RECOMMENDED ACTION:
Adopt Ordinance No. CS-108. amending Title 10, Chapter 10.44 of the Carlsbad Municipal
Code, by the amendment of Section 10.44.520 to increase the prima facie speed limit on
Batiquitos Drive, from Poinsettia Lane to Golden Star Lane, to 45 miles per hour, and to
increase the prima facie speed limit on Batiquitos Drive, from Golden Star Lane to Aviara
Parkway, to 40 miles per hour.
ITEM EXPLANATION:
Ordinance No. CS-108 was introduced and first read at the City Council meeting held on
September 14, 2010. The second reading allows the City Council to adopt the ordinance
which will become effective thirty days after adoption. The City Clerk will have the ordinance
published within fifteen days, if adopted.
FISCAL IMPACT:
See AB #20,354 on file in the Office of the City Clerk.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code section 21065 and CEQA Guidelines section 15738, this
action does not constitute a "project" within the meaning of CEQA and therefore, does not
require additional environmental review.

ORDINANCE NO. cs-108
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
SECTION 10.44.520 OF THE CARLSBAD MUNICIPAL CODE BY
INCREASING THE PRIMA FACIE SPEED LIMIT TO 45 MILE PER
HOUR UPON BATIQUITOS DRIVE FROM POINSETTIA LANE TO
GOLDEN STAR LANE AND TO 40 MILE PER HOUR UPON
BATIQUITOS DRIVE FROM GOLDEN STAR LANE TO AVIARA
PARKWAY.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code
by the revision of Section 10.44.520 to read as follows:
"10.44.520 Batiquitos Drive:
a. Upon Batitquitos Drive from Aviara Parkway to its intersection
with Golden Star Lane, the prima facie speed limit shall be
forty miles per hour.
b. Upon Batiquitos Drive from Kestrel Drive to its intersection
with Golden Star Lane, the prima facie speed limit shall be
forty-five miles per hour.
c. Upon Batiquitos Drive from Poinsettia Lane to its intersection
with Kestrel Drive, the prima facie speed limit shall be forty-
five miles per hour.
d. Upon Batiquitos Drive from Poinsettia Lane to its intersection
with Camino del las Ondas, the prima facie speed limit shall
be thirty miles per hour."

EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption; and
the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in
a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.

INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on
the 14th day of September 2010, and thereafter.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 28th day of September 2010 by the following vote to wit:
AYES: Council Members Lewis, Hall, Packard and Blackburn.
NOES: None.
ABSENT: Council Member Kulchin.
ABSTAIN: None.
