HomeMy WebLinkAbout2009-08-18; City Council; 19947; Transnet Local Street Improvement ProgramCITY OF CARLSBAD - AGENDA BILL RECOMMENDED ACTION: Adopt Resolution No.2009-222 approving Amendment No. 1 to the Carlsbad Transnet Local Street Improvement Program of Projects for Fiscal Years 2009 through 2013. ITEM EXPLANATION: In conjunction with the adoption of the Regional Transportation Improvement Program (RTIP) each member agency of SANDAG that desires to expend certain Federal, State, and/or TransNet State funds must approve a Program of Projects once every two years. The Program of Projects also includes regionally significant capacity increasing projects regardless of the type of funding source. The Federal Metropolitan Planning and Air Quality Conformity Regulations also require inclusion of all regionally significant capacity increasing road projects for air quality emissions analysis. On July 17, 2008 the City Council of the City of Carlsbad adopted Resolution 2008-175 approving the Carlsbad Program of Projects for the Fiscal Years 2009 thru 2013. The Carlsbad Program of Projects which consisted of 19 projects was then used by the San Diego Association of Governments (SANDAG) to assemble the 2008 Regional Transportation Improvement Program (RTIP) for the San Diego County region. The Program of Projects can be revised as needed on a quarterly basis during the two year period between the adoption of the 2008 RTIP and the 2010 RTIP. On June 16, 2009 the City Council approved the Capital Improvement Program (CIP) for Fiscal Year 2009/10. As a result of this approval the City needs to amend the Program of Projects used as the basis for City of Carlsbad's portion of the 2008 RTIP. By amending the Program of Projects the Federal, State and Regional funding programming will be coordinated with the recently adopted CIP and the funds will be available in a timely manner. The subject Amendment impacts thirteen of the nineteen projects on the Carlsbad Program of Projects for fiscal years 2008/09 through 2012/13, see Exhibit 1. The first set of changes will add funds and/or revise the schedule of eight projects consistent with the current CIP. The following projects are in this set: (CB14)- Carlsbad Pedestrian Master Plan, (CB15)- Carlsbad Bicycle Master Plan, and (CB16) Carlsbad Blvd. Bridge over Las Encinas Creek. The final two projects will be amended to reflect changes in the funding, the scope of work and/or the project schedule. For project (CB04B)- El Camino and Cannon Road, the scope of the project was reduced to reflect the work along the frontage and the schedule was moved out to Fiscal Year 2012/13. For project (CB 20)- Pavement Overlay, the amount of funding was increased for Fiscal Year 2009/10 and reduced for the remaining fiscal years to be consistent with the current CIP. ENVIRONMENTAL IMPACT: This activity is statutorily exempt from CEQA pursuant to State CEQA Guidelines, Section 15276, which states that CEQA does not apply to the adoption of regional transportation improvement programs. FISCAL IMPACT: Amending the City of Carlsbad Program of Projects will enable the City to access Federal, State and Regional funds as programmed in the CIP adopted on June 16, 2009. Inclusion in the RTIP, however, is not a guarantee that projects will receive the stated funding. The amounts shown are the best available estimates of anticipated funding. In the event that funding falls short or is not available, the City Council is not obligated to proceed with a project just because it is included in the Program of Projects and the RTIP. That the above recitations are true and correct. 2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of 22 Carlsbad certifies that no more than 30 percent of its annual revenues from the TransNet funds 03 shall be spent on maintenance related projects. 24 3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of 25 Carlsbad certifies that all new projects, or major reconstruction projects, funded by TransNet revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this 27 28 1 requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the 2 City of Carlsbad's public hearing process. 3 4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of 4 Carlsbad certifies that the required minimum annual level of local discretionary funds to be 5 expended for street and road purposes will be met through the 5-year period consistent with the 6 most recent Maintenance of Effort Requirements adopted by SANDAG. 7 5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of 8 Carlsbad certifies that it will extract $2,000 from the private sector for each newly constructed 9 residential housing unit in the City of Carlsbad to comply with the provisions of the Regional 10 Transportation Congestion Improvement Program (RTCIP). 11 6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of 12 Carlsbad certifies that is has established a separate TransNet Improvement Account for 13 TransNet Revenue with interest earned expended only for those purposes for which the funds 14 were allocated. 15 7. That pursuant to Section 18 of the TransNet Extension Ordinance, the City of '® Carlsbad certifies that each project of $250,000 or more will be clearly designated during ' construction with TransNet project funding identification signs. 1ft 8. That the City of Carlsbad does hereby certify that all other applicable provisions of 10 the TransNet Extension Ordinance and the SANDAG Board Policy 31 have been met. 20 9. That the City of Carlsbad agrees to indemnify, hold harmless and defend SANDAG, 21 the San Diego County Regional Transportation Commission, and all officers and employees 22 thereof against all causes of action or claims related to local TransNet funded projects. 23 10.
