ENG AWARD OF CONTRACT FOR CONSTRUCTION OF THE 2009 PAVEMENT OVERLAY PROJECT NO. 6001-09OL RECOMMENDED ACTION: Adopt Resolution No.2009-178 DEPT. HEAD CITY ATTY. CITY MGR. awarding the contract to All American Asphalt for construction of the 2009 Pavement Overlay Project No. 6001-09OL ITEM EXPLANATION: The 2009 Pavement Overlay Project is part of the City's ongoing Pavement Management Program. This rehabilitation project will extend the life of selected roadways in northeast Carlsbad by applying a rubberized asphalt concrete layer over the existing pavement. Areas of the road which are severely cracked will be patched prior to the asphalt concrete overlay. The streets were selected based on the age and existing condition of the pavement surface. On June 23, 2009, thirteen (13) sealed bids were received for the construction of this project as shown on the following table. The engineer's estimate was $2,000,000. Staff has completed its review of the contract documents and has determined that they are in order. Staff recommends that All American Asphalt be awarded the contract. ENVIRONMENTAL IMPACT: The project is exempt from environmental review per CEQA Guidelines Section 15301(c) - repair and maintenance of existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities involving negligible or no expansion. The estimated construction costs associated with this project are summarized in the following table. Remaining Pavement Management Program funds will be used on future pavement rehabilitation and resurfacing projects. Wilshire Ave. Harwich Athens Ave. Pontiac Dr. Lyons Ct. 1 RESOLUTION NO. 2009-178 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, AWARDING A CONTRACT FOR THE CONSTRUCTION OF THE 2009 PAVEMENT OVERLAY, 4 PROJECT NO. 6001-09OL. 5 WHEREAS, the City Council believes that it is in the public's best interest to construct 6 the 2009 Pavement Overlay Project No. 6001-09OL; and 7 WHEREAS, on May 5, 2009, the City Council of the City of Carlsbad approved plans for g the construction of the 2009 Pavement Overlay, Project No. 6001-09OL; and WHEREAS, thirteen (13) sealed bids were received on June 23, 2009 by the City of9 Carlsbad for the construction of the 2009 Pavement Overlay Project No. 6001-09OL; and 10 WHEREAS, the lowest responsive and responsible bid to construct said project was 11 submitted by All American Asphalt, in the amount of $1,400,000; and 12 WHEREAS, there are sufficient funds available in the Pavement Management Program 13 to complete the project; and 14 WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the 15 City Manager to approve change orders in the amount equal to the contingency set at the time of 16 project award. 17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, ig California, as follows: 1. That the above recitations are true and correct. 2. That the low bid of $1,400,000 submitted by All American Asphalt, for the construction of the 2009 Pavement Overlay Project No. 6001-09OL, is accepted and the Mayor is 21 hereby authorized to execute a contract for this project. 22 3. That the City Manager is hereby authorized to approve construction change 93 orders up to $140,000. O A 4. That the award of this contract is contingent upon the bidder submitting the 25 lowest responsible bid executing the required contract and submitting the required bonds and 26 insurance policies, as described in the contract, within twenty (20) days of adoption of this 27 resolution.
