competitive pool, a 12-lane instruction pool, a therapy pool, and a recreational component with wet play structures, slides, and a moving river. The aquatic center also includes 13,000 square feet of building space for a mechanical building, an administration building, locker room facilities, group meeting facilities, a fitness room, and a concessions kitchen. .Other buildings at the proposed park include a maintenance facility, numerous pumping station structures, chlorination building, a snack bar, and three public restrooms. The Alga Norte Community Park and Aquatic Center was designed to achieve the basic level of "certification" in accordance with the Leadership in Energy and Environmental Design (LEED) rating system developed by the U.S. Green Building Council (USGBC). On July 17, 2007 Council adopted Resolution 2007-186 approving the plans, specifications, contract documents, and authorizing staff to advertise for bids. On December 18, 2007, by Resolution No. 2007-326, the Council rejected the bids received for construction of the park and aquatic center and authorized staff to re-advertise the project and receive new bids. On February 26, 2008 the Council directed staff to redesign the project into two phases, deferring construction of the recreational component in the aquatic center to Phase 2. Phase 1 of the project would include three baseball fields, a dog park, a skatepark, basketball courts, playgrounds, open space, and parking, as well as a competitive pool, a 12-lane instruction pool, and a therapy pool in the aquatic center (see Exhibit 2 for Phase 1 aquatic center concept). On July 22, 2008 staff requested permission to re-advertise the revised Phase 1 of the project; however, due to the changing economic conditions and concern about impacts of State budget, Council decided to place the project on hold. Council directed staff to identify options for funding the operating and maintenance costs for Phase 1 and to return the matter following a review of the State's budget. The State's Fiscal Year 2008-09 budget was revised in February 2009 and staff's review indicates that uncertainty still remains regarding the State budget and the overall economy. COUNCIL ACTION: APPROVED DENIED CONTINUED WITHDRAWN AMENDED Dn nn CONTINUED TO DATE SPECIFIC CONTINUED TO DATE UNKNOWN RETURNED TO STAFF OTHER -SEE MINUTES Dnnn On March 3, 2009 at a Council Workshop, staff was directed to update the probable cost of construction to reflect the current construction bidding climate and to revise the construction cost to include market rate wages (non-prevailing). A comparison of July 2008 and March 2009 Phase 1 estimated costs are provided in Table 1. Staff has researched options for funding the operating and maintenance costs. Corporate sponsorship was investigated; however, staff has not included this as a viable option at this time due to the current economic conditions. Operating options exist for both the aquatic center and community park: Operating Options- 1. City operate - based on the Parks & Recreation business model. 2. Lease or management contract - City would build the project and contract out the operation and maintenance to a third party similar to the arrangement with the municipal golf course. 3. Ground lease - the City would grade the site and lease it to a third party to construct, operate, and maintain. 4. Public Private Partnership/design-build - this option could be a variation of item 2 or 3 with a partnership or operating agreement. A design-build component has been added to this option anticipating changes to the project requested by the third party to meet their business model. Design-build is not a viable option until such time that Carlsbad adopts a design-build ordinance. Staff has also included construction options for Council consideration: Construction Options- 1. Maintain hold on project 2. Build Phase 1 project as proposed 3. Rough grade site meeting future park development requirements 4. Build the project with only the phase 1 aquatic center 5. Build project without aquatic center Staff has prepared a presentation to discuss these options in more detail. ENVIRONMENTAL IMPACT: On March 1, 2006, the Planning Commission adopted Resolution No. 6039 and 6040, adopting a Negative Declaration (ND) and Conditional Use Permit No. 04-08, respectively for the project. FISCAL IMPACT: The updated project cost estimated for Alga Norte Community Park and Aquatic Center, excluding the deferred recreational component, is shown in Table 1 below. The Aquatic Center appropriation for the entire aquatic project (includes moving river, water slides and wet play structure in Phase 2) is currently $28,315,490, appropriated from the Public Facilities Fees (PFF) Fund, and the General Capital Construction (GCC) Fund - Proposition C. The estimated construction cost for Phase I of construction when combined with the prorated share of the other line item costs in Table 1 is $19,119,449. The Community Park appropriation is currently $22,107,510, appropriated from the PFF Fund. The estimated construction cost when combined with the prorated share of all other line item costs in Table 1 is $20,689,415. The project's total current appropriation is $50,423,000. The project's currently identified financing sources are detailed in Table 2 below. Proposition C approval allowed General Funds to be used in excess of $1 million for specific projects, which included the Aquatic Center. After Proposition C was approved by the voters, , General Funds were set aside in the GCC Fund for those identified projects. Currently $16,215,795 is allocated for the Aquatic Center from GCC - Proposition C funds as well as $6.0 million from GCC funding. PFF funds can only be used for the designated purpose. The net impact to the General Fund is estimated to be $1.2 million per year for Phase 1. The Ten-Year Financial Forecast assumed a $1.5 million total annual operating impact to the General Fund for Alga Norte Park and Aquatic Center beginning in Fiscal Year 2013-2014. The Ten-Year Financial Forecast will be updated to reflect these current operating estimates, however, even with a lower annual operating impact, the Ten-Year Financial Forecast does not have capacity to support the annual operating and maintenance costs for this project. The forecast is currently assuming a three year recession with a slow economic recovery beginning in FY 2011-12. The City has reduced General Fund operating expenditures for FY 2008-09 by $5.3 million and is planning to reduce operating expenditures for FY 2009-10 by an additional $4- 4.5 million. Even with these additional expenditure reductions, the Ten-Year Financial Forecast is reflecting budget deficits over the next several years. In addition, while there may be one-time funding that could be identified to help support the operation and maintenance of the project in the short-term, it is not fiscally prudent to pursue one-time funding to support ongoing operations and is not recommended at this time especially given the current economic uncertainty. There are many reasons why I believe this is the right time to move forward on the project. The most important, however is the construction costs are an all time low. There is a lot of competition out there right now. I understand that the construction estimates have come in about ten million dollars under what has been budgeted for the project. Why not move forward on the complex and put the remaining ten million dollars into an enterprise fund, using the interest off the fund to cover maintenance and operations. With what you could generate from the park and the interest money you may come close to the O and M costs projected. None of our park facilities cover their entire O and M costs completely, that's what tax dollars are for. Unfortunately, I just had the chance to check my calendar and won't be able to attend as we have our regularly scheduled board meeting at the same time. Therefore I would like to express my endorsement for the project, and hope that someone will be able to present this brief report to the council. I have already sent detailed feedback to Brian Albright regarding some of the design considerations for the ballfields, and Brian could report on that if he wishes. The primary reasons for my endorsement of the new facility are: 1) With only 1 swimming complex in Carlsbad, there is an overwhelming need for another 2) Ballfields are currently used almost to the max by user groups such as ours. Benefits of increasing the stable of available fields would be: a) User groups could more effectively run their programs without compromises such as very late nights for school children b) Existing fields could be better maintained by taking them offline for longer periods to rest where needed c) Fields could be better aligned with user groups geographically d) additional "community time" could be scheduled on some fields where that is seen as a benefit by local resident. e) Replacement for Safety Center field is needed almost immediately as construction is apparently slated for 2010. We specifically chose to live in the Carlsbad neighborhood of Bressi Ranch because of the walkability and it's proximity to schools and parks. A big draw was the future "Alga Norte Park" project. We have been watching and waiting for this project to happen. It is time for Carlsbad to make good on the promise to build this park . The economic opportunity to build it is now. We would like to see Carlsbad stop dragging it's feet and move forward on this project immediately. My family would like to be able to enjoy this park while our children are still young. Benefits of increasing the stable of available fields would be: a) User groups could more effectively run their programs without compromises such as very late nights for school children b) Existing fields could be better maintained by taking them offline for longer periods to rest where needed c) Fields could be better aligned with user groups geographically d) additional "community time" could be scheduled on some fields where that is seen as a benefit by local resident. e) Replacement for Safety Center field is needed almost immediately as construction is apparently slated for 2010. This project is long overdue, and while we can never predict what tomorrow will bring, I believe the time is right to move forward with this second pool. Pool vs. water park positioning has created division among council members. We end up splitting hairs on this topic, and if the water park was never an issue, the pool would have already been built. The people didn't ask for the water park when it was initially passed many years ago. The need was for a second pool given the growth in our community. In the meantime, those that utilize the one and only pool have had to suffer from less pool time, crowded swim lanes, and trying to balance the needs of the high school sports and clubs with those of the community. Mayor Lewis, in reviewing past meeting notes, you have voted to pass a safety training center for the police and fire departments at the cost of $20+ million, of which, only 25% of the time, will this center be utilized. While I agree that safety is a primary concern for all Carlsbad residents, I also challenge you to visit=2 Othe pool on sign up days for swimming lessons. The lines are outrageous, the cost not affordable for everyone, and the spots are few for those parents choosing to provide swim instruction for their children which is an investment in their safety. Building this second pool would be a proactive investment in the community's safety by providing more opportunities for swim instruction and practice. If you've invested $20+M in the safety provided by the fire and police departments, then I would ask that everyone in Carlsbad be provided the opportunity to take swim lessons for free to ensure that our community members are safe in the waters surrounding Carlsbad. This could not be accomplished with our existing pool. We are a coastal community who prides itself in our beautiful beaches and water activities. We need to invest in the skills that will ensure all residents are safe in the water in the first place. I recognize that many other people will make further arguments in support of the second pool. We are a coastal community who prides itself in our water sports and activities. We have seen the legacy of outstanding athletes and programs that have helped to build our community's reputation. Strayer, Co-Founder In March of 1984,1 sat up a utility table at the current site of the La Costa Heights Elementary School. It was the location of the Carlsbad Boys & Girls Club, La Costa Branch and there were two softball fields before the school was built. I solicited interested athletes over age 35 years of age to participate in an Athletic Club / Softball League. With over 120 people signing up, the birth of La Costa 35 Softball was initiated with 8 three pitch, softball teams. Most of the players signed up to play first base. I had to explain to them that we couldn't play the game with that many players playing first base. By participating with guys their own age, I explained to them that they should play the position that they played in youth sports, like "back to the future". The Club and League was an outgrowth of my experiences at Lycoming College in Williamsport, Pa. I was a Brother of the Kappa Delta Rho Fraternity. We were a jock house in those days, with most of the brothers on the college's varsity sports teams or a member of our fraternity's intramural teams. We loved dancing, music and sports. I was the secretary of the group and organized most of the events. The La Costa 35 Athletic Club was founded on the basis of healthy competition without making winning a priority. My good friend John Mitchell, the founder of La Costa Youth Organization and the Co-Founder of LC35AC, started our clubs touch football league, also in 1984, with four teams. It was John who came up with the most popular definition of the club: "It is basically a club for middle-age athletics in the twilight of their mediocre careers". I was determined to make the club a place where members could live out their sports fantasies, with their names on their uniforms. The games are to be run like pro games, with an announcer calling off there names and the playing of the "Star Spangled Banner, before a ball was thrown or kicked. Carlsbad's Mayor, Bud Lewis and Councilwoman Ann Kulchin have thrown out several first pitches at our opening day or playoff games. Newspaper coverage is also important because it makes the members feel like pros. We even had the Red Robin mascot at our games in the past. Today businesses like Boston Pizza, Athletic Cuts, D Street Bar, Coors Light, Truett Labs, YMI Creative, Postal Annex, Grand Pacific Resorts, Encinitas Dental Care and others sponsor teams in our league. Today, The club has 21 summer softball teams, 6 fall softball teams, 13 touch football teams and a golf group. We now have over 700 members after starting with 120. We have social mixers at places like the La Costa Resort & Spa's, Blue Fire Grill, The Kraken and the BellyUp Tavern. Most of our games are held at Stagecoach or Levante Parks. Information on the Club can be found at www.lacosta35.org. We are open to a few new members, especially Carlsbad residents, however openings are limited. Currently we are looking for touch football quarterbacks. We just held our 25th Anniversary Party this past June and our 30th party is just around the corner. These are our "Glory Days". But Strayer's affec- tion for athletics is most strongly displayed in his greatest project of all — the La Costa Athletic Over 35 Club. "I like athletics mostly for the socializing," said Strayer, who founded the Athletic Over 35 Club in 1984. "Sports mean a lot to our family because of our in- volvement. Last night we went to our daughter's volleyball game and had a good time being with all the parents. When I was in college, I belonged to a fraterni- ty, and while we did a lot of work on academics, it was mostly a social group. We learned to cope with each others' problems. We made friends." One of the club's biggest an- nual projects is "Swing With Your Heart," a baseball tourna- ment designed to benefit local residents in need. In its first year, the tournament raised nearly $10,000 for club member Dave Lowe, stricken by Gullain-Barre disease, which paralyzes its victims. Last year's beneficiaries were 11-year-old Richard Miller, paralyzed after an accident on Rancho Santa Fe Road in 1988, and 17-year-old Jenny Pratt of Encinitas, seriously injured when an unknown assailant hit her with a plank. The group raised about $20,000. This is the kind of work that really excites Strayer. "My kick is doing things for free," he said. "We need more volunteers, and we need to give individual volunteers the recognition they deserve." Strayer also puts in time on the Carlsbad Parks and Recreation Committee, advocating for more parks for area sports programs. He was one of the minds behind Stagecoach Park, which pro- vides more room for youth and adult athletics. Strayer and his family — wife Diane and children James, 19; Paige, 16; and Shaun, 9 — came to La Costa in 1977 when Strayer was promoted to regional man- ager in a lab diagnostics com- pany in Philadelphia. His region was the West Coast, and he had to live in a town near a major airport in .order .to travel! He said he initially planned to settle in Newport Beach,.until he saw the home prices. He drove far- ther south- and wound up driving through La Costa. "I came here and fell in love," he said, gazing at the spec-"' tacular view over his back fence. Strayer eventually decided he didn't likejraveling all the time and landed the job he has now, selling medical laboratory anal- ysis equipment. It involves a lit- tle bit of traveling,. but allows him to devote much more time to the Over 35 Club, he said. WHEREAS, JOHN B. STRAYER has been a part of our community for the past 10 years, and has made numerous contributions to the residents and community during that time; and WHEREAS, JOHN STRAYER founded the La Costa Over 35 Athletic Club, which now numbers 250 members, has 12 mens' Softball teams and a touch football league; and WHEREAS, the La Costa Over 35 Athletic Club also holds several social events during the_year, and has sponsored teams in the La Costa Youth Organization for the past two years; and WHEREAS, JOHN STRAYER has been a strong suppprter for more ballfields in the Carlsbad area, has also given his time as a coach for a La Costa Youth T-Ball team for the past 3 years. THE IRON MEN OF THE LA COSTA 35 ATHLETIC CLUB By John B. Strayer, Co-Founder LC35AC The name of the Club suggests that members must be at least 35 years of age or more to participate. That is true; however, let's talk about the upper age group of the Club. I call them the Iron Men of the LC 35 AC. Paul Shook at 75 is not our eldest player. He has played La Costa 35 Softball for the past 15 years. He was a California native of La Canada and then spent 25 years in Westport, Ct. Paul and his wife Dorothy just celebrated their 51st wedding anniversary. They have three sons and daughters, and nineteen grandchildren. He first played American Legion Baseball followed by football at Marshall Jr. High in Pasadena, Ca. At John Muir High School, he lettered playing baseball and football. He attended John Muir Junior College until joining the Air Force in 1952, during the Korean War. He played football at the Alexandria Air Force Base in Louisiana. He shipped out to Korea in May of 1954 and was attached to the 4th Fighter Interceptor Squadron. Later he was assigned to Misawa AFB in Japan. Playing football on an undefeated Air force team in 1955, he was honored with two player of the game awards and was selected as the quarterback for the Far East Air Force All Stars. His team defeated the Navy All Stars on New Years Day 1955 in the Tokyo Rice Bowl. He was discharged from the Air Force in 1956. That followed with an unsuccessful tryout with the San Francisco 49ers. He met Dorothy in a gas station while playing football at LA Junior College. His season ended early due to some broken ribs. Married in August 1957, He started to play softball with the Pasadena JCs and later while working for IBM, He played in a Long Beach softball league. Working for Xerox in 1963, he was one of two sales people covering Orange County. The following year he put on the cleats again and quarterbacked for the McKenzie Raiders, a Costa Mesa semi-pro team. With five children at home he was encouraged to retire his cleats. In 1969, Paul and his family moved to Westport, Ct. working in the computer industry in New York City. He spent the next 19 years in Little League Baseball with his kids. He was League President for 4 years. He then played recreation softball with his sons and pick-up games at Compo Beach. He finally ended his east coast adventures when the Hong Kong Bank that he worked for at the time, closed down. He was given a "tin" parachute and he returned to La Costa in 1993, to join his daughters and youngest son attending SDSU. Paul joined the LC35 AC in 1994 and has been on teams winning 3 summer and 2 fall championships. Now in semi retirement, Paul has family in Naples, Fl, Costa Rica and La Costa. Nine of his grandchildren have passed through La Costa Heights School and five so far have graduated from La Costa Canyon High with four more coming. Folks this is a true Iron man, still reliving his "GLORY DAYS' in La Costa 35. This is just one of several stories about the Iron Men of LC35AC. It is my pleasure to salute Paul for his service to our country, his family, and for being a member of the La Costa 35 Athletic Club.
