CITY MGR. / 7 f*\ j In ^RECOMMENDED ACTION: That the City Council ADOPT Resolution of Intention No. 2009-182 directing the Planning Director to initiate preparation of a Specific Plan for the area of land generally identified as the Plaza Camino Real mall. ITEM EXPLANATION: The Plaza Camino Real (PCR) mall was initially constructed in 1968 and 1969, and was later expanded in 1977 with the City Council's approval of Precise Plan 24. Precise Plan 24 is comprised of a site plan that graphically displays the building footprints of existing stores and the layout of the parking lot. By today's standards, the plan is not adequate to effectively guide the continuing development or redevelopment of the PCR mall. Westfield, LLC is currently interested in pursuing the redevelopment of the PCR mall. However, to do so requires the involvement of all property owners having ownership interest in the PCR mall, including the City of Carlsbad who owns the majority of the parking lot. Given the difficulty of acquiring all property owner signatures, Westfield, LLC has requested that the City of Carlsbad initiate an application for a Specific Plan that would be used in the future to guide these redevelopment efforts. A Specific Plan would include a graphic and textual description of permitted land uses, required public facilities, development standards, design criteria and clear procedures for the development and redevelopment of the PCR mall. Westfield, LLC would serve as the applicant and would be responsible for the payment of all required fees associated with the preparation of the Specific Plan. Pursuant to Section 65450 of State Law and Chapter 21.52 of the Carlsbad Municipal Code, the legislative body (City Council) of a City with an adopted General Plan has the authority to authorize the preparation of a Specific Plan for any area covered by the General Plan. Based upon these facts, staff is recommending that the City Council direct the Planning Director to initiate the preparation of a Specific Plan to be used for the redevelopment of the PCR mall. FISCAL IMPACT: A significant amount of time will be necessary to complete the Specific Plan, prepare recommendations, and process this item. Westfield, LLC will cover all costs associated with the preparation of a Specific Plan, including the payment of all application fees, any technical and environmental reports, and any consulting fees associated with the project. However, approval of a Specific Plan, combined with any plans for the redevelopment of the PCR mall, will likely require an Environmental Impact Report (EIR). EXHIBITS: 1. City Council Resolution of Intention No. 2009-182 n i RESOLUTION NO. 2009-182 2 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DIRECTING THE 3 PLANNING DIRECTOR TO INITIATE PREPARATION OF A SPECIFIC PLAN FOR THE AREA OF LAND GENERALLY 4 IDENTIFIED AS THE PLAZA CAMINO REAL MALL. 5 WHEREAS, the Plaza Camino Real mall, initially constructed between 1968 and 1969, 6 with one major expansion approved in 1977, has a total retail area of approximately 986,081 square feet; and WHEREAS, since the last major expansion, over 32 years ago, the appearance and economic viability of the Plaza Camino Real mall has significantly declined as exhibited by the recent closure of the Robinson-May building in 2008, and WHEREAS, the existing discretionary permit covering the property (Precise Plan 24) is not adequate to effectively guide the continuing development or redevelopment of the Plaza ^ Camino Real mall, and WHEREAS, the City has been formally approached by Westfield, LLC expressing interest in the preparation and processing of a comprehensive Specific Plan to facilitate the redevelopment of the Plaza Camino Real mall, and 17 WHEREAS, the Plaza Camino Real mall site is comprised of multiple properties under 18 multiple ownership, including the City of Carlsbad who owns the majority of the parking lot, and 19 WHEREAS, given the difficulty of acquiring the signatures of all property owner having ownership interest in the Plaza Camino Real mall, Westfield, LLC has requested the City to 21 initiate the application for a Specific Plan that would be used in the future to guide any 22 redevelopment efforts. 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 24 California, as follows: 25 1. That the above recitations are true and correct. 26 2. That the Planning Director is hereby directed to prepare said Specific Plan and after appropriate time set the matter for public hearing before the Planning Commission and City Council. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad on the!4tb day of July 2009, by the following vote, to wit: AYES: Council Members Lewis, Kulcbin, Hall, Packard and Blackburn.
