HEAD S^ff CITYATTY. /l/~l CITYMGR./^^ RECOMMENDED ACTION: Adopt Resolution No. 2009-129 authorizing the Public Works Director in the name of the City of Carlsbad to execute all necessary forms for the purpose of securing payments and to implement and carry out the purposes specified in Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act and appropriation of funds. ITEM EXPLANATION: Pursuant to Section 14581 (a)(5)(A) of the California Beverage Container Recycling and Litter Reduction Act, the Department of Conservation distributes a total of $10.5 million to eligible cities and counties specifically for beverage container recycling and litter cleanup activities. Each city is eligible to receive a minimum of $5,000 or an amount calculated by the State, per capita based, whichever is greater. The per capita amount calculated by the State is based upon the population, as of January 1, 2008, in incorporated areas of a city, as stated in the Annual Demographic Report submitted to the Governor by the Department of Finance. The City of Carlsbad is eligible to receive $26,955 for this program in fiscal year 2009-10. Staff will submit the application form to the State that describes the recycling activities for which the funds mentioned above will be expended. Staff is requesting the funds focus on the purchase and installation of recycling containers for use in public spaces and targeted areas such as gas stations, oil change facilities and car washes, promotional and advertising programs, internal programs and educational programs. The promotional and advertising programs are intended to utilize print media and to disseminate information to the public on recycling programs available within the City of Carlsbad. ENVIRONMENTAL IMPACT: The approval of this grant application is not considered a project under the California Environmental Quality Act and, therefore, is not required to go through environmental review. FISCAL IMPACT: The City will be allocated $26,955 for fiscal year 2009-10 to administer the aforementioned programs within the City of Carlsbad. The City receives these funds on an annual basis for different initiatives. No matching funds are required. EXHIBITS: 1. That the above recitations are true and correct. 2. That City Council authorizes the submittal of the Funding Request Form to the 20 Department of Conservation's Division of Recycling. 21 3. That the Public Works Director is hereby authorized and empowered to execute, 22 in the name of the City of Carlsbad, all necessary forms hereto for the purpose of securing payments and to implement and carry out the purposes specified in the Section 14581 (a)(5)(A) of the California Beverage Container Recycling and Litter Reduction Act and provide information 24 regarding this program to the Department of Conservation's Division of Recycling upon request. 4.
