TRANS ACCEPTANCE OF BIDS AND AWARD OF CONTRACT FOR CONSTRUCTION OF THE 2010 PAVEMENT OVERLAY PROJECT NO. 6001-10-OL2 DEPT. DIRECTOR (\ H CITY ATTORNEY ^2>> CITY MANAGER \jJ^— RECOMMENDED ACTION: Adopt Resolution No. 2010-228 accepting bids and awarding the contract to ATP General Engineering Contractors for construction of the 2010 Pavement Overlay Project No. 6001-10-OL2. ITEM EXPLANATION: The 2010 Pavement Overlay Project is part of the City's ongoing Pavement Management Program. This rehabilitation project will resurface portions of Alga Road, Melrose Drive, El Fuerte Street, and Alicante Road by applying a rubberized asphalt concrete layer over the existing pavement. The streets were selected based on their age and the existing condition of the pavement surface. On September 8, 2010, fifteen (15) sealed bids were received for the construction of this project as shown on the following table. Staff has completed its review of the contract documents and has determined that they are in order. Staff recommends that ATP General Engineering Contractors be awarded the contract. ENVIRONMENTAL IMPACT: The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(c) - minor alteration of existing facilities including streets, sidewalks, gutters, and similar facilities involving negligible or no expansion. Remaining Pavement Management Program funds will be used on future pavement rehabilitation and resurfacing projects. CARLSBAD UTILITIES DEPT. 6/29/10 C:\TRANSPOKTATION DEPARTUENT\OESIGN DMSION\SCHAUBLE\6001-10FED OVERLAY\6001-10FED LOCATION UAP.DWG 1 RESOLUTION NO. 2010-228 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY 3 OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING THE CONTRACT TO ATP GENERAL 4 ENGINEERING CONTRACTORS FOR THE CONSTRUCTION OF THE 2010 PAVEMENT OVERLAY PROJECT NO. 6001- 5 10-OL2. 6 WHEREAS, the City Council of Carlsbad, California has determined that it is necessary, 7 desirable, and in the public's best interest to construct the 2010 Pavement Overlay Project No. 8 6001-10-OL2; and 9 WHEREAS, on July 13, 2010, the City Council of the City of Carlsbad approved plans for the construction of the 2010 Pavement Overlay Project No. 6001-10-OL2; and WHEREAS, fifteen (15) sealed bids were received on September 8, 2010 by the City of 11 Carlsbad for the construction of the 2010 Pavement Overlay Project No. 6001-10-OL2; and 12 WHEREAS, the lowest responsive and responsible bid to construct said project was 13 submitted by ATP General Engineering Contractors in the amount of $1,012,092; and 14 WHEREAS, this project requires the payment of prevailing wages; and ^ WHEREAS, there are sufficient funds available in the Pavement Management Program 16 to complete the project; and 17 WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the 18 City Manager to approve change orders in the amount equal to the contingency set at the time of 19 project award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 22 2. That the low bid of $1,012,092 submitted by ATP General Engineering 23 Contractors for the construction of the 2010 Pavement Overlay Project No. 6001-10-OL2 is 24 accepted and the Mayor is hereby authorized to execute a contract for this project. pc 3. That the City Manager is hereby authorized to approve construction change 26 orders up to $101,209. 27 28 1 4. That the award of this contract is contingent upon the bidder submitting the 2 lowest responsible bid executing the required contract and submitting the required bonds and 3 insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
