RECOMMENDED ACTION:
Adopt Resolution No. 2009-188 accepting bids and award of contract to Sancon Engineering Inc.
for the North Batiquitos Interceptor Sewer Manhole Rehabilitation, Project No. 3538.
ITEM EXPLANATION:
The North Batiquitos Interceptor Sewer (NBIS) is divided into reaches NB1 through NB9 and begins near
the north shore of the Batiquitos Lagoon at Columbine Drive, just west of El Camino Real. From that
beginning point the NBIS pipeline alignment continues westerly along the north shore of the lagoon to the
North Batiquitos Lift Station, located near Gabiano Lane. From the lift station the alignment goes
northwesterly under Interstate 5 and continues north to the Encina Water Pollution Control Facility. The
NBIS was constructed in the early and mid 1970s, with the final upper reaches being completed in 1976.
This manhole rehabilitation project includes reaches NB1 through NB4 of the NBIS, a 1.9 mile long section
of the sewer that follows the north shoreline of the lagoon between El Camino Real and Gabiano Lane.
Much of the alignment is in or near a public trail with the remaining portions of the alignment traversing the
Four Seasons Resort golf course, agricultural property and property owned by the Batiquitos Lagoon
Foundation. During its most recent cleaning and inspection, the pipeline in reaches NB1 through NB4 was
found to be in good condition. However, 41 manholes in this alignment were found to be severely corroded
with considerable ground water infiltration present, and therefore in need of replacement or rehabilitation.
In consideration of the sewer's sensitive location, specific methods of trenchless rehabilitation have been
selected. Manholes will be rehabilitated without excavation, using low impact work methods designed to
eliminate direct impacts to the surrounding habitat.
In order to anticipate and minimize any impacts the project could have on the properties, City staff
corresponded with the Aviara Masters Association, Four Seasons Resort, State of California, and
Batiquitos Lagoon Foundation during the design phase of the project. Since much of the alignment is on or
near the public trail and the resort golf course, a continued effort will be made to coordinate construction
activities in an effort to minimize any inconveniences to the users of the properties during the construction
phase.
On April 14, 2009, through the adoption of Resolution No. 2009-069, the Carlsbad City Council approved
plans and specifications and authorized the City Clerk to advertise to receive bids for the North Batiquitos
Interceptor Sewer Manhole Rehabilitation, Project No. 3538.
On June 25, 2009, two (2) sealed bids were received for the construction of this project, which are
summarized in the table below:

The Engineer's Estimate for this project is $475,000. Staff has completed its review of all documents and
finds that they are in order. Therefore, staff recommends that Sancon Engineering Inc. be awarded the
contract.
ENVIRONMENTAL IMPACT:
A Coastal Development Permit (CDP 07-13), Mitigated Negative Declaration (MND) and Mitigation
Monitoring and Reporting Program (MMRP) were prepared for the Batiquitos Interceptor Sewer
Rehabilitation Project pursuant to the California Environmental Quality Act (CEQA). The initial study (EIA
Part II) prepared in conjunction with the project identified potentially significant effects on the environment
with respect to biology and hydrology/water quality. However, mitigation measures have been employed,
which reduce those effects to a less than significant level. Planning Commission Resolutions 6463 and
6464 approving the CDP, MND and MMRP were approved by the Planning Commission on September 17,
2008. No further environmental review is required.

Sufficient funds are available for the completion of the manhole rehabilitation construction. The project
is funded from the Sewer Replacement Fund. Aforementioned, Resolution No. 2009-069 determined
payment of prevailing wages was not in the City's best interest and the contract reflects that
determination.

CONTRACT TO SANCON ENGINEERING INC. FOR NORTH

6 WHEREAS, the City Council of the City of Carlsbad, California, desires to rehabilitate
7 41 existing manholes in reaches NB1 through NB4 in the North Batiquitos Interceptor Sewer in
8 conformance with the Sewer Master Plan; and
9 WHEREAS, a Coastal Development Permit (CDP 07-13), Mitigated Negative Declaration
10 (MND) and Mitigation Monitoring and Reporting Program (MMRP) were prepared for the Batiquitos
11 Interceptor Sewer Rehabilitation Project in compliance with the California Environmental Quality
12 Act. Planning Commission Resolutions 6463 and 6464 approving the CDP, MND and MMRP
13 were approved by the Planning Commission on September 17, 2008 and no further environmental
14 review is required; and
15 WHEREAS, on April 4, 2008, through the adoption of Resolution No. 2008-069, the
16 Carlsbad City Council approved plans and specifications and authorized the City Clerk to advertise
17 to receive bids for the North Batiquitos Interceptor Sewer Manhole Rehabilitation, Project No.
18 3538; and
19 WHEREAS, the City Council has determined, through the adoption of Resolution No. 2008-
20 069, that the payment of prevailing wages is not in the City's best interest and that determination is
21 reflected in the contract; and
22 WHEREAS, two (2) sealed bids were received on June 25, 2009 by the City of Carlsbad for
23 the construction of said project; and
24 WHEREAS, the lowest responsive and responsible bid to construct said project was
25 submitted by Sancon Engineering Incorporated, in the amount of $262,155; and
26 WHEREAS, funds in the Sewer Connection Fee Fund are sufficient to complete said
27 project.

1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
2 California, as follows:
3 1. That the above recitations are true and correct.
4 2. That the bid in the amount of $262,155 submitted by Sancon Engineering
5 Incorporated, for the construction of the North Batiquitos Interceptor Sewer Manhole
6 Rehabilitation, Project No. 3538, is accepted and the Mayor is hereby authorized to execute a
7 contract with Sancon Engineering Incorporated.
o 3. The City Manager is hereby authorized to approve construction change orders up to
9 $39,324.
1Q 4. That the award of this contract is contingent upon the bidder submitting the lowest
1. responsible bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
