(fjJ!^ CITY MGR.\jj- — RECOMMENDED ACTION: Adopt Resolution No. 2009-108 accepting bids and awarding contract for the construction of the Poinsettia Community Park Phase MB Parking Lots, Project No. 4504. ITEM EXPLANATION: The proposed Poinsettia Community Park Phase MB Parking Lots project is located in Poinsettia Community Park, which is accessed from Hidden Valley Road as seen on Exhibit 1. The construction of the parking lots is part of the overall master plan for Poinsettia Community Park approved by Council in 1992. Future phases of the master plan call for a community center, completion of the tennis complex (clubhouse, center court, and practice backstop), additional tot lot, and various other amenities. This project constructs two (2) additional parking lots at the entrance to Poinsettia Community Park. A total of 97 parking spaces (including four handicap parking spaces) in both lots will be constructed. The project includes paving and striping for the parking lots, lighting, and installation of adjacent landscaping. The project also includes low impact development elements such as zero curb and vegetated swales. On March 10, 2009, the City Council adopted Resolution No. 2009-046 approving plans and authorizing to advertise for bids. On April 22, 2009, twenty six (26) bids were received. The bids are summarized in Table 1. The lowest responsive bidder, Marathon General, Inc., submitted a bid in the amount of $231,946. Staff reviewed the bid and found a minor mathematical error. The sum of the extended unit prices is $232,447. This is an addition error by the contractor. The contract document states that in case of bid discrepancies, the bid amount as computed on the basis of extended unit prices shall be used for bid comparisons. The revised bid amount still places Marathon General, Inc. as the lowest responsive bidder. Staff has completed the review of all other contract documents and has determined that they are in order. Carlsbad Municipal Code Section 3.28.080 (A)(7)(c) allows the City Council to waive any minor irregularities in a bid. Therefore, staff recommends that Marathon General, Inc. be award the contract and that the Council waive the minor irregularity created by the discrepancy between the unit prices and the total bid amount. ENVIRONMENTAL IMPACT: This project is consistent with CUP 92-05/HDP 92-09 approved by the Planning Commission in October 1992, as well as the Mitigated Negative Declaration issued by the Planning Director on July 30, 1992. Table 2 shows the current status of the Poinsettia Community Park Phase IIB Parking Lot project. The engineer's estimate is based on bid data for similar projects received by the City in 2008 and 2007, with adjustments for current conditions. This project did not require payment of prevailing wages for construction. The significant decrease in the bid amount as compared to engineer's estimate can be attributed to the current economic conditions, significantly cheaper raw materials, and lack of prevailing wage requirements. That the discrepancy between the total bid amount and the sum of the unit prices 2 is waived. 3. That the bid amount of $232,447 submitted by Marathon General, Inc. is herby accepted and the Mayor is hereby authorized to execute a contract with Marathon General, Inc. 0 for the construction of the Poinsettia Community Park Phase MB Parking Lots, Project No. 4504, 6 in accordance with plans, specifications, and contract documents referred to herein. 4. That the City Manager is hereby authorized to approve construction change Q orders up to $75,000 for Project No. 4504. ° 5. That the award of contract is contingent upon the bidder submitting the lowest 10 responsive bid executing the required contract and submitting the required bonds and insurance 11 policies, as described in the contract, within twenty (20) days of adoption of this resolution.
