If, - RECOMMENDED ACTION: Adopt Resolution No. 2010-003 accepting bids and awarding the contract to KTA Construction for the grading of Alga Norte Community Park, Project No. 3837. ITEM EXPLANATION: The proposed Alga Norte Community Park is located at the northwest corner of the intersection of Poinsettia Lane and Alicante Road. On December 17, 2002, the City Council adopted Resolution No. 2002-371 approving the Alga Norte Community Park Master Plan featuring an aquatics center, three baseball fields, a dog park, a skate park, basketball courts, playgrounds, open space, and parking. Plans and specifications were completed and bids were received to construct the park. On December 18, 2007, Council rejected the bids because of bid irregularities. On February 26, 2008, through Agenda Bill 19333, Council discussed the aquatics center's recreational component of the park. Through a minute motion, Council deferred the aquatics center's recreational component which included wet play structures, slides, and a moving river. On April 21, 2009, through Resolution Number 2009-079, Council directed staff to have the proposed Alga Norte Community Park site rough graded to meet future park development requirements. With this change, staff worked with the architectural consultant to determine the changes required to the plans and bid documents to reflect the Council's direction. On June 23, 2009, through Resolution Number 2009-164, Council authorized Amendment No. 11 with Wimmer, Yamada and Caughey to prepare specification sections and plan revisions including modifications to title sheets, grading plans, erosion control plans, utility plans, storm water pollution prevention plans, storm water management plan, including construction oversight, to allow for separate bidding and rough grading work for Alga Norte Community Park. The plans and specifications were completed and on October 6, 2009, through Resolution Number 2009-241, Council authorized to advertize for bids to grade Alga Norte Community Park. On December 10, 2009, twenty (20) sealed bids were received, opened, witnessed for the construction of this project as shown in the following Table 1. Bid documents submitted by the lowest bidder, KTA Construction, were determined to be responsive after staff completed a review of the contract documents and determined that they were in order. Based on a review of the bids submitted, staff recommends awarding the construction contract to KTA Construction, in the amount of $1,501,995. ENVIRONMENTAL IMPACT: On March 1, 2006, the Planning Commission adopted Resolution Nos. 6039 and 6040, adopting a Negative Declaration (ND) and Conditional Use Permit No. 04-08, respectively for the project. PROJECT NO. 3837. 4 5 WHEREAS, on October 6, 2009, the City Council of the City of Carlsbad, through 6 Resolution No. 2009-241, has previously authorized to advertize for bids to grade Alga Norte 7 Community Park Project No. 3837; and 8 WHEREAS, twenty (20) sealed bids were received on December 10, 2009, by the City 9 for the construction of said project; and 10 WHEREAS, the lowest responsive and responsible bid to construct said project was 11 submitted by KTA Construction in the amount of $1,501,995; and 12 WHEREAS, the City Council of the City of Carlsbad, California, has determined it 13 necessary, desirable, and in the public interest to accept bids and award a contract to grade Alga 1^ Norte Community Park; and WHEREAS, funding for said project has been appropriated from the Public Facilities 16 Fees (PFF) Fund and General Capital Construction (GCC) Fund to cover all project costs and is sufficient; and 18 WHEREAS, the City Manager is hereby authorized to approve change orders in the 19 cumulative amount equal to the contingency hereby set at fifteen percent (15%) of the contract award. 21 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 22 California, as follows: 23 1. That the above recitations are true and correct. 24 2. That the bid amount of $1,501,995 submitted by KTA Construction is hereby 25 accepted and the Mayor is hereby authorized to execute a contract with KTA Construction for the 26 grading of Alga Norte Community Park, Project No. 3837, in accordance with plans, specifications, 27 and contract documents referred to herein. 28 3. That the award of contract is contingent upon the bidder submitting the lowest responsive bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
