DIRECTOR /%jf CITY ATTORNEY (jf2^ CITY MANAGER / ,^ RECOMMENDED ACTION: Adopt Resolution No. 2010-021 _ accepting bids and awarding the contract to Empire Pipeline for the Corrugated Metal Pipe Replacement Program - State Street and Oak Avenue, Project No. 6607. ITEM EXPLANATION: The Corrugated Metal Pipe (CMP) Replacement Program was established as a five-year program to replace, repair or remediate deteriorated CMP storm drain systems throughout the City. The pipelines included in the program were identified after City staff inspected the interior of the storm drain pipe and assessed the condition of CMP pipelines. The program includes the eventual replacement or remediation of 25 storm drain pipelines. The locations of the pipelines and status are included in Exhibit 2. The State Street storm drain pipeline project will construct a new larger pipeline in State Street between Beech Avenue and the unnamed street that provides an auxiliary access to the Carlsbad Village Coaster Station parking lot. The pipeline will connect to an existing storm drain in the North County Transit District right-of-way. The new reinforced concrete storm drain pipeline will replace an existing corroded 24-inch corrugated metal pipe storm drain with pipe varying in size from 18 inches to 36 inches. New curb inlets and manholes will be constructed. The existing storm drain pipeline, which is located under the sidewalk, will be filled with concrete slurry and abandoned in place. All work associated with the State Street storm drain project will be completed as night work to minimize disruptions to local businesses. The Oak Avenue storm drain replaces an existing corroded 12-inch corrugated metal pipe with an 18- inch reinforced concrete storm drain pipe between Lincoln Street and Washington Street. Three new manholes will be constructed with this pipeline. The plans and specifications were completed and on November 10, 2009, through Resolution Number 2009-284, Council authorized to advertize for bids to for the Corrugated Metal Pipe Replacement Project - State Street and Oak Avenue. On January 7, 2010, eighteen (18) sealed bids were received, opened, witnessed for the construction of this project as shown in the following Table 1. Bid documents submitted by the lowest bidder, Empire Pipeline, were determined to be responsive after staff completed a review of the contract documents and determined that they were in order. Based on a review of the bids submitted, staff recommends awarding the construction contract to Empire Pipeline, in the amount of $345,690. ENVIRONMENTAL IMPACT: The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(b) - minor alteration of existing facilities of public utility services involving negligible or no expansion and 15304(f) - minor trenching or backfilling. Annually, funds are added to the project through the Capital Improvement Program. This funding source is not subject to State or Federal restrictions regarding prevailing wage. Therefore, pursuant to Carlsbad Municipal Code Section 3.28.130, prevailing wages are not required for the construction of CMP Replacement Program, Project No. 6607. PROJECT NO. 6607. WHEREAS, on November 10, 2009, the City Council of the City of Carlsbad, through 6 Resolution No. 2009-284, has previously authorized to advertize for bids to construct the Corrugate Metal Pipe Replacement Program - State Street and Oak Avenue; and 8 WHEREAS, eighteen (18) sealed bids were received on January 7, 2010, by the City for 9 the construction of said project; and 10 WHEREAS, the lowest responsive and responsible bid to construct said project was submitted by Empire Pipeline in the amount of $345,690; and WHEREAS, the City Council of the City of Carlsbad, California, has determined it 1 O necessary, desirable, and in the public interest to accept bids and award a contract to construct14 the Corrugated Metal Pipe Replacement Program - State Street and Oak Avenue; and I O WHEREAS, funding for said project has been appropriated from the Infrastructure16 Replacement Fund (IRF) to cover all project costs and is sufficient; and WHEREAS, the City Manager is hereby authorized to approve change orders in the18 cumulative amount equal to the contingency hereby set at fifteen percent (15%) of the contract 20 21 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 22 California, as follows: 23 1. That the above recitations are true and correct. 2. That the bid amount of $345,690 submitted by Empire Pipeline is hereby accepted and the Mayor is hereby authorized to execute a contract with Empire Pipeline for the construction of the Corrugated Metal Pipe Replacement Program - State Street and Oak Avenue, 5 1 Project No. 6607, in accordance with plans, specifications, and contract documents referred to 2 herein. 3 3. That the award of contract is contingent upon the bidder submitting the lowest 4 responsive bid executing the required contract and submitting the required bonds and insurance 5 policies, as described in the contract, within twenty (20) days of adoption of this resolution.
