RECOMMENDED ACTION:
Adopt Resolution No. 2010-212 establishing interim compensation for the Deputy City Treasurer
while she is acting City Treasurer.
ITEM EXPLANATION:
Due to the untimely death of City Treasurer Harold "Mac" McSherry, the City Council declared a
vacancy in the position of City Treasurer on July 27, 2010. At that time, the City Council
approved Resolution No. 2010-198 leaving the elected position unfilled for the remainder of Mr.
McSherry's unexpired term of office and providing that the Deputy City Treasurer is authorized
to perform any duties normally performed by the City Treasurer until a new City Treasurer is
elected on November 2, 2010 and sworn into office.
Sections 41006 and 41007 of the Government Code provide that the City Treasurer may
appoint deputies, and that these deputies shall receive compensation as is provided by the
legislative body. City employee Nancy Sullivan was initially appointed as Deputy City Treasurer
in November 2004 by Treasurer McSherry's predecessor, Jim Stanton, and the City Council
confirmed her status as Deputy City Treasurer on July 27, 2010.
Section 2.08.020 of the Carlsbad Municipal Code sets the compensation of the City Treasurer
at $1070 per month. Because Ms. Sullivan is currently performing any duties normally
performed by the City Treasurer, it is recommended that she receive compensation in an
amount equivalent to the salary of the City Treasurer during the period of time that she is
serving as the City Treasurer. It is proposed that the City Council approve this salary
retroactive to the first day of the pay period that includes July 27, 2010 and be discontinued as
of the date a new City Treasurer is sworn into office.
FISCAL IMPACT:
The cost of this temporary salary is estimated to be $5,400. Sufficient funds are available in the
City Treasurer's budget to cover this expense and there is no net increase in cost to the City
since the same amount would have been paid to the incumbent City Treasurer for the balance
of his term in office.

ENVIRONMENTAL IMPACT:
This amendment is not a "project" within the meaning of CEQA pursuant to Public Resources
Code Section 21065 since it is not an activity which may cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment.

21 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
22 Carlsbad, California, as follows:
23 1. That the above recitations are true and correct.

2. That the Deputy City Treasurer shall receive interim compensation
25
equivalent to the salary of the City Treasurer while she is performing the duties of the
26
City Treasurer.

1 3. That this compensation is retroactive to the first day of the pay period that
2 includes July 27, 2010 and shall be discontinued as of the date a new City Treasurer is
sworn into office.

4. That the expenditure of $5,400 is hereby authorized from the City

Treasurer's General Fund budget.
