RECOMMENDED ACTION:
Adopt Resolution No. 2010-158 accepting the contract for construction of the Palomar Airport
Road Bridge over Carlsbad Boulevard, Project No. 4700 as complete, and directing the City Clerk to record
a Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On July 14, 2009, the City of Carlsbad awarded a contract to Truesdell Corporation of California, Inc. in the
amount of $647,647 for the construction of the Repair of Palomar Airport Road Bridge over Carlsbad
Boulevard, Project No. 4700.
Truesdell Corporation of California, Inc. completed the contract on December 24, 2009. City staff has
inspected the work and found it to be satisfactory. Staff recommends acceptance of the improvements by
the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of
CEQA pursuant to Section 15268 of the State CEQA Guidelines.

Upon substantial completion of the project, Truesdell Corporation of California, Inc. filed a claim requesting
additional compensation related to project delays. Until the claim is settled, the total construction
expenditures remain unknown.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF THE REPAIR OF PALOMAR AIRPORT
4 ROAD BRIDGE OVER CARLSBAD BOULEVARD, PROJECT
NO. 4700. AS COMPLETE.

WHEREAS, the construction of the Palomar Airport Road Bridge over Carlsbad

Boulevard, Project No. 4700, has been completed to the City's satisfaction by Truesdell
7
Corporation of California, Inc. on December 24, 2009; and
8
WHEREAS, the formal project Notice of Completion has been prepared; and
9
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:

1. That the above recitations are true and correct.13
14 2. That the Palomar Airport Road Bridge over Carlsbad Boulevard, specifically
15 identified as Project No. 4700 is deemed complete and is hereby accepted by the City Council of
16 the City of Carlsbad.
17 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
18 execute and record the Notice of Completion for the Palomar Airport Road Bridge over Carlsbad
19 Boulevard, Project No. 4700.
