DIRECTOR ^($f CITY ATTORNEY rf£§" CITY MANAGER ICT""" RECOMMENDED ACTION: Adopt Resolution No.2010-063 accepting bids and awarding the contract to PAL General Engineering, Inc., for the Palomar Airport Road Right Turn Lane to Melrose Drive, Project No. 6012. ITEM EXPLANATION: This project improves the southwest corner of the intersection of Palomar Airport Road and Melrose Drive. The improvements include a dedicated right turn lane from eastbound Palomar Airport Road to southbound Melrose Drive. In addition, landscaping and sidewalk improvements are included to accommodate the addition of the right turn lane. On December 22, 2009, through Resolution Number 2009-319, Council approved the plans and specifications and authorized the advertisement for bids for Palomar Airport Road Right Turn Lane to Melrose Drive, Contract No. 6012. On February 9, 2010, nineteen (19) sealed bids were received for the construction of this project, which are summarized in the Table 1. The lowest responsive bidder, PAL General Engineering, Inc., submitted a bid in the amount of $137,372. Staff has completed the review of all contract documents and has determined that they are in order. Therefore, staff recommends awarding the construction contract to PAL General Engineering, Inc., in the amount of $137,372. ENVIRONMENTAL IMPACT: The project was previously evaluated in the Final Program Environmental Impact Report (EIR) for the Bressi Ranch Master Plan 178 (EIR 98-04), dated July 9, 2002. The EIR evaluated the potential environmental effects of the development and operation of the Bressi Ranch Master Plan including an analysis of traffic circulation, water quality, biological resources, and land use. This project is within the scope of the Final Program EIR 98-04 and no further California Environmental Quality Act (CEQA) compliance is required. A total of $254,480 from the Community Facilities District #3 and the Traffic Impact Fee ("TIF") Funds has been programmed to the project. Table 2 summarizes the project costs to date. That the City Manager is hereby authorized to approve construction change orders up to $27,474 for Project No. 6012. 4. That payment of prevailing wages will not be required as part of the construction contract per City of Carlsbad Municipal Code Section 3.28.130. 5. That the award of contract is contingent upon the bidder submitting the lowest responsive bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
