Trail Boardwalk at Lake Calavera

RECOMMENDED ACTION:
Adopt Resolution No. 2010-227 authorizing the filing of an application for grant funds
from the Habitat Conservation Fund Program (HCF) for a trail boardwalk at Lake Calavera, and
for committing matching funds necessary to complete the grant application.
ITEM EXPLANATION:
To date $598,750 has been appropriated in the 2010-11 CIP budget for implementation of the
Lake Calavera Trails Master Plan. A component of the master plan is construction of a
boardwalk over existing trails that cross Calavera Creek and wetland areas. (See Exhibit 2 for
locations of the proposed trail boardwalk.)
Sufficient funds are available in the project to cover costs to develop and construct the
boardwalk. However, staff would like to submit a grant proposal to the Habitat Conservation
Fund (HCF) in the amount of $100,000 to assist in recovering costs for the boardwalk
component of the trail system. A summary of the HCF grant program follows:
• HCF is a local assistance program of the State of California Department of Parks and
Recreation.
• State Parks distributes approximately $2 million per year for this grant.
• The HCF grant reimburses costs for the construction of trails.
• The grant performance period for each project is 5 years starting on July 1 of the fiscal
year following the application due date (October 1, 2010).
• Grantees have up to 3 years to execute the contract and an additional 2 years to finish
the project.
• Grant requests generally do not exceed $200,000.
• There is a required non State, dollar-for-dollar match.
• Eligible projects include new development of trails that bring people to a wildlife
environment.
FISCAL IMPACT:
If awarded, the funds received would defray costs towards a very important component of the
Lake Calavera trail system, including environmental permits, engineering surveys, mitigation
of wetlands (impacted by the boardwalk construction), and the construction of the boardwalk
itself.

The estimated costs for the trail boardwalk project and the grant funding request are
summarized below.

Currently there is $485,000 available in the Lake Calavera Trails Master Plan CIP account
whereby $100,000 of the funds could be used for the matching component for the grant if
Council so chooses. Grant request amount cannot exceed 50% of total project cost and the
required match amount must be a minimum of 100% of grant amount.
The associated maintenance and operations costs for the boardwalk can be accommodated
within the existing Parks and Recreation Department Trails Maintenance Budget.
ENVIRONMENTAL IMPACT:
Application for grant funds does not qualify as a "project" under the California Environmental
Quality Act (CEQA) per state CEQA Guidelines Section 15378, as it does not result in a
direct or reasonable foreseeable indirect physical change in the environment.
CEQA review for the Lake Calavera Trails Master Plan was completed in January of this year
and a Mitigated Negative Declaration was filed in compliance with Section 21108, for Project
No. HMP 09-05 and filed with the State Clearing House on January 25, 2010
(State Clearinghouse No. 2009071090).

WHEREAS, the people of the State of California have enacted the California
6
Wildlife Protection Act of 1990, which provides funds to the State of California for grants
7
to local agencies to acquire, enhance, restore or develop facilities for public recreation
8
g and fish and wildlife habitat protection purposes; and
10 WHEREAS, the State Department of Parks and Recreation has been delegated
11 the responsibility for the administration of the Habitat Conservation Fund (HCF)
12 Program, setting up necessary procedures governing project application(s) under the
13 HCF Program; and
14 WHEREAS, said procedures established by the State Department of Parks and
15 Recreation require the applicant (City of Carlsbad) to certify by resolution the approval
16
of applications(s) before submission of said applications(s) to the State; and
17
WHEREAS, as part of the grant award the City, as applicant will be required to18
enter into a subsequent contract with the State of California that assures that the City
20 will complete the construction of the trail boardwalk at Lake Calavera ("project"); and
21 WHEREAS, adequate funding is available in the Lake Calavera Trails Capital
22 Improvement Program account (account no. 3007000 9060 38661) to utilize as a match
23 for the grant application; and
24 WHEREAS, the City Council of the City of Carlsbad, California, finds it desirable
25
and in the public interest to construct a boardwalk for the Lake Calavera trail system;
26
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
27
Carlsbad, California as follows:

1 1. That the above recitations are true and correct.
2 2. Approves the filing of an application for the Habitat Conservation Fund Program.
3. Certifies that the applicant has or will have available, prior to commencement of
4 any work on the project included in this application, the required match and sufficient
5
funds to complete the project.

4. Certifies that the applicant has or will have sufficient funds to operate and
7

5. Certifies that the applicant has reviewed, understands, and agrees to the
10 provisions contained in the contract shown in the grant administration guide.
11 6. That the City Manager or designee has the authority to negotiate, submit, and
12 execute all related HCF Grant documents, including, without limitation, the grant
13 application, agreements, amendments and process payment requests and other
14 documents that may be necessary for the completion of the project.
7. The applicant agrees to comply with all applicable federal, state and local laws,

including applicable ordinances, rules, regulations and guidelines.
