RECOMMENDED ACTION:
Adopt Resolution No.2010-070 expressing intent to initiate proceedings pursuant to
Chapter 11.08 of the Carlsbad Municipal Code and calling for a public hearing for April 27, 2010, to
determine whether the public health, safety, or welfare require the formation of an underground utility
district on El Camino Real between Tamarack Avenue and Chestnut Avenue.
ITEM EXPLANATION:
The El Camino Real Street Widening Project No. 3957, widens El Camino Real from Chestnut
Avenue south to Tamarack Avenue to full prime arterial standards on portions of the east and west
side. Exhibit 1 shows the location of the project.
The El Camino Real widening will result in improvements within the right-of-way width of 126 feet that
include:
• 8-foot-wide bicycle lanes on both sides of the roadway.
• Three southbound lanes of 12-foot width each.
• Three northbound lanes of 12-foot width each.
• An 18-foot-wide landscaped median island.
• 5 Vz -foot-wide sidewalks on both sides of the roadway.
• 4 Vz -foot-wide native planted areas on both sides of the roadway.
Other elements incorporated into the design include narrowing the street widening to a width of 116
feet within the middle reach of the improvements to reduce the height of a planned retaining wall on
the west side of the roadway. In addition, the west side of the intersection of El Camino Real and
Chestnut Avenue will be improved by including the removal of the raised concrete channelization
features ("pork chops") and adding sidewalk improvements to meet requirements of Americans with
Disability Act (ADA). Unique aspects of the storm water management will be included in the
improvements and include a fully vegetated median to minimize site runoff and water quality
mitigation via bio-filter boxes.
Undergrounding Overhead Utilities: For this project, undergrounding of overhead utilities is
required in accordance with Council Policy No. 41. Within the subject segment of El Camino Real,
nine (9) transmission utility poles convey power and communication. The location of these poles is
shown on Exhibit 2 as poles 2 through 10. Also, two poles are located on the easterly side of El
Camino Real, referred to as poles 3A and 4A on Exhibit 2, for support purposes. Finally, at pole
number 5, a distribution line to pole 5A exists that provides two residences their power from this short
reach of the power distribution system. San Diego Gas & Electric holds an overhead easement from
pole 5 to 5A.

Staff has identified two alternatives for an underground district. The alternatives are as follows:
Alternative 1. The underground district will only be within the right-of-way of El Camino Real from the
middle of the intersection of Chestnut Avenue to just south of pole number 10. This will underground
eight of the poles. Pole 1 will remain as the connection point for the remaining overhead system
aligned east and west along Chestnut Avenue. Pole 5 will remain as the distribution pole for the local
distribution system. The boundary of this alternative is shown in Exhibit 3.
Alternative 2. The underground district boundary will only be within the right-of-way of El Camino
Real from the middle of the intersection of Chestnut Avenue to just south of pole number 10 and will
include the two properties served by the minor distribution system between poles 5 and 5A at 3821
and 3851 El Camino Real. This will underground all poles along El Camino Real south of Chestnut
Avenue to a point just north of Tamarack Avenue. Pole 1 will remain as it is on the north side of
Chestnut Avenue and is the terminus pole for this undergrounding. The boundary of this alternative is
shown in Exhibit 4.
These alternatives have financial impacts and are further discussed in the Fiscal Impact Section.
ENVIRONMENTAL IMPACT:
A Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program were
prepared for the El Camino Real Road Widening project (CDP 07-22/HDP 07-02/SUP 07-04/HMP 07-
08). The Notice of Intent (NOI) to adopt a Mitigated Negative Declaration was published in the
newspaper November 1, 2007, and sent to the County Clerk's Office for a 30-day public review
(October 30, 2007 - November 30, 2007). One comment letter was received during the 30-day review
period. The MND was approved by the Planning Commission on June 3, 2009 in compliance with the
California Environmental Quality Act (CEQA) Guidelines Section 15074.
FISCAL IMPACT:
The proposed El Camino Real Widening Project is a compilation of various Capital Improvement
Program (CIP) projects. The CIP projects and their funding sources include:
• 3957 - El Camino Real Widening Tamarack to Chestnut - Traffic Impact Fees, TransNet-
Local, & TransNet-Miscellaneous
• 3929 - El Camino Real Widening South of Chestnut - Traffic Impact Fees
• 6303 - Traffic signal repairs at El Camino Real and Tamarack - Infrastructure Replacement
• 6302 - Traffic signal repairs at El Camino Real and Chestnut - Infrastructure Replacement
• 3643 - El Camino Real Median Improvements - Public Facilities Fees & Gas Tax
Table 1 below summarizes current CIP account balances for the roadway widening.

The road widening project design is 90 percent complete and construction is currently estimated to
cost $10.7 million. When inspection, material testing, and construction contingency are added to the
road widening construction, the construction total is estimated to be $13.1 million.
Working with San Diego Gas & Electric (SDG&E), staff estimates the cost of the undergirounding of
about $2 million. These undergrounding costs are included in the construction contract estimate in
Table 2.
Two financing options are available to the City via the SDG&E undergrounding programs: 20A and
20B. The 20A and 20B programs are undergrounding programs through the California Public Utilities
Commission that allow for funding mechanisms for undergrounding projects. The 20A program is
funded through allocations from SDG&E to the City's 20A account. The funds for the allocations are
collected from SDG&E ratepayers. As of 2009, the City's account has a balance of minus $239,883.
A negative balance occurs when future allocations are borrowed against. The City is able to borrow
against up to 5 years of future allocations under the 20A program. The last 20A project performed by
the City (Roosevelt Street undergrounding) required borrowing against future 20A allocations.
Over the last 5 years, annual allocations to the City's 20A account ranged from a low of $82,469 in
2005 to a high of $184,657 in 2008 with an average of $133,000. Staff estimates that it would take at
least 10 years before a sufficient balance exists in the 20A account to fund this undergrounding. Also,
if this project uses the 20A funds, all other undergrounding projects will need to be paid with other
funds or delayed. For example, staff is currently in the process of designing an undergrounding
project for Valley Street/Magnolia Avenue as part of the street improvements in CIP project no. 6019.
If 20A funds were used for the El Camino Real Widening project to underground the utilities, those
funds could no longer be used for the Valley Street undergrounding project.
As part of the road widening, SDG&E would need to relocate its overhead poles that are in City's
right-of-way at its expense. Since the City desires to underground the overhead wires, under the 20B
program, SDG&E pays for the removal of the overhead facilities and gives the City an equivalent
overhead credit towards the cost of the project. The credit is created because SDG&E will not have to
construct new poles. This credit is determined by SDG&E during its undergrounding design and an
estimate is not available at this time. The City pays for all other undergrounding costs, such as
conduit, concrete structures, cables, etc. SDG&E pays to place the cables in the conduits and
energize the new system.

With this project being in its final design stages, staff recommends that the 20B program be used,
where the City pays for the undergrounding. TransNet funds can be used for undergrounding
purposes and funds are sufficient within all budgets for the widening to construct the undergrounding
with these funds.
FUNDING OPTIONS:
Two alternatives are identified for the implementation of undergrounding along El Camino Real from
Tamarack Avenue to Chestnut Avenue. Staff has reviewed the physical and financial aspects of the
project and developed two options:
Funding Option 1 - Underground the project using 20B funds while incorporating the Alternative 1
underground district boundary (excludes pole 5 and 5A undergrounding). The additional cost to the
project of this option is about $2 million.
Funding Option 2 - Underground the project using 20B funds while incorporating the Alternative 2
underground district boundary (undergrounding of all poles). The City would pay for undergrounding
the distribution line to the private properties (estimated at about $100,000) and acquire a utility
easement for SDG&E. The additional cost to the project of this option is about $2.1 million.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, EXPRESSING ITS INTENT TO
INITIATE PROCEEDINGS PURSUANT TO CHAPTER 11.08 OF
THE CARLSBAD MUNICIPAL CODE AND CALLING A PUBLIC
HEARING FOR APRIL 27, 2010, TO DETERMINE WHETHER
THE PUBLIC HEALTH, SAFETY, OR WELFARE REQUIRE THE
FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON
EL CAMINO REAL BETWEEN TAMARACK AVENUE AND
CHESTNUT AVENUE, PROJECT NO. 3957.
WHEREAS, Chapter 11.08 of the Carlsbad Municipal Code provides for the formation in
the City of Carlsbad of underground utility districts to accomplish the orderly removal of existing
overhead facilities and the construction of new underground facilities; and
WHEREAS, the City has consulted with the affected utilities and has conducted
preliminary studies and made investigations concerning the feasibility of such a district in an area
along El Camino Real extending between Tamarack Avenue and Chestnut Avenue; and
WHEREAS, said studies and investigations indicate that further proceedings pursuant to
Chapter 11.08 are warranted to determine whether or not the district should be established; and
1C. WHEREAS, two underground district boundaries were developed and include Alternative
,. 1 shown in Exhibit 3 and Alternative 2 shown in Exhibit 4; andID
WHEREAS, two funding options were identified and include:
Funding Option 1 using the Alternative 1 underground district boundary for an additional
cost of $2 million,i y
Funding Option 2 using Alternative 2 underground district boundary with City covering
private properties conversions for an additional costs of $2.1 million; and
WHEREAS, Council has selected Funding Option 2 ; and
WHEREAS, a Public hearing shall be held on this undergrounding on April 27, 2010.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:

1. That the above recitations are true and correct. The Council hereby expresses

its intent to initiate proceedings for the formation of an underground utility district for the above-

described area to be known as Underground Utility District No. 19 (District No. 19), Project No.
3957.
2. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council
of the City of Carlsbad on April 27, 2010, at the hour of 6:00 p.m. in the City Council Chambers, at
1200 Carlsbad Village Drive, Carlsbad, California, to ascertain whether the public health, safety, or
welfare require the removal of poles, overhead wires, and associated overhead structures, and the
underground installation of wires and facilities for supplying electric, communication, or similar
associated service in the area hereinabove described and to determine whether or not the Cityo
should continue proceedings to create and implement an underground utility district to accomplishy
said removal and installation.10
3. That the undergrounding will be financed in accordance with the 20B program as
described by San Diego Gas and Electric (SDG&E) undergrounding rules.

4. The City Council hereby waives permit fees associated with property

conversions.

5. At said hearing, all persons interested are invited to appear and present their
15
views and all such persons shall be given an opportunity to be heard. Said hearing may be
16 continued from time to time as may be determined by the City Council.
17 6. The boundary to be included within the proposed District No. 19 is shown upon
18 the map entitled "Underground Utility District No. 19", Project No. 3957 associated with Funding
19 Option 2 which is on file in the Transportation Department, and which is incorporated by
reference herein.
7. The City Clerk shall give notice of the time and place of the hearing to all
property owners within District No. 19, as shown on the last equalized assessment rolls or as
known to the City Clerk and to each public utility within District No. 19, by mailing a copy of this
resolution to such property owners and such utilities at least fifteen (15) days prior to the date
thereof.
