RECOMMENDED ACTION:
Adopt Resolution No. 2010-125 approving the Carlsbad TransNet Local Street Improvement
Program of Projects for Fiscal Years 2010/11 through 2014/15.
ITEM EXPLANATION:
The 2010 Regional Transportation Improvement Program (RTIP) is a program of proposed highway,
arterial, transit, and bikeway projects for Fiscal Years 2010/11 through 2014/15. The San Diego
Association of Governments (SANDAG) is required by State and Federal laws to develop and adopt
the RTIP every two years.
Each member agency of SANDAG that desires to expend TransNet and/or certain Federal and State
funds must approve a Program of Projects once every two years. In addition to projects with these
funding sources, the Program of Projects also includes regionally significant capacity increasing
projects regardless of the funding source. The Federal Metropolitan Planning and Air Quality
Conformity Regulations also require inclusion of all regionally significant capacity increasing road
projects for air quality emissions analysis.
The approval process includes a public hearing which allows citizens an opportunity to comment on
the City's Program of Projects. The adopted Resolution approving the Carlsbad Program of Projects
is due to SANDAG by June 30th. The Program of Projects is then incorporated into the 2010 RTIP as
assembled and submitted to the State by SANDAG by August 1, 2010.
The proposed Carlsbad Program of Projects for Fiscal Years 2010/11 through 2014/15, which is
attached as Exhibit A to the Resolution, includes projects with the following fund types:
Federal - SAFETEA-LU (High Priority Project, HPP)
Federal - Highway Bridge Program (HBP)
State - Transportation Development Act (TDA)
SANDAG - TransNet Local
Local - City funds
Local - Private funds
The Federal funding included in the Carlsbad Program of Projects consists of $1,436,000 in Federal
SAFETEA-LU, High Priority Project funds for Poinsettia Lane Reach E. The City is also programmed
to receive Federal Highway Bridge Program funding which is included by SANDAG and Caltrans as a
lump sum allocation and therefore is not listed as a funding line item on the City of Carlsbad Program
of Projects.

The State IDA funds are programmed for the installation of audible and count down pedestrian signal
equipment.
The TransNet funds are programmed for a variety of projects including bridge improvement, roadway
improvement and roadway maintenance projects. The Transnet funding will provide the local
matching funds for two bridge railing projects along Carlsbad Boulevard. The bridges are located
across the warm water outfall channel from the Encina power station and over the railroad just south
of State Street. The TransNet funds are also programmed for roadway widening projects which are in
progress as well as the ongoing Pavement Management Program.
The Program of Projects also includes various capacity increasing roadway projects located along
regionally significant arterials, regardless of the funding source. The projects in this category include
various roadway segments and intersection improvements. The majority of these projects are funded
by local City funds such as Traffic Impact Fees and/or local Private funds.
The Program of Projects can be revised as needed on a quarterly basis during the two year period
between the adoption of the 2010 RTIP and the subsequent 2012 RTIP.
ENVIRONMENTAL IMPACT:
This activity is statutorily exempt from CEQA pursuant to State CEQA Guidelines, Section 15276,
which states that CEQA does not apply to the adoption of regional transportation improvement
programs.
FISCAL IMPACT:
Approving the RTIP is a requirement under State law for receiving TransNet, State and Federal
funds. Approval of the RTIP ensures eligibility for funding and programs the funding for future
obligation.
Inclusion in the RTIP, however, is not a guarantee that projects will receive the stated funding. The
amounts shown are the best available estimates of anticipated funding. In the event that funding falls
short or is not available, the City Council is not obligated to proceed with a project just because it is
included in the RTIP.
EXHIBITS:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ADOPTING THE CARLSBAD
TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF
PROJECTS FOR FISCAL YEARS 2010111 THROUGH
2014115.
WHEREAS, on November 4, 2004, the voters of San Diego County approved the
San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet
Extension Ordinance); and
WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the
Regional Transportation Commission, shall approve a multi-year program of projects submitted
by local jurisdictions identifying those transportation projects eligible to use transportation sales
tax (TransNet) funds; and
WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local
street and road revenues for Fiscal Years 201 1 through 2015; and
WHEREAS, the City of Carlsbad has held a clearly noticed public hearing with an
agenda item that clearly identified the proposed list of projects prior to approval of the projects
by its authorized legislative body in accordance with Section 5(A) of the TransNet Ordinance
and Rule 7 of the SANDAG Board Policy 31.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of
Carlsbad certifies that no more than 30 percent of its annual revenues from the TransNet funds
shall be spent on maintenance related projects.
3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of
Carlsbad certifies that all new projects, or major reconstruction projects, funded by TransNet
revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this
requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the
City of Carlsbad's public hearing process.
4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of
Carlsbad certifies that the required minimum annual level of local discretionary funds to be
expended for street and road purposes will be met through the 5-year period consistent with the
most recent Maintenance of Effort Requirements adopted by SANDAG.
5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of
Carlsbad certifies that it will extract $2,000 from the private sector for each newly constructed
residential housing unit in the City of Carlsbad to comply with the provisions of the Regional
Transportation Congestion lmprovement Program (RTCIP).
6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of
Carlsbad certifies that is has established a separate Transportation lmprovement Account for
TransNet Revenue with interest earned expended only for those purposes for which the funds
were allocated.
7. That pursuant to Section 18 of the TransNet Extension Ordinance, the City of
Carlsbad certifies that each project of $250,000 or more will be clearly designated during
construction with TransNet project funding identification signs.
8. That the City of Carlsbad does hereby certify that all other applicable provisions of
the TransNet Extension Ordinance and the SANDAG Board Policy 31 have been met.
9. That the City of Carlsbad agrees to indemnify, hold harmless and defend SANDAG,
the San Diego County Regional Transportation Commission, and all officers and employees
thereof against all causes of action or claims related to local TransNet funded projects.
10. That the Carlsbad TransNet Local Street Improvement Program of Projects for
Fiscal Years 201 1 through 2015 attached to this Resolution as Exhibit A is hereby approved.
