RECOMMENDED ACTION:
Adopt Resolution No. 2010-134 approving the City of Carlsbad's application to the California
Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California
Integrated Waste Management Board, Used Oil Payment Program (OPP) and authorizing the Utilities
Director, or designee, as signature authority for all related grant documents.
ITEM EXPLANATION:
The California Oil Recycling Enhancement Act authorizes the collection of four cents for every quart of
lubrication oil sold, transferred, or imported into California. A portion of these funds is available to local
governments in the form of the OPP. These funds were authorized in SB 546, and replace the Used Oil
Block Grant Program, which encourages collection programs and recycling of used oil. The annual
appropriated funds to the OPP will be determined each year by CalRecycle for each annual period from
July 1, 2010 to June 30, 2015. Payments are made in April of the first year of the term.
With the City Council's approval, the current and future OPP is slated to address the following items;
continuing public education, enhancing the use of the permanent collection facilities available to residents,
and identifying new activities that can strengthen the level of services provided to the City's residents. Staff
used previous block grant funds from the California Integrated Waste Management Board to develop and
continue an outreach campaign; assist paying for the Household Hazardous One Day Collection Event,
which included accepting used oil and filters; assist with the Storm Water Protection Mitigation program;
and it has paid for program management staff time.
ENVIRONMENTAL IMPACT:
The approval of the OPP application is exempt from the requirements of CEQA pursuant to Section 15268
of the State CEQA Guidelines.
FISCAL IMPACT:
Per the payment requirements of the OPP, funds must be expended prior to the end of the term or
returned to CalRecycle. The funding for the OPP is made late in the first year term. Therefore, staff is
requesting an initial appropriation of an amount not to exceed $20,000 to the solid waste fund in
advance of payment for each annual term. In addition, staff is requesting the OPP funds received by
CalRecycle in excess of the initial appropriated funds be appropriated after the OPP payment has
been received in April for each annual period between July 1, 2010 and June 30, 2015.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, APPROVING THE USED OIL
PAYMENT PROGRAM APPLICATION AND APPROPRIATION
4 OF FUNDS.

WHEREAS, Public Resources Code (PRC) § 48690 et seq. authorize the California
6
Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California
7
Integrated Waste Management Board, to make payments to qualifying jurisdictions for

implementation of their used oil programs as required by PRC § 48690 et seq.; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
10 procedures governing the administration of the Used Oil Payment Program (OPP); and
11 WHEREAS, CalRecycle's procedures for administering the OPP require, among other
12 things, an applicant's governing body to declare by resolution certain authorizations related to the
13 administration of the OPP; and
14 WHEREAS, the City of Carlsbad is desirous of applying for these funds; and
WHEREAS, initial appropriated funds will not exceed $20,000 for the term for each15
annual period between July 1, 2010 and June 30, 2015; and

WHEREAS, OPP funds received by CalRecycle in excess of initial appropriated funds
17
will be appropriated after OPP payment has been received in April for each annual period.
18 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
19 California, as follows:
20 1. That the above recitations are true and correct.
21 2. That this authorizes the submittal of an OPP application to CalRecyle.
22 3. That the Utilities Director, or his/her designee, is hereby authorized and
oo empowered to execute in the name of the City of Carlsbad all documents, including but not limited
24 to, applications, agreements, annual reports including expenditure reports and amendments
25 necessary to secure said payments to support our Used Oil Collection Program.
26 4. That this authorization is effective for five (5) years from the date of adoption of
27 this resolution for the period of July 1, 2010 through June 30, 2015; and

1 5. That the Finance Director is hereby directed to appropriate solid waste funds in
2 an amount not to exceed $20,000 as the initial appropriated funds for each annual period; and
2 6. That the Finance Director is hereby directed to appropriate OPP funds received
by CalRecycle in excess of initial appropriated funds after OPP payment has been received in
April for each annual period between July 1, 2010 and June 30, 2015.
