(jtA — RECOMMENDED ACTION: Introduce Ordinance No.CS-048 to establish no parking seven days a week from 2:00 A.M. to 5:00 A.M. on Paseo Descanso from Carrillo Way to Paseo Cerro. ITEM EXPLANATION: At the City Council meeting of July 21, 2009, the City Council heard an appeal of the Traffic Safety Commission to deny the request to establish no parking at night on a portion of Paseo Descanso. Some residents residing on Paseo Descanso requested the Council to establish no parking from 2:00 A.M. to 5:00 A.M. on Paseo Descanso between Carrillo Way and Paseo Cerro. After considering the input of residents living on and near Paseo Descanso, the City Council determined that no parking from 2:00 A.M. to 5:00 A.M., seven days a week should be implemented on Paseo Descanso from Carrillo Way to Paseo Cerro. By a 5-0 vote, the Council directed staff to return with an ordinance to establish the parking restriction. ENVIRONMENTAL IMPACT: The installation of an official traffic control device is a project that is a Class 1 categorical exemption (minor alteration of existing structure or facility) and is exempt from the environmental review process under the provisions of the California Environmental Quality Act (CEQA), section 15301(c). FISCAL IMPACT: Installing approximately 13 no parking signs with time restrictions specified will cost about $2,000. Sufficient funds are available in the Public Works Streets Department budget. CS-048 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF 3 4 5 6 7 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.40, OF THE CARLSBAD MUNICIPAL CODE TO DECLARE NO PARKING ON PASEO DESCANSO FROM CARRILLO WAY TO PASEO CERRO FROM 2:00 A.M. to 5:00 A.M., SEVEN DAYS A WEEK. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended by the addition of Section 10.40.170 to read as follows: "10.4.170 Parking Time Limit on Paseo Descanso from Carrillo Way to Paseo Cerro When authorized signs are in place giving notice thereof, no person shall stop, stand or park any vehicle on Paseo Descanso from Carrillo Way to Paseo Cerro, seven days a week, between the hours of 2:00 A.M. and 5:00 A.M."
