DEPT. 20.387 11/09/10 TRANS AUTHORIZE THE MAYOR TO EXECUTE COOPERATE WORK AGREEMENT FOR THE COASTAL RAIL TRAIL PROJECT NO. 3455 DEPT. DIRECT CITY ATTORNEY CITY MANAGER (V RECOMMENDED ACTION: Adopt Resolution No. 2010-248 authorizing the Mayor to execute the Cooperate Work Agreement (CWA) extension for the Coastal Rail Trail, Project No. 3455. ITEM EXPLANATION: The Coastal Rail Trail is a multi-modal trail extending from the San Luis Rey River in Oceanside to the Santa Fe Depot in San Diego. The trail is located within the railroad right-of-way and on city streets. North County Transit District (NCTD) owns the railroad right-of-way in Carlsbad. On January 25, 2000, the City Council authorized the application for federal Intermodal Surface Transportation Efficiency Act (ISTEA) TEA-21 funding for the Coastal Rail Trail project. A Program Supplement was approved in 2001. These funds will expire on June 30, 2011. Staff has requested a one-year extension for these funds. The CWA extension request requires approval of the City Council. FISCAL IMPACT: The funds have a "use-it-or-lose-it" policy. There is no guarantee the state will authorize the extension; submitting the form will initiate the process. The City risks losing all or a portion of the $397,479 if the form is not submitted. ENVIRONMENTAL IMPACT: On April 17, 2001, City Council adopted the Mitigated Negative Declaration for the project (EIA 00-06) as Resolution Number 2001-122. The Mitigated Negative Declaration was prepared in accordance with California Environmental Quality Act (CEQA) guidelines and it covers the project from the San Luis Rey River in Oceanside to the southern boundary of Del Mar. The City of San Diego chose not to be a part of the Mitigated Negative Declaration. As a result of the federal funding for the project, a National Environmental Protection Act (NEPA) federal environmental document is needed. CALTRANS prepared and processed the Categorical Exclusion in conformance with NEPA guidelines. The Federal Highway Administration approved the Categorical Exclusion on August 1, 2001. That the above recitations are true and correct. 20 2. City Clerk Deputy Clerk Book «X The Coastal Rail Trail is a multi-modal trail envisioned to extend from the San Luis Rey River in Oceanside to the Santa Fe Depot in San Diego. Within the City of Carlsbad the trail was divided into six reaches as shown on the attached exhibit. The current status of each reach is briefly outlined below. Reach 1 (Northerly City limit to Oak Ave.): Construction drawings and contract specifications are currently being prepared. It is anticipate the drawings and contract documents will be complete in January 2011. The current construction cost estimate for this reach of the trail is approximately $860,000. The City is in the process of requesting an extension of previously allocated construction funding in the amount of $397,479 and anticipates requesting additional funds in January 2011 in order to bid and construct reach one beginning summer 2011. Reach 2 (Oak Ave. to Tamarack Ave.): Construction of Reach 2 is complete. 0.7 miles of Class I trail was constructed within railroad right of way between Oak Avenue and Tamarack Ave. Reach 3 (Tamarack Ave. to Cannon Rd.): Reach 3 is in the early stages of preliminary engineering/design. Staff is in the early stages of reviewing conceptual alignments through various properties and meeting with potentially impacted property owners (NRG, SDG&E, West Development, Caltrans, etc.) along these alignments. Reach 4 and Reach 5 (Cannon Rd. to Poinsettia Coaster Station): Reach 4 and 5 are in the preliminary engineering/design stage. Staff is working with Caltrans, NCTD and other stakeholders to identify a preferred alignment and finalize preliminary plans. Staff anticipates a final alignment for these reaches will be determined during the first quarter of 2011. Once an alignment is chosen staff will proceed with generating construction drawings and contract specifications. Because impacts to existing vegetation vary between the alternatives, timing for construction of the project will depend greatly on which alternative is chosen.
