RECOMMENDED ACTION:
Adopt Resolution No. 2010-135 accepting bids and awarding a contract for the construction of
the 2010 Concrete Replacement Project No. 6013.
ITEM EXPLANATION:
As part of the City's annual Concrete Replacement Program, staff has evaluated the concrete
improvements in the public right-of-way and produced a list of 245 locations where concrete
replacement is necessary. Curb, gutter, sidewalk, curb ramps, and driveway approaches need to be
replaced because of deterioration, cracking, and uplifting. The locations requiring repairs are located in
the southern portion of Carlsbad.
On March 23, 2010, City Council approved Resolution No. 2010-051, authorizing the advertisement for
bids for construction of the 2010 Concrete Replacement Project No. 6013. The engineer's estimate was
$230,000. Seventeen (17) bids were received on May 6, 2010, which are summarized as follows:

The lowest responsive bidder, Crest Equipment Inc., submitted a bid in the amount of $187,896. Staff
has completed its review of the contract documents and has determined that the bid by Crest
Equipment Inc. is responsive. Therefore, staff recommends that Crest Equipment Inc. be awarded the
contract.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines
Section 15301(c) - minor alteration of existing facilities including streets, sidewalks, gutters, and
similar facilities involving negligible or no expansion.
FISCAL IMPACT:
The total cost for the 2010 Concrete Replacement Project is $244,264 as shown in the table below.

The Concrete Replacement Program (CIP No. 6013) has sufficient GCC and Gas Tax funds available
to complete this project. Remaining appropriations will be used for future concrete replacement
projects. Prevailing wages are not required for this contract.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
A CONTRACT FOR CONSTRUCTION OF THE 2010
4 CONCRETE REPLACEMENT PROJECT NO. 6013.

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6 necessary, desirable, and in the public interest to replace damaged concrete; and
^ WHEREAS, the project is exempt from the California Environmental Quality Act (CEQA)
8 pursuant to CEQA Guidelines Section 15301(c); and
g WHEREAS, on March 23, 2010, the City Council approved contract documents and
specifications for furnishing of all labor, materials, tools, equipment, transportation, and other

expenses necessary or incidental to the 2010 Concrete Replacement Project No. 6013; and
WHEREAS, seventeen (17) sealed bids were received on May 6, 2010 for the project;
12 and
13 WHEREAS, the lowest responsive, responsible bid for the project was submitted by
Crest Equipment Inc., in the amount of $187,896; and14
WHEREAS, there are sufficient funds available in the Concrete Replacement Program
15 (CIP No. 6013) account for construction of the project.
16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
17 California, as follows:
1. That the above recitations are true and correct.18
2. That the bid submitted by Crest Equipment Inc., in the amount of $187,896 is
19 hereby accepted and the Mayor is hereby authorized to execute the contract for the construction
20 of the 2010 Concrete Replacement Project No. 6013, in accordance with the specifications and
21 contract documents referred to herein.
22 3. That the City Manager is hereby authorized to approve construction change
orders up to the contingency amount of $28,184 to Crest Equipment Inc. for the 2010 Concrete

Replacement, Project No. 6013.
4. That the award of this contract is contingent upon Crest Equipment Inc.
25 executing the required contract and submitting the required bonds and insurance policies, as
26 described in the contract, within twenty (20) calendar days of adoption of this resolution. The City
Manager may grant reasonable extensions of time.
