RECOMMENDED ACTION:
Adopt Resolution No. 2009-195 directing the City Clerk to place copies of the City Charter
at the beginning of the Municipal Code and to request the City's codification service to
include the charter in every addition.
ITEM EXPLANATION:
Carlsbad celebrated its first year anniversary of becoming a charter city on July 3, 2008. On
June 3, 2008 the voters approved the City Charter by the largest margin (82.4%) of any City
ballot initiative. The Charter was filed by the Secretary of State on July 3, 2008 and is now
part of the statutes of the State of California and is entitled to the same dignity and respect as
the California Constitution when local affairs of the City are impacted. Since its adoption, the
City has adopted 29 ordinances, which could not have happened but for the City's charter
status. A summary of some of those actions are as follows:
• The majority of the quorum Ordinance, overruling State law to the contrary.
• The prevailing wage Ordinance allowing the Council to make prevailing wage
decisions on local projects on a case-by-case basis.
• An ordinance allowing the City to expedite ordinances in order to avoid any
unnecessary expenditure of City funds.
• Urgency Ordinance by a simple majority and defined by the City Council not the State.
Future plans for proposed laws under our charter powers include:
• To enhance and refine qualifications to run for the elective offices of City Clerk and
City Treasurer.
• To propose to Council a better Design Build Law than currently allowed to general law
cities by the State.
• Amendments to the Purchasing Ordinance to streamline contracting and purchasing.
To emphasis the importance of the City Charter, it is recommended that the Council adopt
Resolution No. 2009-195 directing the City Clerk to place copies of the charter at the
beginning of every copy of the Municipal Code and to request the City's codification service
to include this in every edition.

6 WHEREAS, it has been a year since the voters at the special election of June 3,
7 2008 voted to adopt the Carlsbad City Charter; and
8 WHEREAS, the Charter was filed in the Office of the Secretary of State and is
a
now part of the statutes of the State of California and is entitled to the same dignity and
10 respect as the Constitution of the State of California; and

WHEREAS, this resolution is to commemorate the year anniversary of the City
12
adopting the Charter and to direct the City Clerk to incorporate a copy of the Charter at
the beginning of the Municipal Code.
15 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
16 Carlsbad, California, as follows:
17 1. That the above recitations are true and correct.
18 2. That the City Clerk is directed to include copies of the City Charter at the
19 beginning of every Municipal Code.

3. To request the City's codification service to include the Charter at the
21
every edition/revision to the Municipal Code.
23 4. To include a link to the City Charter on the City's Webpage.
24 5. To retain copies of the City Charter at the City's libraries.

of the City of Carlsbad on the 21st day of July, 2009, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
