RECOMMENDED ACTION:
1. Adopt Resolution No. 2009-173

of the City Council of the City of Carlsbad, California

5.09.030(b)
3. Adopt Resolution No. 1365 of the Carlsbad Municipal Water District adopting
changes to the Master Fee Schedule with regards to three new turbo meter fees.
ITEM EXPLANATION:
One of the City Council's goals is to annually evaluate fees and charges for services. Proposed fee
increases were presented to the City Council at the Public hearing on June 16, 2009. At that time, the
City Council asked that staff return with additional information regarding some of the proposed fee
increases, most specifically those that are tied to growth in various cost indexes. Those proposed
escalators, and the various options available to the City Council, are detailed below. The Master Fee
schedule showing current and proposed fees is attached (Exhibit 1a). All proposed indexed fee
escalators have been removed from the schedule at this time, pending the City Council's decisions on
the items below. On June 16, 2009, the City Council adopted several other fee adjustments which are
included in the Master Fee Schedule.
General City Fees and Development Related Fees - General City Fees are charged for the usage of
City services and property, such as rentals, classes and water rates. Development Related Fees are
charged to recover the cost of staff time and materials spent on development related activities. Most
General City Fees and Development Related Services Fees are proposed to be increased by 3.5%, to
reflect the cost of inflation, based on the Consumer Price Index (CPI). The City Council has asked to
review various options for adjusting these fees.
Options:
• Increase fees by 3.5%, as proposed.
• Increase fees by a smaller percentage than proposed.
• Do not increase fees for FY 2009-10. A follow-up analysis can be done to determine if a
catch-up provision should be implemented when fees are next indexed.

The financial Impact of not enacting the proposed fee escalators would be the loss of approximately
$135,000 of potential revenue. These potential revenues were not included in the Revenue Estimates
in the FY 2009-10 Operating Budget. Since direct costs for the City to provide services continue to
increase, the loss of revenue would mean the City would need to subsidize these services at an even
higher level than the current subsidy.
It should be noted that there was approximately $40,000 included in the Revenue Estimates for FY
2009-10 related to proposed fee increases for Library services. Council acted on those proposed
increases on June 16, 2009 and did not adopt them. Those fee increases have now been removed
from the Revenue Estimates in the FY 2009-10 Operating Budget.
Development Impact Fees - Development Impact Fees are fees used to recover the cost that growth
will have on City infrastructure. Development Impact Fees and other fees that are increased annually
based upon an index as stated in the resolutions or ordinances establishing the fees are also
proposed to be increased. Based on the ordinances currently in place, the majority of the
Development Impact fees are proposed to be increased by 6.4%, consistent with the one year
Engineering News Record (ENR) Construction Cost Index for Los Angeles County as of April 2009.
The City Council has asked to review various options for increasing these fees.
Options:
• Increase fees by 6.4% (or other appropriate indexed increase), as stated in the current
ordinances.
• Increase fees by less than the indexed increase proposed.
• Do not increase fees for a period of one year. A follow up analysis can be done to determine
if a catch-up provision should be implemented when fees are next indexed.
Approximately $16,000 of potential revenue for FY 2009-10 from proposed fee increases has been
included in the FY 2009-10 CIP Revenue Projections, assuming minimal development occurring in the
coming year due to the declining economy. In FY 2009-10, the financial Impact of not enacting the
proposed fee increases is the loss of this potential revenue, but the impact could be much greater as
a sizeable loss of revenue could potentially occur if a developer pulls permits this year for a large
project, which has not been included in the growth assumptions.
Additional impacts could amount to a loss of approximately $1.6 million in CIP revenue, through
buildout, if the proposed indexed fee increase for FY 2009-10 is not enacted in FY 2010-11 or future
years.
On May 5, 2009, staff provided Council with updates and recommendations regarding the fee
structure of the Traffic Impact Fee (TIF) Program. Council's directions from that meeting regarding
the TIF increases that become effective July 1, 2009 are reflected in the attached Master Fee
Schedule (Exhibit 1a), and no additional adjustments to Council's directions from May 5, 2009 are
proposed at this time.
Other Proposed Fee Changes - It is proposed that three turbo irrigation meter fees for installation and
connection fees for the San Diego County Water Authority and the Carlsbad Municipal Water District
(CMWD), be added back to the fee schedule and be increased by the ENR index rate up to FY 2008-
09. These meters are used by commercial and industrial high volume customers and for landscape
irrigation for homeowner's associations. These fees were inadvertently removed from the schedule in
FY 2006-07. These meters are currently used by customers, and fees are charged accordingly,
therefore, it is requested that these be added back to the fee schedule. The fees have now been
reflected in the Master Fee Schedule (Exhibit 1a), but have only been increased by the ENR index
through FY 2008-09. The table below summarizes the three fees, including the potential fee if the fees
are escalated by the ENR for FY 2009-10.

5 WHEREAS, the City Council of the City of Carlsbad has the authority to establish
6 fees for City services; and
7 WHEREAS, from time-to-time said fees are reviewed and evaluated to maintain
8 an adequate fee structure recovering costs for City services; and

WHEREAS, the City Council has determined the cost of providing general and

development-related services; and

WHEREAS, the City Council finds it necessary to recover the costs for City

14 WHEREAS, the City Council has held the necessary public hearing and allowed
15 for public comment on the establishment of said fees.
16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of

CLASSIFICATION OF APPLICANTS
Each application will be reviewed by the Department staff and classified into a category depending on the
type of organization and the intended use. The Department activities have first priority for the use of the
facilities. The classifications are listed in order or priority with classification "A" first, classification "B"
second, etc.
The City attempts to accommodate all groups; however, there is a limited number of facilities.
Unfortunately, the demand exceeds the supply. For that reason, a priority classification system for use
was established.

MUNICIPAL CODE SECTIONS 13.10.030, 13.10.080,
SECTION 1: That section 13.10.030 of the Carlsbad Municipal Code is amended to
read as follows:
13.10.030-Sewer capacity fee -Encina Treatment Plant
Except as provided, every person who wishes to use the city sewer system and the
Encina Treatment Plant shall pay to the city prior to the issuance of a sewer permit, a
12 sewer capacity fee per equivalent dwelling unit. The amount of the sewer capacity fee
shall be as set from time to time by a resolution of the city council.13 The sewer capacity fee shall be adjusted annually by a resolution of the city
14 council by the percentage change in the Engineering News Record Los Angeles
Construction Cost Index with the base index in effect in December 2003.
The fee adjustment for the July 1, 2009 - June 30, 2010 fiscal year shall be held in
16 abeyance for a period of one year. Thereafter the fee shall return to the amount it would
have been had there been no suspension unless prior to that time the City Council adopts
an ordinance specifying a different fee or formula.
All sewer capacity fees shall be placed in the sewer construction fund and shall be
used to pay for capital improvements of such system.

Angeles Construction Cost Index of 9335.69 based on the 1967 average = one hundred.
The fee adjustment for the July 1, 2009 - June 30, 2010 fiscal year shall be held in
abeyance for a period of one year. Thereafter the fee shall return to the amount it would
