RECOMMENDED ACTION:
Adopt Resolution No. 2010-078 accepting the contract for construction of the Traffic Signal at Faraday
Avenue and Rutherford Road, Project No. 6312-1 as complete, and directing the City Clerk to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On February 17, 2009, the City of Carlsbad awarded a contract to T&M Electric, Inc. dba Perry Electric in the
amount of $145,800 for the construction of the Traffic Signal at Faraday Avenue and Rutherford Road, Project
No. 6312-1.
Perry Electric completed the contract on September 2, 2009. The punch list was completed and administrative
issues were resolved on March 12, 2010. City staff has inspected the work and found it to be satisfactory. Staff
recommends acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of CEQA
pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF THE TRAFFIC SIGNAL AT FARADAY AVENUE
. AND RUTHERFORD ROAD, PROJECT NO. 6312-1.
5 WHEREAS, the construction of the Traffic Signal at Faraday Avenue and Rutherford
Road, Project No. 6312-1, has been completed to the City's satisfaction by T&M Electric, Inc. dba
Perry Electric on September 2, 2009; and
WHEREAS, the punch list was completed and administrative issues were resolved on
March 12, 2010; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
-12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
13 California, as follows:
14 1. That the above recitations are true and correct.
15 2. That the Traffic Signal at Faraday Avenue and Rutherford Road, specifically
16 identified as Project No. 6312-1 is deemed complete and is hereby accepted by the City Council of
the City of Carlsbad.
18 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
1Q execute and record the Notice of Completion for the Traffic Signal at Faraday Avenue and
Rutherford Road, Project No. 6312-1.
