RECOMMENDED ACTION:
Adopt Resolution No. 2009-208 accepting the contract for construction of the 2007 Pavement
Overlay, Project No. 3667-15 as complete, and directing the City Clerk to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On June 19, 2007, the City of Carlsbad awarded a contract to All American Asphalt in the amount of
$3,611,285 for the construction of the 2007 Pavement Overlay, Project No. 3667-15.
All American Asphalt completed the contract work on February 12, 2009. The final change order was
executed on June 24, 2009. City staff has inspected the work and found it to be satisfactory. Staff
recommends acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF THE 2007 PAVEMENT OVERLAY,
PROJECT NO. 3667-15.
WHEREAS, the construction of the 2007 Pavement Overlay, Project No. 3667-15 has
been completed to the City's satisfaction by All American Asphalt on February 12, 2009; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
11 1. That the above recitations are true and correct.
12 2. That the 2007 Pavement Overlay, specifically identified as Project No. 3667-15 is
13 deemed complete and is hereby accepted by the City Council of the City of Carlsbad.

3. The City Clerk of the City of Carlsbad is hereby authorized and directed to

execute and record the Notice of Completion for the 2007 Pavement Overlay, Project No. 3667-15.
