HEAD ££_ CITY ATTY. <&% CITY MGR. ^_ RECOMMENDED ACTION: Council adopts Resolution No. 2009-282 accepting and appropriating State Homeland Security Grant funds to Carlsbad Fire and Police Departments for emergency preparedness. ITEM EXPLANATION: The federal State Homeland Security Grant Program (SHSGP) provides funds to build catastrophic incident planning, response, recovery, and information sharing capabilities. The County of San Diego applies for, receives, and locally administers these federal grant funds and has received notification of the federal grant award (Exhibit 1). FY 2009 SHSGP funds allocated to the City of Carlsbad are $185,400 to be used for the purchase of communications equipment, tactical protective equipment, search and rescue equipment and/or emergency planning. Equipment is first purchased and paid for by the city. Paid invoices for SHSG-related purchases are then sent to the San Diego County Office of Emergency Services for full reimbursement to the city. Planning costs are similarly expended and reimbursed. Council has previously approved applying for these funds by adopting Resolution No. 2009-180 (Exhibit 2). Staff requests that the City Council appropriate the $185,400 grant award to the Fire Department's General Fund budget for the purchase of communications equipment, tactical protective equipment, search and rescue equipment and/or emergency planning. The General Fund will be reimbursed by periodic grant reimbursements. All grant reimbursements are anticipated to be completed before the close of FY 2009/10. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065 and CEQA Guidelines section 15738, this grant application does not constitute a "project" within the meaning of CEQA and therefore, does not require an environmental review. This is a request to authorize the Department of Agricultural Weights and Measures, the Department of Environmental Health, the Department of Planning and Land Use, the Department of General Services, the Health and Human Services Agency, the Department of Public Works, the Department of the Medical Examiner, the Sheriffs Department and the Office of Emergency Services to accept $7,645,550 in Homeland Security Grant Program (HSGP) funds sub-granted through the State of California from the Federal Department of Homeland Security. This program incorporates the State Homeland Security Program (SHSP) grant and the Metropolitan Medical Response System (MMRS) grant. The Office of Emergency Services is responsible for administering and distributing the grant funds to the cities in the County, as well as the unincorporated areas of the County. The funding is for emergency planning, the continued development of an exercise program, equipment purchases, regional projects and grants administration. Recommendation(s) CHIEF ADMINISTRATIVE OFFICER 1. Authorize the Department of Agricultural Weights and Measures, the Department of Environmental Health, the Department of Planning and Land Use, the Department of General Services, the Health and Human Services Agency, the Department of Public Works, the Department of the Medical Examiner, the Sheriffs Department and the Office of Emergency Services to accept the HSGP funds for the period from September 23, 2009 to April 30, 2012 in the amount of $7,645,550 to conduct emergency planning, exercises, administration and to purchase equipment to enhance the response to chemical, biological, radiological, nuclear and explosive incidents. Authorize the Director of the Office of Emergency Services to enter into expenditure contracts of $3,017,180 with local jurisdictions as stated in the table listed in the background section to enhance and strengthen regional emergency preparedness, response and recovery. 12. Waive Board Policy B-29, Fees, Grants, Revenue and Contracts - Department Responsibility for Cost Recovery. Fiscal Impact Funds for this request are not included in the Fiscal Year 2009-11 Operational Plan. If approved, this request will result in federal grant revenue of $7,645,550 in Fiscal Year 2009-10 with a pass-through of $3,017,180 to local jurisdictions. The remaining $4,628,370 will be for emergency planning, conducting exercises, conducting training, purchasing equipment and grant administration by the previously listed County departments. The funding source is the federal Department of Homeland Security through the Cal EMA Fiscal Year 2009 Homeland Security Grant Program. No additional staff years are required. There are no capital projects, fees, revenue leases, or space related impacts associated with this grant. Business Impact Statement N/A Advisory Board Statement The Approval Authority Body, consisting of the San Diego County Public Health Officer, the Operational Area Fire Coordinator, the Municipal Fire Chief, the County Sheriff, and the Chula Vista Police Chief approved the application for the HSGP grant on July 14, 2009. The Unified San Diego County Emergency Services Organization approved the grant spending plan on July 16,2009. BACKGROUND: -3- SUBJECT: OFFICE OF EMERGENCY SERVICES - HOMLAND SECURITY GRANT PROGRAM ACCEPTANCE (District: All) The federal Department of Homeland Security released the HSGP grant guidance in November, 2008. This was followed by the release of the State HSGP grant supplemental guidance in May, 2009 by the Cal EMA. The grant guidance incorporates the SHSP and MMRS program into one application. The San Diego Operational Area was allocated $7,645,550 under these grants: $7,324,329 for SHSP and $321,221 for MMRS. Your Board approved the application submittal on June 16,2009 (7) and the application was submitted to the Cal EMA on My 17,2009. The application was accepted and the Cal EMA awarded the funding on September 23,2009. The SHSP supports the implementation of the State Homeland Security Strategies to address the identified planning, equipment, training, and exercise needs for acts of terrorism. In addition, the SHSP supports the implementation of the National Preparedness Goal, the National Incident Management System (NTMS), and the National Response Framework (NRF). The MMRS funds support the Metropolitan Medical Strike Team (MMST) to further enhance and sustain an integrated, systematic mass casualty incident preparedness program that enables an effective response during the first crucial hours of an incident. This is a request to accept $7,645,550 in grant funds from the State of California FY09 HSGP to be used by the County, the cities, the unincorporated area, and those special districts with a role in response to a terrorist attack within the County. The funds will be used as follows: $3,386,687 for equipment, $946,366 for training, $2,377,248 for planning, $705,882 for exercises, and $229,367 for OES to manage and administer the grants. The grant performance period began on September 23,2009 and expires on April 30,2012. The State requires the grant to be administered through a reimbursement process. After a jurisdiction or department has completed their expenditures, reimbursement is requested through OES. Of this amount, $970,000 is from the Regional Terrorism Threat Assessment Center (RTTAC) grant and will be used for the maintenance, support and operation of the San Diego RTTAC/Law Enforcement Coordination Center (LECC). All remaining SHSP grant funds will be used to purchase services and supplies and fixed assets to enhance information sharing, to improve emergency and terrorist response capabilities, to develop emergency plans and to conduct incident management and response training and exercises. The funding allows 3% for grant management and administration, but does not cover indirect costs. In accordance with Board Policy B-29, the Office of Emergency Services certifies the HSGP grant would be a worthy expenditure of County funds, in the absence of external funding. The funding will continue to enhance the ability of emergency personnel to plan for, respond and recover appropriately to emergencies in the County. ITEM EXPLANATION; The State Homeland Security Grant Program provides funds to build capabilities at the state and local levels and to implement the goals and objectives included in state homeland security strategies. State goals and objectives include: • Strengthen information sharing, collaboration capabilities & law enforcement investigations • Strengthen communications capabilities • Enhance catastrophic incident planning and response & recovery capabilities, among others The County of San Diego is the entity that applies for, receives, and locally administers federal grant funds associated with the State Homeland Security Grant (SHSG) Program. The County's Unified Disaster Council, of which the City of Carlsbad is a member, is the governing body that determines the local grant fund distribution formula, which is based on "first responders" in each jurisdiction. No matching funds are required for the State Homeland Security Grants. The federal grant funds allocated to the City of Carlsbad are $185,400. The City of Carlsbad Police and Fire Departments jointly review allowable grant expenditures, determine the needs of each department and allocate the funds based on identified department needs. Equipment is then purchased and paid for by the city. Paid purchase invoices for SHSG-related purchases are then sent to the San Diego County Office of Emergency Services for full reimbursement to the city. Dislribuffim Clues/SHSP - All 1 RESOLUTION NO. 2009-282 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING AND 3 APPROPRIATING FEDERAL STATE HOMELAND 4 SECURITY GRANT PROGRAM FUNDS TO THE FIRE DEPARTMENT FOR EMERGENCY PREPAREDNESS 5 27 28 6 WHEREAS, the City of Carlsbad Police and Fire Departments are eligible to 7 receive federal grant funds through the FY 2009 State Homeland Security Grant 8 Program (SHSGP) for emergency preparedness. 9 WHEREAS, the total amount of the grant is $185,400. 10 WHEREAS, the Fire Department will be administering the SHSGP grant funds on 11 behalf of the City. 12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 15 1. That the above recitations are true and correct. 16 2. The SHSGP grant funds require no matching funds. Since all grant-related 17 purchases and planning costs are 100% reimbursable, the City shall incur no 18 costs. 19 3. That Council authorizes the receipt of grant funds. 20 4. The Finance Director is authorized to appropriate funds totaling $185,400 to 22 the Fire Department's General Fund budget. 23 5. That the Fire Chief, or his designee, is authorized to execute any and all 24 documentation associated with the FY 2009 State Homeland Security Grant 25 Carlsbad's emergency preparedness programs.
