HR SETTLEMENT OF WORKERS' COMPENSATION CLAIM OF MARK WIDDOSS DEPT. HEAD Ml^L CITY ATTY. <5& CITY MGR. ^^, RECOMMENDED ACTION: Adopt Resolution No. 2009-155 authorizing the settlement claim of Mark Widdoss. ITEM EXPLANATION: The claimant was a Police Officer for seven years with the Carlsbad Police Department. Mr. Widdoss sustained a back injury while performing his usual and customary job duties. The terms and conditions of the proposed settlement are set forth in the Stipulations with Request for Award (on file in the Human Resources Department). The terms and conditions were agreed upon by the claimant and the City, and have been approved by TRISTAR, the City's Third Party Administrator, and the Workers' Compensation Appeals Board. FISCAL IMPACT: The cost of the settlement is $44,550. There are sufficient funds available in the Workers' Compensation Self-Insurance Fund to cover the cost of this settlement. ENVIRONMENTAL IMPACT: This amendment is statutorily exempt from CEQA pursuant to Public Resources Code Section 21080(b)(1). EXHIBITS: 1. COUNCIL ACTION: APPROVED DENIED CONTINUED WITHDRAWN AMENDED D P CONTINUED TO DATE SPECIFIC D CONTINUED TO DATE UNKNOWN D RETURNED TO STAFF D OTHER - SEE MINUTES D 1 RESOLUTION NO. 2009-155 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, 4 CALIFORNIA, AUTHORIZING THE EXPENDITURE OF FUNDS FOR 5 SETTLEMENT OF THE WORKERS' COMPENSATION CLAIM OF MARK 6 WIDDOSS 7 8 9 WHEREAS, TRISTAR, the City's Third Party Administrator, has recommended a settlement of the Workers' Compensation claim of Mark Widdoss; and 11 WHEREAS, the settlement has been approved by the Workers' Compensation Appeals 12 Board on May 11, 2009; and 13 WHEREAS, there are sufficient funds available in the Workers' Compensation Self-14 Insurance Fund to pay the settlement. ! 6 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 17 California, as follows: 1. That the above recitations are true and correct. 19 2. That the expenditure of $44,550 from the Workers' Compensation Self-Insurance 20 Fund is authorized for the settlement of said claim. 21 3.
