TRAN CONTINUATION OF LOCAL DECLARATION OF EMERGENCY FOR CARLSBAD BOULEVARD ROADFILL FAILURE DEPT. DIRECTOR (2^\~ CITY ATTORNEY /gj?. CITY MANAGER (X^-i ^ RECOMMENDED ACTION: Adopt Resolution No. 2010-057 to continue the Declaration of a Local Emergency for repair and stabilization of a roadfill failure along the number two lane of Carlsbad Boulevard, Southbound, northerly and southerly of the Encinas Creek Bridge. ITEM EXPLANATION: On January 17, 2010, and for several days following, severe storms produced substantial rainfall, flooding and destructive tidal-surge wave action in Carlsbad. These events occurred on or about the same time as higher than normal tides produced by an astronomical high tide event. On February 2, 2010, during a routine inspection, staff determined that the roadway along Carlsbad Boulevard, south of the Encinas Creek Bridge had been compromised and the integrity of the roadway was at risk. Staff implemented protocols to ensure the safety of the motoring public, bicyclists, and pedestrians, and a local emergency was declared on February 5, 2010. Federal-Aid is currently being pursued by Staff. Staff and Nolte Associates have prepared a 60% design to temporarily protect Carlsbad Boulevard by extending the rip rap design being used for the Encinas Creek Bridge replacement project, Project No. 3919, approximately 250 feet south to the State's sewer lift station where suitable rip rap exists. Based on meetings with Encina Wastewater Authority (EWA), EWA has agreed to secure the professional services of an engineering consultant to prepare a design to protect their outfall. Staff is in the process of securing an Emergency Coastal Development Permit (CDP) separate from the CDP issued for the Encinas Creek Bridge replacement projeet. An Emergency CDP is required to excavate on the west side of Carlsbad Boulevard and locate the Encina Wastewater Treatment Plant (EWTP) outfall. After locating the outfall, the rip rap design and the design to protect EWTP outfall can be completed. Staff has been coordinating with the State Department of Parks (State) to relocate their sewer forcemain that was exposed during the destructive tidal-surge wave action that occurred in January. The State's existing sewer forcemain conflicts with the City's proposed temporary rip rap improvements and must be removed prior to placing rip rap. The State is in the process of designing the relocation of their facilities. ENVIRONMENTAL IMPACT: Emergency projects are statutorily exempt from CEQA pursuant to CEQA Guidelines Section 15269. At this time, though, Federal-Aid Highway Emergency Relief or California Disaster Assistance has not been secured. City Council appropriated $100,000 from the Gas Tax Fund at the March 9, 2010 Council meeting to complete the design portion of the emergency project. If Federal- Aid is secured, the Gas Tax Fund will be reimbursed by Federal-Aid. Staff will update the estimates after completing the design and obtaining a cost proposal for the improvements from Bert W. Salas, the onsite Contractor for the Encinas Creek Bridge replacement project. Staff will request additional funds once the cost proposal has been obtained. EXHIBITS: 1.
