REQUEST FOR FINDING BY CITY COUNCIL FOR TWO
MAINTENANCE AND SERVICE AGREEMENTS

RECOMMENDED ACTION:
Adopt Resolution No.2009-156 finding that in accordance with Carlsbad Municipal
Code Section 3.28.130 that it is not in the best interest of the City of Carlsbad to require prevailing
wages for two maintenance and service agreements and that determination shall be included in the
notice inviting bids due to the potential for measurable cost savings to the City.
ITEM EXPLANATION:
The City of Carlsbad has traditionally utilized various maintenance and service contracts to maintain
and repair city infrastructure. Utilizing a service contractor allows the City to provide these services
without the need to increase staffing, purchase and maintain expensive specialty equipment, and
allows staff resources to be allocated to our core maintenance functions. Staff recommends that
Council make a finding that it is not in the best interest of the City of Carlsbad to require the payment
of prevailing wage for the Tree Trimming Maintenance Services and the Traffic Signal Maintenance
Services agreements, as lifting that requirement could result in measurable cost savings to the City of
Carlsbad.
Carlsbad Municipal Code Section 3.28.130 requires that City Council make a determination that it is in
the best interest of the City of Carlsbad to let the above-mentioned agreements without the
requirement the payment of prevailing wage. Staff is requesting that Council make that determination
at this time.
ENVIRONMENTAL IMPACT:
These agreements are a Class 1 categorical exemption (minor alteration of existing structure or
facilities) and are, therefore, exempt from the environmental review process under provisions of the
California Environmental Quality Act (CEQA), Section 15301(c).
FISCAL IMPACT:
These are funded from various City funding sources including the Parks Maintenance Operating
Budget - General Fund, Streets Maintenance Budget - General Fund, and the Trails Maintenance
Budget - General Fund. No funding from State or Federal agencies or programs is included.
Prevailing wages are not required for these agreements because General Fund monies are not
restricted funds.
Subsequent award of agreements will be dependent upon current and future appropriations to fully-
fund the agreements.

14 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

2. That measurable cost savings may be realized if two maintenance and service
agreements are let without a requirement to pay prevailing wages.
18 3. That State and/or Federal funding will not be utilized for these maintenance and
service agreements.
20 4. That a finding is made that it is not in the best interest of the City of Carlsbad to
