RECOMMENDED ACTION:
Adopt Resolution No. 2010-211 , accepting bids and awarding the construction contract to
Mark Sauer Construction, Inc. for the Leo Carrillo Ranch Barn Restoration, City Project No.
45051.
ITEM EXPLANATION:
The Leo Carrillo Ranch Master Plan calls for retrofitting the original barn into a theater to
showcase Leo Carrillo's life, other period and interpretive films, as well as a venue for lectures
and small gatherings. The barn project has been split into two phases, "stabilization" and
"restoration".
In June of 2009, the Carrillo Ranch Barn "stabilization" was completed using a combination of
City funds and a Federal grant. Shortly thereafter, in August of 2009 the City Council directed
staff to proceed with the full build out of the barn project. In December 2009, an architectural
consultant was hired to complete the plans and specifications for the full restoration of the
barn/theater.
On May 25, 2010 the City Council authorized the bidding for the barn restoration project. On
July 20, 2010, three bids were received for the project. The table below lists the bidders and
the corresponding bids received.

The project contract required pre-qualification of the Contractors and Sub-Contractors to assure
experience with historic projects completed under The Secretary of the Interior's Standards for
the Treatment of Historic Properties. While Fordyce Construction Inc. did have some
experience with historic restoration, they did not meet the contract's pre-qualifications for
completion of 5 (minimum) separate projects under the Secretary of the Interior's Standards for
the Treatment of Historic Properties. Therefore, staff is recommending that the City Council
award the contract to Mark Sauer Construction, as the lowest responsive bid received that met
the contracts' requirement for pre-qualification.

Annual operating costs for the barn/theater are estimated at $13,000. These are for facility
maintenance costs only. No additional operating costs are required as current Parks &
Recreation staff on site will operate the facility
ENVIRONMENTAL IMPACT:
The Leo Carrillo Ranch Park Master Plan was originally approved by the Planning
Commission with a Mitigated Negative Declaration, on November 11, 1999 (Planning
Commission Resolution No. 4694). Planning staff has reviewed the proposed restoration
project and the Planning Director has determined that the proposed project is within the
scope of the prior environmental documents and that no further environmental documentation
is required per CEQA Guideline Sections 15162.

6 WHEREAS, the City Council of the City of Carlsbad, California, has determined it
7 necessary, desirable, and in the public interest to restore the existing barn structure at Leo
^ Carrillo Ranch Historic Park; and

WHEREAS, funds are available in the Fiscal Year 2010-11 Capital Improvement
10
Program Budget for the full restoration of the barn structure; and
11
WHEREAS, the City Council, of the City of Carlsbad, California has previously
12
adopted Resolution No. 2010-120, approving the plans and specifications and authorizing
the advertisement for the bidding for the Project; and
15 WHEREAS, Three (3) sealed bids were received and opened in public by the
16 City on July 20, 2008 for the Project; and
17 WHEREAS, it was determined that Mark Sauer Construction, Inc. is the lowest
18 responsive and responsible bid received; and
19 WHEREAS, The City Council of the City of Carlsbad, California, has determined
20 it necessary, desirable and in the public interest to award the Project contract to Mark
21
Sauer Construction, Inc.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
23
Carlsbad, California, as follows:
25 1. That the above recitations are true and correct.

2. Funds are available in the Fiscal Year 2010-11 Capital Improvement
Program Budget for the construction of the barn restoration at Leo Carrillo
3 Ranch Historic Park.

3. That the bids received and opened by the City for the Leo Carrillo Ranch

Barn Restoration, City Project 45051, on July 20, 2010 are hereby
6
accepted and the lowest responsive, responsible bid received is hereby
determined to be that bid submitted by Mark Sauer Construction, Inc., in
9 the amount of $335,000.
10 4. That the bid received from Mark Sauer Construction Inc. is accepted and
11 that the contract is hereby awarded to Mark Sauer Construction Inc. and
12 that the Mayor is authorized to execute said contract on behalf of the City.

5. That the City Manager is hereby given the authority to approve
14
construction change orders, singly or in aggregate, for the Project up to

A question was raised today during Council briefings regarding why one contractor was disqualified as it appeared they
had been pre-qualified.
The pre-qualification criteria was included in the invitation to bid, and while the contractor did not meet the published
criteria, they still chose to submit a bid.
