RECOMMENDED ACTION:
Adopt Resolution No. 2010-128 approving and authorizing an increase in the contingency for
the construction of Alga Norte Community Park, Project No. 3837.
ITEM EXPLANATION:
On January 12, 2010, the City Council adopted Resolution 2010-003 awarding a contract to KTA
Construction for the grading of Alga Norte Community Park. The grading started in March 2010 with
an anticipated completion date of September 2010.
During grading of the site, unanticipated soft soils and groundwater conditions were discovered along
the easterly portion of the park site adjacent to Alicante Road. In order to complete the park site
grading in accordance with the contract plans and specifications, it is necessary to perform remedial
grading operations and install soil stabilization measures to mitigate these unanticipated conditions.
Upon discovery of the groundwater, staff began working with the City's contract Geotechnical
Engineer to develop a solution. The recommendations developed include localized dewatering and
installation of a layer of imported rock and placement of soil stabilization fabric. Implementation of
these mitigation measures will allow KTA Construction to continue placement of compact fill soils in
accordance with the contract plans and specifications.
ENVIRONMENTAL IMPACT:
On March 1, 2006, the Planning Commission adopted Resolution Nos. 6039 and 6040, adopting a
Negative Declaration (ND) and Conditional Use Permit No. 04-08, respectively for the project.
FISCAL IMPACT:
The revised total estimated cost of construction for the grading of Alga Norte Community Park, Project
No. 3837, is shown in Table 1. This table reflects increasing the construction contingency budget by
$125,000.
This increase is being requested because the dollar amount of change orders anticipated over the
next couple of weeks, including the change order necessary to mitigate the groundwater issues
discussed above, exceeds $225,500.

As shown in the Table 2, sufficient Public Facilities Fees (PFF) and General Capital
Construction (GCC) funds totaling $45,704,190 are available in the project budget to accommodate
the increase in contingency of $125,000.

WHEREAS, on January 12, 2010, the City Council of the City of Carlsbad, through

Resolution No. 2010-003, awarded the contract for construction of the grading of Alga Norte

Community Park, Project No. 3837, to KTA Construction; and
7
WHEREAS, unforeseen conditions including soft soils and groundwater were discovered
8
in the field which require additional remedial grading operations as well as soil stabilization
9
measures; and10
WHEREAS, it has been determined to be necessary to increase the construction11
contingency for the grading of Alga Norte Community Park, Project No. 3837, by an amount of
$125,000; and13
WHEREAS, the City Manager was previously authorized to approve change orders up to
$225,500 and will now be authorized to approve change orders up to $350,500 for the grading of15
Alga Norte Community Park, Project No. 3837; and16
WHEREAS, funds are available in the existing project budget to cover the contingency

ig NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
20 California, as follows:
21 1. That the above recitations are true and correct.
22 2. That the contingency for the grading of Alga Norte Community Park, Project No.
23 3837, is hereby increased $125,000 using available project funds.
24 3. That the City Manager is hereby authorized to approve construction change
25 orders for the grading of Alga Norte Community Park, Project No. 3837 up to $350,500.
