RECOMMENDED ACTION:
Adopt Resolution No. 2010-034 _ accepting bids and awarding the contract to Terra Pipeline
Inc. for the Corrugated Metal Pipe Replacement Program - Alder Avenue and Marron Road Storm
Drains, Project No. 6607.
ITEM EXPLANATION:
The Corrugated Metal Pipe (CMP) Replacement Program was established to replace, repair or
remediate deteriorated CMP storm drain pipelines throughout the City. The pipelines included in the
program were identified after City staff inspected the interior of the storm drain pipe and assessed the
condition of the CMP pipelines. The program includes the eventual replacement or remediation of 25
storm drain pipelines. The locations of the pipelines and status are included in Exhibit 2.
The Alder Avenue project will construct new storm drain and curb inlets to alleviate an existing
drainage issue and install a cured-in-place liner into an existing pipeline that conveys run off from
Alder Avenue down to El Camino Real a distance of 252 feet. The Marron Road project will install an
85 feet long cured-in-place liner into a storm drain pipeline in the Westfield Shopping Center parking
lot near the North County Transit District Transit Center.
The plans and specifications were completed and on December 1, 2009, through Resolution Number
2009-20,045, Council authorized to advertize for bids for the Corrugated Metal Pipe Replacement
Project - Alder Avenue and Marron Road Storm Drains, Contract No. 6607.
On January 20, 2010, thirteen (13) sealed bids were received, opened, and witnessed for the
construction of the subject project and are summarized in Table 1.

The Engineer's Estimate for construction costs, prepared by Harris and Associates, was $145,880.
Bid documents submitted by the lowest bidder, Terra Pipeline Inc., were determined to be responsive
after staff completed a review of the contract documents and determined that they were in order.
Based on a review of the bids submitted, staff recommends awarding the construction contract to
Terra Pipeline Inc., in the amount of $104,715.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA
Guidelines Section 15301(b) - minor alteration of existing facilities of public utility services involving
negligible or no expansion and 15304(f) - minor trenching or backfilling.
FISCAL IMPACT:
Table 2 shows the current financial status of the Corrugate Metal Pipe Replacement Program:

Sufficient funds have been appropriated from the Infrastructure Replacement Fund (IRF) to fund this
project. Annually, funds are added to the project through the Capital Improvement Program. This
funding source is not subject to State or Federal restrictions regarding prevailing wage. Therefore,
pursuant to Carlsbad Municipal Code Section 3.28.130, prevailing wages are not required for the
construction of CMP Replacement Program, Project No. 6607. Staff recommends awarding the
contract for the construction of CMP Replacement Program - Alder Avenue and Marron Road Storm
Drains, Project No. 6607 to Terra Pipeline Inc..

CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
3 THE CONTRACT TO TERRA PIPELINE INC. FOR THE
CORRUGATED METAL PIPE REPLACEMENT PROGRAM -
4 ALDER AVENUE AND MARRON ROAD STORM DRAINS,
PROJECT NO. 6607.

6 WHEREAS, on December 1, 2009, the City Council of the City of Carlsbad, through
7 Resolution No. 2009-20,045, has previously authorized to advertize for bids to construct the
8 Corrugate Metal Pipe Replacement Program Alder Avenue and Marron Road Storm Drain
9 Replacements, Project No. 6607and
10 WHEREAS, thirteen (13) sealed bids were received on January 20, 2010, by the City for
11 the construction of said project; and
12 WHEREAS, the lowest responsive and responsible bid to construct said project was
13 submitted by Terra Pipeline Inc. in the amount of $104,715; and
14 WHEREAS, the City Council of the City of Carlsbad, California, has determined it
15 necessary, desirable, and in the public interest to accept bids and award a contract to construct
16 the Corrugated Metal Pipe Replacement Program - Alder Avenue and Marron Road Storm Drains
Replacements; and
18 WHEREAS, funding for said project has been appropriated from the Infrastructure
19 Replacement Fund (IRF) to cover all project costs and is sufficient; and
20 WHEREAS, the City Manager is hereby authorized to approve change orders in the
21 cumulative amount equal to the contingency hereby set at fifteen percent (15%) of the contract
22 award.
23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
25 1. That the above recitations are true and correct.
26 2. That the bid amount of $104,715 submitted by Terra Pipeline Inc. is hereby
27 accepted and the Mayor is hereby authorized to execute a contract with Terra Pipeline Inc. for the
28
1 construction of the Corrugated Metal Pipe Replacement Program - Alder Avenue and Marron
2 Road Storm Drains Replacements, Project No. 6607, in accordance with plans, specifications, and
3 contract documents referred to herein.
4 3. That the award of contract is contingent upon the bidder submitting the lowest
5 responsive bid executing the required contract and submitting the required bonds and insurance
6 policies, as described in the contract, within twenty (20) days of adoption of this resolution. The
7 City Manager may grant reasonable extensions of time.
