(XA_- RECOMMENDED ACTION: Adopt Resolution No. 2009-141 accepting bids and awarding the contract for the construction of Palomar Airport Road Widening at Paseo Del Norte, Project No. 3811. ITEM EXPLANATION: The proposed westbound Palomar Airport Road (PAR) Widening and Deceleration Lane project is located between Armada Drive and Paseo Del Norte (PDN) as shown in Exhibit 1. The improvements include: • Widening westbound PAR to add an additional traffic lane, thus creating a total of four (4) through lanes for vehicles approaching PDN • Installing a Caltrans Overhead Truss Sign Structure that will identify the westbound PAR lane designations In addition to the City's project, CB Ranch Enterprises ("Developer"), under CUP 98-20 and CDP 98-91, will be improving the Flower Fields parking lot located on the northeast corner of the intersection of PAR and PDN, by constructing a deceleration lane from westbound PAR to serve the parking lot. The City's design has incorporated the deceleration lane portion of the Developer's improvements into the City's PAR Widening project to save construction costs (e.g., cost savings exporting fill to the Flower Fields and providing a construction staging area in the Flower Field's parking lot) and to minimize traffic impacts and disruption to the public during construction. A combined project allows for construction to occur once and not as two separate projects. On April 7, 2009, the City Council adopted Resolution No. 2009-063 approving a reimbursement agreement with the Developer, increasing appropriations of funds, approving plans and specifications, and authorizing advertisement of bids. On May 20, 2009, sixteen (16) bids were received. The bids are summarized on the following page in Table 1. The lowest responsive bidder, Sierra Pacific West, Inc., submitted a bid in the amount of $961,240. Staff has completed a review of the contract documents and has determined that they are in order. Therefore, staff recommends that Sierra Pacific West, Inc. be awarded the construction contract. DEPARTMENT CONTACTS: Jacob Moeder, 760-602-2736. ENVIRONMENTAL IMPACT: CIP Project No. 3811 Palomar Airport Road Widening at Paseo Del Norte project is exempt from the provisions of CEQA, pursuant to CEQA Guidelines Section 15301 (c) - Existing Facilities. This project is within the Coastal Zone and CDP 08-07 has been approved in Resolution No. 6439. FISCAL IMPACT: An allocation of $1,244,000 for the Palomar Airport Road Widening project was included in the Fiscal Year 2008-2009 Capital Improvement Program using Traffic Impact Fee (TIF) funds. On April 7, 2009, through Resolution No. 2009-063, an additional $432,019 in TIF funds was appropriated when the authorization to advertise for bids was approved by Council. Table 2 below shows the current funding status of the Palomar Airport Road Widening at Paseo del Norte project. The significant decrease in the bid amount as compared to engineer's estimate may be attributed to the current economic conditions. The total construction cost for both the City's and Developer's project is shown on the following page in Table 3 below. CARLSBAD ENGINEERING DEPT. 2/23/09 C:\CAPITAL\LOCATION UAPS\3811.DWS 1 RESOLUTION NO. 2009-141 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING THE CONTRACT FOR THE CONSTRUCTION OF THE PALOMAR 4 AIRPORT ROAD WIDENING AT PASEO DEL NORTE, PROJECT NO. 3811. 5 WHEREAS, the City Council of the City of Carlsbad, California, has determined it 6 necessary, desirable, and in the public interest to construct one additional westbound through lane on Palomar Airport Road including an Overhead Caltrans Truss Sign Structure; and 8 WHEREAS, on April 7, 2009, through the adoption of Resolution No. 2009-063, the City 9 Council approved the plans and specifications for furnishing of all labor, materials, tools,10 equipment, transportation, and other expenses necessary or incidental to the construction of the11 Palomar Airport Road Widening at Paseo Del Norte Project No. 3811; and WHEREAS, sixteen (16) sealed bids were received on May 20, 2009 for the project; and i O WHEREAS, the lowest responsive bid for the project was submitted by Sierra Pacific West, Inc. in the amount of $961,240; and 10 WHEREAS, funding for said project has been appropriated from the Traffic Impact Fee16 Fund in the amount of $1,676,019 to cover all project costs and is sufficient; and .0 WHEREAS, the City will be reimbursed by CB Ranch Enterprises in the amount ofio .Q approximately $188,313 in accordance with the reimbursement agreement approved through theiy 2Q adoption of Resolution No. 2009-063; and 21 WHEREAS, the City Council has previously determined that payment of prevailing 22 wages will not be required as part of the construction contract per City of Carlsbad Municipal Code 23 Section 3.28.130. 24 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 25 California, as follows: 25 1. That the above recitations are true aifid correct. 27 2. That the bid amount of $961,240 submitted by Sierra Pacific West, Inc. is hereby 2g accepted and the Mayor is hereby authorized to execute a contract with Sierra Pacific West, Inc. 5" 1 for the construction of the Palomar Airport Road Widening at Paseo Del Norte, Project No. 2 3811, in accordance with plans, specifications, and contract documents referred to herein. 3. That the City Manager is hereby authorized to approve construction change orders up to $144,500 for Project No. 3811.4 4. That the award of contract is contingent upon the lowest responsive bidder, 5 Sierra Pacific West, Inc. executing the required contract and submitting the required bonds and 6 insurance policies, as described in the contract, within twenty (20) days of adoption of this 7 resolution. The City Manager may grant reasonable extensions of time. Q 5.
