RECOMMENDED ACTION:
Adopt Resolution No. 2009-254 accepting the contract for construction of the Leo Carrillo
Ranch Barn Stabilization, Project No. 39611 as complete, and directing the City Clerk to record a
Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On September 16, 2008, the City of Carlsbad awarded a contract to Mark Sauer Construction, Inc. in
the amount of $363,000 for the construction of the Leo Carrillo Ranch Barn Stabilization,
Project No. 39611.
Mark Sauer Construction, Inc. completed the contract on July 19, 2009. The final change order was
executed on August 10, 2009. City staff has inspected the work and found it to be satisfactory. Staff
recommends acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF THE LEO CARRILLO RANCH BARN
STABILIZATION. PROJECT NO. 39611. AS COMPLETE.
WHEREAS, the construction of the Leo Carrillo Ranch Barn Stabilization,
Project No. 39611, has been completed to the City's satisfaction by Mark Sauer Construction, Inc.
on July 19, 2009; and
WHEREAS, the formal project Notice of Completion has been prepared; and
g WHEREAS, all project costs have been established to date.
10 .NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
12 1 • That the above recitations are true and correct.
13 2. That the Leo Carrillo Ranch Barn Stabilization, specifically identified as
14 Project No. 39611 is deemed complete and is hereby accepted by the City Council of the City of
15 Carlsbad.
16 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
17 execute and record the Notice of Completion for the Leo Carrillo Ranch Barn Stabilization,
18 Project No. 39611.
