RECOMMENDED ACTION:
City Council of the City of Carlsbad Adopt Resolution No. 2010-056 accepting the contract for
construction of the El Camino Real 24-inch Transmission Main, Flow Control Station, Widening North
of Cougar Drive, and Median Improvements, Project Nos. 3843, 3920, & 3920-A as complete, and
directing the City Clerk to record a Notice of Completion and release bonds in accordance with State
Law and City Ordinances.
Board of Directors of the Carlsbad Municipal Water District (CMWD) Adopt Resolution No.
1390 accepting the contract for construction of the El Camino Real 24-inch Transmission
Main, Flow Control Station, Widening North of Cougar Drive, and Median Improvements, Project Nos.
3843, 3920, & 3920-A as complete, and directing the Secretary to record a Notice of Completion and
release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On July 15, 2008, the City of Carlsbad and CMWD awarded a contract to TC Construction Company,
Inc. in the amount of $1,677,432 for the construction of the El Camino Real 24-inch Transmission
Main, Flow Control Station, Widening North of Cougar Drive, and Median Improvements, Project Nos.
3843, 3920, & 3920-A.
TC Construction Company, Inc. substantially completed the project on August 21, 2009. The final
punch list items were completed on March 3, 2010. Staff has inspected the work and found it to be
satisfactory. Staff recommends acceptance of the improvements by the City Council and the Board.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

WHEREAS, the construction of the El Camino Real 24-inch Transmission Main, Flow

Control Station, Widening North of Cougar Drive, and Median Improvements, Project Nos. 3843,

3920, & 3920-A, has been completed to the City's satisfaction by TC Construction Company, Inc.

on March 3, 2010; and

WHEREAS, the formal project Notice of Completion has been prepared; and

WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,12

1. That the above recitations are true and correct.

Widening North of Cougar Drive, and Median Improvements, specifically identified as Project Nos.
3843, 3920, and 3920-A is deemed complete and is hereby accepted by the City Council of the
City of Carlsbad.
