RECOMMENDED ACTION:
Adopt Resolution No. 2009-087
Inc. of $1,565.
authorizing a refund of business license tax to Safeway
ITEM EXPLANATION:
Safeway Inc., Von's Store #2165, ceased conducting business in the City of Carlsbad in
December 2008. After the store closed, Safeway Inc. made a payment for 2009 business
license taxes. They have requested a refund for this payment.
The Finance Department audited the account, confirmed the business closure, verified the
payment for 2009 taxes and ensured compliance with all other business license policies.
Section 5.04.130 of the Carlsbad Municipal Code requires Council approval of any refund in
excess of $500. Therefore, staff is recommending approval of a refund to Safeway Inc. of
$1,565.
FISCAL IMPACT:
The payment will result in $1,565 in refunds. There is no true fiscal impact, as the payment was
in error.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code Section 21065 and CEQA Guidelines Section 15378, this
does not constitute a "project" within the meaning of CEQA and, therefore, does not require an
environmental review.

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, REFUNDING BUSINESS
3 LICENSE TAX PAYMENT TO SAFEWAY INC.
5 WHEREAS, Safeway Inc. ceased doing business in the City of Carlsbad in 2008;
6 WHEREAS, Safeway Inc. paid business licenses taxes for 2009 and requested a
7 refund for these taxes; and
WHEREAS, the Finance Department confirmed the payment by Safeway Inc.
9 and verified the refund amount.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of

Carlsbad, California, as follows:

1. That the above recitations are true and correct.
14 2. That a refund of business license tax of $1,565 to Safeway Inc. is
