RECOMMENDED ACTION:
Adopt Resolution No. 2009-219
Global Markets Inc. of $2,083.
authorizing a refund of business license tax to Citigroup
ITEM EXPLANATION:
Citigroup Global Markets Inc. operated an entity named Salomon Smith Barney which ceased
doing business in June 2009. At that time, this business became Morgan Stanley Smith Barney.
The business license taxes were paid on both accounts. Citigroup is asking for a refund for the
portion of the year, June through December 2009 that was paid on the closed account.
The Finance Department audited the account, confirmed the business closure, verified the
payment for 2009 taxes and ensured compliance with all other business license policies.
Section 5.04.130 of the Carlsbad Municipal Code requires Council approval of any refund in
excess of $500. Therefore, staff is recommending approval of a refund to Citigroup Global
Markets Inc. of $2,083.
FISCAL IMPACT:
The payment will result in $2,083 in refunds. There is no true fiscal impact, as the business
was closed and did not owe the fee.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code Section 21065 and CEQA Guidelines Section 15378, this
does not constitute a "project" within the meaning of CEQA and, therefore, does not require an
environmental review.

3 LICENSE TAX PAYMENT TO CITIGROUP GLOBAL
4 MARKETS INC.
5 WHEREAS, Citigroup Global Markets Inc. ceased doing business as Salomon
6
Smith Barney, in the City of Carlsbad in June 2009;
7
WHEREAS, Citigroup Global Markets Inc. paid business licenses taxes for the
8
9 full year 2009 and requested a refund for these taxes; and
10 WHEREAS, the Finance Department confirmed the payment by Citigroup Global
11 Markets Inc. and verified the refund amount.
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
13 Carlsbad, California, as follows:
14 1. That the above recitations are true and correct.
