RECOMMENDED ACTION:
Adopt Resolution No. 2009-163
Commission.
ITEM EXPLANATION:
Michael Holzmiller has requested that Council rescind his May 19, 2009, appointment to
the Planning Commission due to potential conflicts of interest that may arise as he
performs his duties and responsibilities as a Planning Commissioner.
Other members of the Planning Commission are: Julie Baker, Sondra Boddy, Bill
Dominguez, Farrah Douglas Hap L'Heureux, and Marty Montgomery.
NOTE:Members of the Planning Commission are subject to the provisions of the
Political Reform Act, and must file a Statement of Economic Interests, Form 700.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code Section 21065 and CEQA Guidelines Section 15378,
this action does not constitute a "project" within the meaning of CEQA and therefore, does
not require an environmental review.
Applications received in Calendar Year 2009 are on file in the Office of the City Clerk.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPOINTING ONE MEMBER
TO THE PLANNING COMMISSION
WHEREAS, the May 19, 2009 appointment of Michael Holzmiller to

Carlsbad, California, as follows:
1 . That the above recitations are true and correct.

Mayor Lewis:
Regarding my recent appointment to the Planning Commission, as you are aware, my spouse works for a local
planning consulting firm. In addition to this firm representing several clients involved is some high-profile development
proposals that will be considered by the Planning Commission in the near future, I recently was made aware that the firm
will also be representing clients that will be participating in and submitting comments on several important planning
programs and issues coming before the Commission including the Housing Element, the General Plan Update and the
Village Redevelopment strategies. I was not aware of the extent of the constraints that would be placed on my
participation as a Planning Commissioner when I applied for the appointment. Based on further discussions regarding
potential conflicts, I have decided that it would be in the best interest of the city to have my appointment rescinded and
replaced by another interested individual.
Thank you for supporting my application. I intend to still participate in planning programs in the city as a private,
individual citizen.
