RECOMMENDED ACTION:
Adopt Resolution No.2010-159 accepting the contract for construction of the Poinsettia
Community Park - Phase 2B Parking Lots, Project No. 4504 as complete, and directing the City Clerk to
record a Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On May 19, 2009, the City of Carlsbad awarded a contract to Marathon General, Inc. in the amount of
$232,447 for the construction of the Poinsettia Community Park - Phase 2B Parking Lots,
Project No. 4504.
Marathon General, Inc. completed the contract on February 10, 2010. City staff has inspected the work
and found it to be satisfactory. Staff recommends acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of
CEQA pursuant to Section 15268 of the State CEQA Guidelines.

Upon substantial completion of the project, Marathon General, Inc. filed a claim requesting additional
compensation related to project delays. Until the claim is settled, the total construction expenditures remain
unknown.

COMPLETE.

WHEREAS, the construction of the Poinsettia Community Park - Phase 2B Parking

Lots, Project No. 4504, has been completed to the City's satisfaction by Marathon General, Inc. on

February 10, 2010; and
8
WHEREAS, the formal project Notice of Completion has been prepared; and
9
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:

1. That the above recitations are true and correct.13
. 2. That the Poinsettia Community Park - Phase 2B Parking Lots, specifically
._ identified as Project No. 4504 is deemed complete and is hereby accepted by the City Council of
