ITEM EXPLANATION: Project Application(s) GPA 09-06 ZC 09-07 LCPA 09-06 SP 181 (G) SP 199(B) CT 09-03 Administrative Approvals Planning Commission RA RA RA RA RA x ,, City Council X X •/ X X RA = Recommended Approval * = Final City decision-making authority •/ = requires Coastal Commission approval On September 15, 2010 the Planning Commission conducted a public hearing and recommended to the City Council approval (5-0-2 (Montgomery and Dominguez absent)) of a General Plan Amendment, Zone Change, Local Coastal Program Amendment, and Specific Plan Amendments and approved a Tentative Tract Map to subdivide 504.7 acres into six golf course lots, three future development lots, one future park lot, and one remainder parcel on property generally located north of Palomar Airport, east and west of College Boulevard, and south of Faraday Avenue within the boundaries of the City of Carlsbad Municipal Golf Course in Local Facilities Management Zones 5 and 8. The land use change, zone change, and Specific Plan amendments included in this agenda bill require City Council approval and are necessary to clearly define the golf course use on the City's official land use maps and to create and zone the three non-golf course City-owned lots to a compatible Planned Industrial/Office use that is similar to surrounding Planned Industrial uses. The project consists of the subdivision of the property into ten lots and one remainder parcel, removal of property developed as the Carlsbad Municipal Golf Course from the Carlsbad Airport Centre Specific Plan SP 181; repeal of the College Business Park Specific Plan SP 199; amendment of the General Plan Land Use map to designate seven of the lots as Open Space, 3 of the lots as Planned Industrial/Office, DEPARTMENT CONTACT: Christer Westman 760-602-4614 christer.westman@carlsbadca.gov FOR CITY CLERKS USE ONLY. The California Coastal Commission is the final approving body for the Local Coastal Program amendment. The Planning Commission discussed the project. There were no comments provided by the public. A full disclosure of the Planning Commission's actions and a complete description and staff analysis of the proposed project is included in the attached minutes and Planning Commission staff report. The Planning Commission and staff are recommending approval of the proposed legislative actions. FISCAL IMPACT: There are no direct fiscal impacts to the City associated with this project approval. Indirect financial benefit may occur once the Tentative Map is recorded as a final map since three of the ten lots are vacant, industrial/office zoned, graded and suitable for future development with uses allowed by the Planned Industrial and Office zones and could be sold. No improvements are required by this approval and therefore no development costs are incurred. ENVIRONMENTAL IMPACT: The proposed project falls within the scope of a previously certified Environmental Impact Report reviewed pursuant to the California Environmental Quality Act (CEQA). Staff has analyzed the project and has concluded that no potentially significant impacts would result with the implementation of the project that were not previously examined and evaluated in the Carlsbad Municipal Golf Course Environmental Impact Report (EIR 97-01), dated January, 2000. EIR 97-01 evaluated the potential environmental effects of development within the golf course site along with the creation of three development pads including analysis of traffic circulation, water resources, cultural resources, biological resources, and land use. The Planning Commission certified EIR 97-01 on June 7, 2000. At that time CEQA Findings of Fact, a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program were approved. The EIR 97-01 "Findings of Fact and Statement of Overriding Considerations" applies to the entire project's proposed actions. The proposed activities would have no effects beyond those analyzed in the EIR, since the project is the subdivision of the existing golf course development and no improvements or development is proposed. This project is within the scope of Certified EIR 97-01 and no further CEQA compliance is required for this project. EIR 97-01 is available at the Planning Department. EXHIBITS: 1. B) That based on the evidence presented at the public hearing, the Commission 9 RECOMMENDS APPROVAL of CARLSBAD MUNICIPAL GOLF COURSE MAPPING GPA 09-06, based on the following findings and 10 conditions: Findings: 12 The Planning Commission finds that the project, as conditioned herein, is in 13 conformance with the Elements of the City's General Plan based on the facts set forth in the staff report dated September 15, 2010 including, but not limited to the following: 14 That the Carlsbad Crossings Municipal Golf Course is consistent with the Open Space and Conservation Element of the General Plan since golf courses are Category 3: Outdoor Recreation Open Space and the net increase in General Plan < x- Open Space will be 186.53, a golf course development is a recreational use encouraged for the Open Space Land Use designation. The PI/O designation will 17 provide opportunities for a wider variety of industrial and office uses for the three lots not included in the golf course and are compatible with surrounding OS uses. 18 2. The Planning Director has determined that: 2Q a. the project is a(n) subsequent activity of a project for which an EIR was prepared (City of Carlsbad Municipal Golf Course EIR 97-01), and a notice for the activity has 21 been given, which includes statements that this activity is within the scope of the EIR approved earlier, and that the EIR adequately describes the activity for the purposes 22 of CEQA) [15168(c)(2) and (e)] and 23 b. this project is consistent with the project cited above; 24 c. EIR 97-01 was certified in connection with the prior project; 25 d. the project considered the change of Zoning and General Plan Land Use and has no new significant environmental effect not analyzed as significant in the prior EIR 97- 27 28 e. none of the circumstances requiring a Subsequent EIR or a Supplemental EIR under CEQA Guidelines Sections 15162 or 15163 exist. PCRESONO. 6715 -2- 3. That the proposed open space area: a. Is 186.53 acres of General Plan Open Space greater than the area depicted on the Official Open Space and Conservation Map; and 4 b. Is of environmental quality equal to or greater than that depicted on the Official Open Space and Conservation Map in that the project adds 186.53 acres of open space that has varying quality from the preservation of natural resources to outdoor recreation; 6 and 7 c. Is contiguous or within close proximity to open space as shown on the Official Open Space and Conservation Map.8 o 4. The project application was deemed complete in September 2009 and is therefore subject to the adopted Airport Land Use Compatibility Plan for the McClellan- 10 Palomar Airport (ALUCP), dated October 2004. The project is consistent with the ALUCP. Golf courses are low density developments and are not adversely impacted by the noise generated by an airport. The proposed project land use changes, which designate three parcels as Planned Industrial/Office, are also compatible in that the parcels fall within the less than 70 db CNEL noise contours; a portion of Lot 4 falls 13 within the flight activity zone (FAZ), however, no development is proposed at this time; future development of the Planned Industrial/Office lots will be subject to 14 separate discretionary action. 5. INTRODUCTION A. PURPOSE The Specific Plan has been prepared to provide for the design, development and operation of an industrial complex within the City of Carlsbad. The development regulations therein will insure conformity to community goals and values and the protection of adjacent land uses from unfavorable impacts. As a device to carry out the goals and policies of the General Plan, this Specific Plan establishes standards for development and does not provide a guarantee of approval for future discretionary acts or projects within its boundaries. This industrial complex shall be known as Carlsbad Airport Centre. This Specific Plan is adopted pursuant to the provisions of California Government Code Sections 65450 et seq. and the Land Use Element of the City of Carlsbad General Plan. The area covered by this plan is included within the Palomar Airport Special Treatment Area specified in the General Plan and, therefore, this plan is also prepared according to the special treatment area requirements established by the City's General Plan. A specific plan is required for this project because of the particular requirements of the special treatment area. This Specific Plan establishes detailed regulations, conditions and programs for development within the area specified herein. B. LOCATION The Carlsbad Airport Centre contained 333 acnes of land when first approved, but was reduced in size by 118 acres when Phase Three was removed from the Specific Plan area per SP 181(G) and is located on the north side of Palomar Airport Road, south and west of Palomar Airport in an unincorporated County island, but is within the City's sphere of influence and will be annexed to the City. See Figure 1 for general site location and Figure 2 for the project location. C. GENERAL PLAN AND ZONING DESIGNATIONS This site is designated in the Land Use Element of the City's General Plan as Planned Industrial (PI) with the underlying zone to be designated as Planned Industrial (PM). GENERAL DEVELOPMENT CONCEPT This project is a planned industrial development which will consist of several different uses such as industrial, research and development, and office and related commercial. An organized and pleasant setting will be provided for the various industrial development sites. A full range of commercial and industrial support facilities will be included to service the project. The location of various land uses is designated on the Land Use Plan (Figure 7). All development shall conform to the Land Use Plan. The building sites and parking lots will be extensively landscaped along with special landscape treatments on designated streets. The establishment of setback requirements and sign controls will help to provide an aesthetically sensitive environment. Pedestrian and bicycle access will be provided throughout the development. Private recreational facilities will be recommended for the benefit of the employees of individual industrial users. Areas where heavy concentration of oak trees exist will be preserved where possible as natural open space. The SDG&E easements that cross the property will be utilized for parking, other nonbuilding uses and access to the existing pole and tower structures, which will be maintained and enhanced. B. For a cumulative period of more than 30 minutes in any hour; or b. Plus 5 decibels for a cumulative period of more than 15 minutes in any hour; or c. Plus 10 decibels for a cumulative period of more than 5 minutes in any hour; or d. Plus 15 decibels for a cumulative period of more than 1 minute in any hour; or e. Plus 20 decibels for any period of time; 2. Vibration, heat, glare, or electrical disturbances beyond the boundaries of the site; 3. Air pollution detectable by the human senses without the aid of instruments, beyond the boundaries of the site; 4. Emissions which endanger human health which can cause damage to animals, vegetation or property, or which can cause spilling at any point beyond the boundaries of the site; 5. Odor detectable by the human senses without aid of instruments beyond the boundaries of the site. All wastes discharged into the wastewater discharge system will meet City standards. All uses shall conform to the general development concepts for a high-quality business park, with all standards and restrictions established by this plan and with CC&Rs. Specifically, the following uses are permitted in Area 1: 1. Uses primarily engaged in research activities, including research manufacturing such as, but not limited to, the following: a. Biochemical; SP181G b. Chemical; c. Electronics; d. Film and photography; e. Medical and dental; f. Metallurgy; g. Pharmaceutical; h. X-ray. 2. Manufacture, research assembly, testing and repair of components, devices, equipment and systems, and parts and components of the following: a. Coils, tubes, semi-conductors; b. Communication, navigation, guidance and control equipment; c. Data processing equipment, including computer software; d. Glass edging and silvering equipment; e. Graphics and art equipment; f. Metering equipment; g. Radio and television equipment; h. Photographic equipment; i. Radar, infrared and ultraviolet equipment; j. Optical devices and equipment; k. Filling and labeling machinery. 3. Light manufacturing, processing, and/or assembly of the following or similar products: a. Food products; b. Apparel and finish products from textile products; c. Lumber and wood products; d. Furniture and fixture products; e. Chemical and allied products; f. Plastic and rubber products; g. Stone, clay, and glass products; h. Fabricated metal products; i. Professional, scientific, controlling, photographic, and optical products or equipment. 10 SP 181G 4. Service industries or those industries providing a service as opposed to the manufacture of a specific product, such as the repair and maintenance of appliances or component parts, tooling, printers, testing shops, small machine shops, shops engaged in the repair, maintenance and servicing of such items, excluding automobile and truck repair, and excluding equipment rental yards. 5. Industries engaged in the distribution and/or storage or warehousing of products similar to those listed in other permitted uses in this group. 6. Construction industries such as general contractors, electrical contractors, plumbing contractors, etc., and their accessory and incidental office uses. 7. Blueprinting, photostatting, photo-engraving, printing, publishing, and bookbinding. 8. Administrative and professional offices, limited to a) offices which are associated with any permitted industrial use or b) offices which do not attract nor are primarily dependent upon business customers visiting the office. Permitted offices include, but are not limited to, corporate offices, regional offices, general offices, and such professional offices as accountants, attorneys, engineers, architects, and planners. Prohibited offices include, but are not limited to, banks and financial institutions, medical and dental offices, employment agencies, real estate agencies, and travel agencies. 9. Employee cafeteria, cafe, restaurant, or auditorium accessory with and incidental to a permitted use. (intended primarily for the express use of those persons employed at the firm or use where such incidental use is applied). 10. Accessory uses and structures when related and incidental to a permitted use such as, but not limited to, food preparation, food service, and eating facilities. 11. Education Facilities, Other as defined in Section 21.04.137 of the Zoning Ordinance subject to a Minor Conditional Use Permit and where the facility is for adult students (18 years and older) exclusively, and is located entirely outside of the Flight Activity Zone and entirely outside of the 65 dB CNEL noise contour (as shown in the Comprehensive Land Use Plan for the McClellan- Palomar Airport, dated October 2004), or where the use is located partially or entirely between the 60 dB CNEL and the 65 dB CNEL noise contours if interior noise levels are attenuated to 45 dB CNEL (as verified through a site specific acoustical study). 11 . SP 181G B. AREA 2 Area 2 is designated for industrial support uses, business and professional uses, and certain retail uses supporting the business park. The commercial areas in Area 2 require a conditional use permit for each use pursuant to Chapter 21.42 of the Carlsbad Municipal Code. Permitted uses in Area 2 are: 1. Retail businesses (oriented to needs of complex employees); 2. Service businesses (oriented to needs of complex employees and businesses); 3. Personal service businesses; 4. Financial service businesses; Amended March 6 2001 5. Blueprinting, photostatting, photo-engraving, printing, publishing, and bookkeeping; 6. Administrative, professional, and business offices; 7. Health or athletic club facilities; 8. Service stations; 9. Hotels, motels, and theaters; 10. Restaurants may be permitted anywhere in the Airport Business Center with a conditional use permit subject to the provisions of Section 21.42 of the Carlsbad Municipal Code. At a minimum, this conditional use permit shall address adequate parking, distance between restaurants, compatibility with surrounding uses, and hours of operation. C. GENERAL DEVELOPMENT STANDARDS This section provides standards which will allow unique site planning and building design on individual parcels while maintaining regulations assuring the development of an industrial center of excellent quality. Various setbacks, building separations, building heights, and architectural styles will be allowed as a result of the mixed land uses and prevailing topography, although visual continuity will be provided by unified landscaping along the special landscaped streets. A. BUILDING SETBACKS For the purpose of this ordinance, setbacks are defined as that minimum distance from the ultimate right-of-way line of the frontage street. Special landscaped streets are as follows: 6€>tte§e Boulevard, Camino Vida Roble, and "D" Street (Palomar Oaks Way). 1. Streetside Setback. No structure shall be located within 30 feet of any street right-of-way line, except that unsupported roofs or sun screens may project 6 feet into the setback area. The following improvements are specifically permitted in the streetside setback: a. Walks; b. Paving and associated curbing, except that vehicle parking areas shall not be permitted within 30 feet of the streetside right-of-way lines of special landscaped streets or within 10 feet of the streetside right-of- way line of other streets. In either case, any parking overhang is prohibited; c. Landscaping; d. Planters, architectural fences, or walls not to exceed 3 feet in height; In the case of through lots extending from street to street, both street frontages shall be treated as a streetside setback. 2. Interior Setback. No structure shall be located within 10 feet of any interior lot line. 3. Rear Setback. No structure shall be located within 25 feet of a rear lot line. Parking areas shall maintain a ten-foot setback from rear lot lines with no parking overhang permitted. 4. Figures 3 through 6 represent graphic examples of how setbacks on special streets and interior streets should be treated. Treatment is not limited to the method depicted in this graphic, however. 18 SP 181G B. SITE COVERAGE Maximum building coverage, including accessory building structures and excluding open parking areas, shall not exceed 50 percent of the gross lot area. C. BUILDING HEIGHT The maximum height of all structures shall be determined by the underlying zone. D. PARKING No on-street parking will be allowed. The Parking requirements for all uses shall comply with Chapter 21.44 of the Carlsbad Municipal Code. E. LANDSCAPING The following standards shall apply to all landscaping within the development. "Special Landscaped Streets" have been designated on the Land Use Plan (see Figure 7). Special consideration will be given to the landscaping along these streets and is referred to under separate sections of the following standards. All landscaping must comply with the City of Carlsbad Landscape Guidelines Manual. 1. General Requirement a. All landscaping pursuant to this section shall be installed by the developer and maintained through the business park association or, if approved by City Council, a maintenance district. b. A minimum of 15 percent of each building site area shall be reserved for irrigated landscaping which shall be maintained in a neat and orderly manner. The configuration of the required landscaping may be creatively distributed but shall, at a minimum, include the following areas: 1) Streetside Setback Areas a) General Statement: An effective combination of street trees, trees, ground cover, and shrubbery shall be provided. b) Special Landscaped Street (College Boulevard Camino Vida Roble and "D" Street (Palomar Oaks Way)): except for approved driveway and sidewalk locations, the entire area between the curb and the building setback line shall be landscaped (Figures 3 and 4). Amended March 6, 2001 19 SP181G c) Interior Streets: Except for approved driveway and sidewalk locations, the entire area from the curb to a point 10 feet beyond the right-of-way line shall be landscaped (Figures 5 and 6). d) Berms: The landscaping in all streetside setbacks shall include berms as noted below. The average height of berms shall be 42 inches for special landscape streets and 30 inches for all other streets. The height of the berm shall be measured from the street curb or parking lot curb, whichever is higher. When the parking area is more than 36 inches below street level, the berm may be 18 inches. Berms are not required where the entire area between the street and building is to be landscaped and free of parking. e) Intersections: Landscaping and berms, not including trees, along all streets shall be limited to a height of 2.5 feet within the triangle formed by a line extended between points 35 feet distant from the intersection of the right-of-way lines prolonged. f) All landscaping planted within the confines of San Diego Gas & Electric easements shall conform to the standards applied to those easements. g) All screening trees shall be evergreen varieties. 2. Palomar Airport Road. A special landscape corridor along Palomar Airport Road, with a minimum width of 50 feet from right-of-way, shall be established and maintained by the developers' or homeowners' association. The landscaping shall consist of a combination of trees and shrubs and ground cover that is consistent with the general theme along Palomar Airport Road. 3. Interior Setback. a) General Statement: All designated undeveloped areas such as setbacks and areas not used for parking or 20 SP 181G storage shall be landscaped with ground cover, shrub, and tree materials. b) Undeveloped Areas: Undeveloped areas or unpaved areas proposed for future expansion shall be maintained by developer/owner/lessee in a weed-free condition, but need not be landscaped. c) Screening: Areas used for parking • shall be landscaped in such a manner as to interrupt or screen said areas from view from access streets and adjacent properties. Plant materials used for this purpose shall consist of lineal or grouped masses of shrubs and/or trees. 4. Parking Areas. Trees, equal in number to one per five parking stalls shall be provided in the parking area. The trees may be distributed evenly throughout the area or may be grouped or clustered in order to create a random pattern. Canopy trees shall be used in parking areas. 5. Slope Banks. All slope banks greater than 5:1 or 6 feet in vertical height and adjacent to a public right-of-way shall be stabilized, planted with a combination of trees, shrubs, and ground cover, and irrigated as required by the City Engineer. 6. Entrywavs. Special landscape and sign treatment shall be applied to all entry ways into the business center at Cotioga Be4^e¥af4^beth==eflete}? Distinctive landscape design consisting of ground cover and hedgerows combined with contour beriming shall be included. Entryways shall be limited to ground signs which contain the name of the business center only and which conform to the sign and graphic standards of this plan. Entryway plans shall be submitted to the Planning Director for approval prior to issuance of sign permits. Entryway signs shall be limited to 25 feet in length and 6 feet in height. 21 SP181G 7. A detailed landscape and irrigation plan for all special landscaped streets, mini-parks and common areas, shall be submitted to and approved by the Planning Director prior to approval of the final map for each phase. 8. Mini-Park Development. Four mini-parks, located as shown on the tentative map and Figure 7 of this Specific Plan, shall be constructed to provide passive rest and picnic areas for employees and visitors of Airport Business Center. Each park shall be developed according to the requirements of the City's Parks and Recreation Director. Prior to development of any phase, plans for construction of all parks within that phase shall be submitted to the Parks and Recreation Director for approval. The mini-parks shall be maintained by the property owners through a property owner's association according to standards established by the Parks and Recreation Director. Each mini- park will incorporate berms, landscaping and furniture (to include picnic benches, tables and trash receptacles). F. SIGN AND GRAPHIC REQUIREMENTS All signs within the Carlsbad Airport Centre Specific Plan shall comply with Chapter 21.41 of the Carlsbad Municipal Code. G. LOADING AREAS 1. On special landscape streets, no loading shall be allowed which is visible from adjacent streets. 2. On other than special landscaped streets, streetside loading shall be allowed provided the loading dock is set back a minimum of 70 feet from the street right-of-way line. All loading areas must be screened from adjacent streets. H. STORAGE AREAS 1. All outdoor storage shall be visually screened from adjacent streets and property. Said screening shall consist of a solid concrete or masonry (or other durable material approved by the Planning Director) wall not less than six feet in height. Outdoor storage shall include the parking of all company-owned or - operated motor vehicles, with the exception of regular passenger vehicles (automobiles). Amended March 6, 2001 22 Ccl SP 181G 2. No storage shall be permitted between streetside and the building line. I. METAL STRUCTURES No metal structures with metal siding or sheeting exterior shall be permitted. J. REFUSE COLLECTION AREAS 1. All outdoor refuse collection areas shall be completely enclosed and screened from access streets and adjacent property by a block wall, six feet in height, approved by the Planning Director. All such areas shall have concrete floors, and shall be of sufficient size to contain all refuse generated by the business. These areas shall be no less than six by eight feet in size. 2. No refuse collection areas shall be permitted between streetside and the building line. K. TELEPHONE AND ELECTRICAL SERVICE All "on-site" electrical lines (excluding transmission lines) and telephone lines shall be placed underground. Transformer or terminal equipment shall be visually screened from view from streets and adjacent properties. L. NUISANCES No portion of the property shall be used in violation of the performance' standards of this plan or in such a manner as to create a public or private nuisance. M. SCREENING OF EQUIPMENT Exterior components of plumbing, processing, heating, cooling and ventilating systems (including but not limited to piping, tanks, stacks, collectors, heating, cooling, and ventilating equipment fans, blowers, duct work, vents, louvers, meters, compressors, motors, incinerators, ovens, etc.) shall not be directly visible to surrounding areas to the satisfaction of the Planning Director. N. SAN DIEGO GAS & ELECTRIC EASEMENTS Should San Diego Gas & Electric Company utilize their easement rights to underground utilities or in any other way disturb parking areas, access ways, or other approved portions of the site, the developer shall be responsible for restoring such parking areas or access ways to their required condition. ARCHITECTURAL GUIDELINES Projects within this specific planned area shall incorporate a variety of methods to improve visual impacts. Such methods may include the following: 1) Variety of roof and wall materials and colors 2) Variety of building architectural accent features 3) Varied building roof heights and roof overhangs 4) Varied building street setbacks beyond the minimum requirements 5) Enhanced fenestration 6) Varied building exterior accent colors 7) Enhanced architectural and landscaped entry treatments 8) Varied front yard landscaping treatments within an overall unifying theme 9) Articulated building forms Roof planes Wall planes Inset/offset windows/doors 10) Installation of large specimen-size trees or groupings of smaller trees in front setback Q. EMPLOYEE EATING AREAS Employee eating areas shall be provided in accordance with the Carlsbad Development Code and all City policies. 24 SP 181G V. GENERAL NOTES AND MITIGATION MEASURES The following general notes and mitigation measures shall control the overall development of Carlsbad Airport Centre. The developer shall be responsible for implementing the mitigation measures which are based on the EIR for the project. A. GENERAL 1. Except as specified in this plan, the requirements of the PM zone and all other applicable provisions for the zoning, subdivision, grading and building codes (and any amendments thereto) of the City of Carlsbad shall apply. 2. Where minor questions arise regarding interpretation of this Specific Plan, the Planning Director shall resolve them in a manner consistent with the Municipal Code, adopted City plans, and City policy. Such decisions by the Planning Director may be appealed to the Planning Commission and City Council. 3. The developer or association shall be responsible for maintaining all natural canyon areas, all fill and cut slopes adjacent to public streets, and all special landscape areas as outlined in this text. B. MITIGATION MEASURES 1. Grading/Foundation Design a. The conclusions and recommendations of the final geotechnical study required by the Subdivision Map Act shall be incorporated into this project. b. The ultimate engineering design of the project will incorporate the specific recommendations of the geology consultant relative to design criteria and foundation development. c. Clearing of ground cover in advance of actual grading operations will be avoided. d. All graded or fill slopes shall be revegetated immediately after grading. e. A soils engineer shall review the final grading plans and be present during grading operations on the site. 25 SP181G 2. Drainage/Erosion Control/Water Quality a. A master plan of drainage for the site shall be prepared and submitted to the City Engineer for approval in conjunction with the first tentative tract map. Such plan shall be consistent with the Master Drainage Plan of the City as adopted by the City Council. The developer shall be responsible for construction of any drainage facility required as part of tentative map approval. b. A plan for siltation control for all storm runoff from the property during construction and initial operation of the tract, and the maintenance of silt control facilities during normal operation, shall be prepared by the developer and submitted to the City Engineer for approval prior to recording the final map for each element of the development. c. Drainage and siltation control facilities shall be constructed by the developer prior to or concurrently with grading operations. d. Ground cover suitable for slope erosion control will be planted and maintained by the developer immediately following grading. e. A regular street-cleaning program will be implemented by the developer or the property owner's association to minimize pollutant runoff from internal private roadways and parking areas related to the project. f. On-site retention basins as shown on Figure 7 shall be constructed and operational prior to any grading on the site. 3. Biological Resources The developer will protect approximately two acres of the depleted riparian oak woodland habitat located in the southeast part of the property. This habitat will be incorporated into a larger five-acre open space area. Also, erosion of soils will be controlled during and subsequent to grading operations to minimize sedimentation to downstream habitats. 4. Archaeological Resources The proposed project could have significant impacts on a number of archaeological sites on the subject property. Strategy for mitigating significant impacts to a level of insignificance consists of a well-conceived, thoroughly planned, and carefully controlled two-phase testing and salvage program. 26 SP 181G Significant impacts to some cultural sites might be mitigable in the first of two phases. Phase I procedures would include mapping, posthole excavation, surface collection, and at most sites the excavation of sampling units. Phase II procedures consist primarily of more extensive subsurface excavation according to a research design planned to accurately identify and evaluate archaeological resources. A second phase of unit sampling is specifically recommended for sites SDM- W-123 and SDM-W-128, while sites SDM-W-2493 and SDM-W-2404 may also require a two-phase approach. A second phase might also be necessary at any of the other sites, pending results of first- phase analysis, but this is considered unlikely for SDM-W-2400, SDM-W-2401, SDM-W-2404, and SDM-W-2405. Perhaps less likely, but also feasible, is that first-phase mitigation might be attainable at SDM-W-1983, SDM-W-1984, SDM-W-1985, and SDM-W-2408. It is noted that mitigation has already been achieved for SDM-W-2406, which was surface collected at the time of field survey. The City maintains the right to review any archaeological reports submitted as mitigation for this section, if the Planning Director determines that such work is inadequate, a consulting firm may be used by the City at the expense of the developer to review and correct these reports. 5. Paleontological Resources The greatest potential for paleontological resources are located in the Delmar Formation found along the southern boundaries of the property. Given this potential, a qualified paleontologist will be present at all pregrading meetings (required by the City's grading ordinance) to determine at what stages of grading and at what locations the paleontologist will be present during grading operations. Paleontological sites uncovered during grading operations and termed significant by the inspecting paleontologist will be left exposed until fossil collection and appropriate investigations are accomplished or until reasonable mitigation has taken place as determined by the Planning Director. 6. Circulation All recommendations included in the traffic study regarding intersection geometries and roadway assignments will be incorporated into the project as a requirement for development unless otherwise addressed. 7. Flight-Path Restricted Use Zone A restricted use zone, 500 feet wide (250 feet each side of the centerline of the Palomar Airport runway), is shown on the tentative map and Figure 7. The land use plan 27 SP181G will be applied to lots underlying this zone. The purpose of this restricted use zone is to reduce the number of people actively employed in the zone, lowering the potential impact of an airplane crash on the site. Within this zone, the following lot coverages for potential uses will be applied: a. Warehouses or similar uses-maximum 75% lot coverage b. Offices or similar uses-maximum 35% lot coverage These coverages shall apply to any lot which is impacted by this zone greater than 25% of the net pad area. No storage or manufacture of explosives or highly flammable materials will be allowed within this zone. The appropriateness of use allowed in this zone will be at the discretion of the Planning Director. The Planning Director shall determine if uses similar to warehouse type uses are appropriate for this area. All other standards outlined in this Specific Plan and the underlying zone shall apply to this area. 8. Noise The most significant source of noise at Airport Business Center will be from aircraft operations at or near Palomar Airport, with minor amounts of noise generated from vehicular traffic along College Boulevard, Palomar Airport Road and "D" street (Palomar Oaks Way). Noise impacts are especially severe (greater than 75 dBA CNEL) in the area just west of the runway. This area is shown as the Flight-Path Restricted Use Zone on Figure 7, the land use plan. Recommendations and noise standards below shall apply only to this area of the Specific Plan. a. Uses: Warehouses, parking areas and other low-intensity uses should be encouraged to develop in this area. Office type uses shall be permitted but should meet special construction standards to minimize noise. b. Internal Noise Standards: For warehouses and low-intensity, low- employee type uses, internal noise levels shall be reduced to 70 dBA CNEL from all sources. For offices, conference areas and classroom type uses where frequent communications occur, interior noise levels shall be reduced to less than or equal to 50 dBA CNEL from all sources. c. Construction Standards: For office and similar type uses, the following standards are recommended at a minimum for construction to reduce noise levels to the above standards: 1) Limit the number of wall openings (door and window) to a minimum amount. 28 SP181G 2) Minimize window surface area and locate windows in areas not exposed to noise source. 3) Use double-glazed glass. 4) Reduce the need for open windows by providing adequate mechanical ventilation. 5) Exterior door should be of solid-core construction. 6) Exterior wall coating should be of materials which partially absorb noise, thereby reducing reflected sound. 7) Sound buffering materials should be utilized for basic construction such as masonry with double-glazed windows. 9. Services and Utilities Development in the Specific Plan area will not be allowed until the City Council has determined that sewer service will be adequate to serve this site. The City of Carlsbad has approved in concept a Wastewater Reclamation Master Plan. Part of the plan will be implemented by the construction of a satellite treatment plant in conjunction with an adjacent development (Carlsbad Research Center) which will also provide service to the Carlsbad Airport Centre as well as the surrounding area. This project shall be approved under the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference and according to the agreement executed by the applicant for payment of said fee. A copy of that agreement, dated June 25, 1980, is on file with the City Clerk and is incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. 29 SP 181G VI. I.RECOMMENDATION That the Planning Commission make a determination that the project is within the scope of the previously certified City of Carlsbad Municipal Golf Course Program EIR (EIR 97-01) and ADOPT Planning Commission Resolutions No. 6715, 6716, 6717, and 6718 RECOMMENDING APPROVAL of General Plan Amendment GPA 09-06, Zone Change ZC 09-07, Local Coastal Program Amendment LCPA 09-06, Specific Plan Amendment SP 181(G), repeal of Specific Plan 199 (SP199(B)), and ADOPT Planning Commission Resolution No. 6719 APPROVING Tentative Tract Map CT 09-03 based on the findings and subject to the conditions contained therein. II. INTRODUCTION The project is atypical in that the underlying existing golf course use has been approved by Conditional Use Permit (CUP 97-07) and all of the improvements have been completed. The Crossings Golf Course has been in operation since 2006. Review and analysis of the map and land use changes is therefore not to determine if a golf course should be approved at this location or if the golf course and related uses are compatible with adjacent uses. Compatibility was established through the approval of the CUP and certification of the Carlsbad Municipal Golf Course EIR. The various applications associated with this project are follow-up actions GPA 09-06/ZC 09-07/LCPA 09-06/SP 181(G)/SP 199(B)/CT 09-03 - CARLSBAD MUNICIPAL GOLF COURSE MAPPING September 15, 2010 PAGE 2 necessary to clearly define the golf course use on the City's official land use maps and to create and zone the remainder non-golf course City owned lots to a compatible PI/0 use that is similar to other surrounding PI uses. The project consists of the subdivision of the property into ten lots, removal of property developed as the Carlsbad Municipal Golf Course from the Carlsbad Airport Centre Specific Plan SP 181; rescission of the College Business Park Specific Plan SP 199; amendment of the General Plan Land Use map to designate seven of the lots as Open Space, 3 of the lots as Planned Industrial/Office, and a remainder lot as Planned Industrial; amendment of the Zoning Map designating seven of the lots as Open Space, 3 of the lots as Planned Industrial/Office, and a remainder lot as Planned Industrial; and, amending the Land Use and Zoning maps of the Local Coastal Program designating seven of the lots as Open Space, 3 of the lots as Planned Industrial/Office, and a remainder lot as Planned Industrial. HI. PROJECT DESCRIPTION AND BACKGROUND Even though the property is improved as the Carlsbad Crossings Golf Course, there are two underlying recorded subdivisions. One was approved in August 1982 (Phase 3 of CT 81-46) and the other in November 1986 (CT 85-17). Together, 103 industrially zoned lots were created. Although they are recorded subdivisions, neither one has been built. The Carlsbad Municipal Golf Course was approved in June 2000. Since its approval by the City of Carlsbad, a Coastal Development Permit was issued for the golf course by the California Coastal Commission, all environmental permits issued, and ultimately the Carlsbad Crossings was constructed. Subdivision of the property into individual lots that are coordinated with the various elements of the golf course satisfies the implementation of the property financing, allows for the separation and possible sale of the three individual development lots and remainder lot that are not a part of the golf course itself, and also establishes clear separation of properties that are also being re- designated through these applications on the General Plan and Zoning maps as either Open Space or Planned Industrial/Office. Two of the three non-golf course lots are located on College Boulevard. One is on the north side of the street at the eastern edge of the golf course and the second is on the south of the street and is also at the eastern edge of the golf course. The third non-golf course lot is at the end of the Crossings Drive west of the golf course clubhouse adjacent to the water tower. The remainder lot is adjacent to the Callaway Golf testing facility. The two Specific Plan actions resolve conflicts created by the General Plan Amendment and Zone Change in that the project property will be either removed from reference in the Specific Plan or in the case of the College Business Park, it will be repealed altogether because the property will no longer be developed as an industrial park. ANALYSIS The proposed subdivision is subject to the following plans, ordinances, standards, and policies: A. Carlsbad General Plan Planned Industrial (PI) and Open Space (OS) Land Use designation regulations; B. Open Space (OS) and Planned Industrial (P-M) Zone (Chapters 21.33 and 21.34 of the Carlsbad Municipal Code); C. Carlsbad Airport Centre Specific Plan (SP 181); D. College Business Park Specific Plan (SP 199); E. . Subdivision Map Act and City of Carlsbad Subdivision regulations (Title 20 of the Carlsbad Municipal Code); F. Local Coastal Program; Mello II Segment; Coastal Resource Protection Overlay Zone; and G. Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code). The recommendation for approval of these project actions was developed by analyzing the project's consistency with the applicable regulations and policies. The project's compliance with each of the above regulations is discussed in the sections below. A. Carlsbad General Plan: Planned Industrial (PI), Office (O), and Open Space (OS) Land Use Designations The existing General Plan Land Use designations for the site are Planned Industrial (PI) and Open Space (OS). Currently, within the project area, there are 207.73 acres designated as PI and the remaining 296.97 acres are designated as Open Space. Both the PI and OS designations allow for the development of a golf course with the approval of a Conditional Use Permit. Conditional Use Permit CUP 97-07 was approved by the Planning Commission and is currently valid. The PI land use underlying the City of Carlsbad's municipal golf course does not accurately reflect the development of the golf course. Amending the land use designation will serve as clarification as to the current and future expected use of the property. In addition, and consistent with the regulations of the City's Habitat Management Plan, open space areas that are part of a Habitat Management Plan preserve are to be designated on the General Plan Land Use map and on the Zoning map as Open Space. The proposed land use change will significantly increase the amount of Open Space designation on the Official Open Space and Conservation Map and Land Use map. The Open Space being added to the map is of environmental quality equal to or greater than that depicted on the Official Open Space and Conservation Map since the map designation is being changed from developable areas to preservation areas. The preservation areas being added to the Official Open Space and Conservation Map are immediately adjacent to the City owned properties north and south of Faraday Avenue that are already designated as Open Space preserve. The proposed additions of Open Space and preserve areas to the General Plan Land Use map and Official Open Space and Conservation Map will not have an effect on the Habitat Management GPA 09-06/ZC 09-07/LCPA 09-06/SP 181(G)/SP 199(B)/CT 09-03 - CARLSBAD MUNICIPAL GOLF COURSE MAPPING September 15,2010 PAGE 4 Plan hardline preserve that has already been established over the golf course property. That hardline preserve was established and based upon physical habitat onsite and with no regard for General Plan Land Use designations. Therefore the project's proposed General Plan land use amendment will place all of the lots that constitute the golf course and future Veteran's Memorial Park into a permanent Open Space (OS) land use designation. This change will result in a net increase in General Plan Open Space of 186.53 acres. The type of Open Space varies from the preservation of natural resources to outdoor recreation. The three lots that are for future development are being re-designated from PI or OS to a combination of Planned Industrial and Office to allow for similarly compatible uses. According to the General Plan, development proposals on properties that are designated as a combination district must be processed by a Site Development Plan (SDP) if they are less than 25 acres in size. Properties that are 25 acres or more must be processed through the approval of a Specific Plan. The project complies with all elements of the General Plan as discussed in Table A below: TABLE A - GENERAL PLAN COMPLIANCE ELEMENT Land Use Public Safety Open Space & Conservation USE, CLASSIFICATION, GOAL, OBJECTIVE OR PROGRAM The Open Space Land Use designation has a variety of classifications. Among them are recreational uses. To provide industrial lands which can accommodate a wide range of industrial uses while minimizing impacts to surrounding land uses. Review new development proposals to consider emergency access, fire hydrant locations and fire flow requirements. Minimize environmental impacts to sensitive resources' within the City. PROPOSED USES & IMPROVEMENTS Golf Course development is a recreational use encouraged for the Open Space Land Use designation. The PI/O designation will provide opportunities for a wider variety of industrial and office uses and are compatible with surrounding OS uses. The project includes or has been conditioned to provide facilities to ensure that the development proposal complies with public safety requirements. The project includes the preservation of open space and the designation of the open space as Open Space (OS) on the General Plan land use map. Open Space (OS) and Planned Industrial (P-M) Zone (Chapters 21.33 and 21.34 of the Carlsbad Municipal Code) A total of 483.50 acres of the project site will be designated as Open Space since the majority of the site is the Carlsbad Crossings Golf Course and future Veterans' Memorial Park. The use of the property as golf course is consistent with the intent and purpose of the Open Space Zone in that this zone should provide for recreational uses, should contribute to the City's comprehensive Open Space system, and should protect areas set aside and preserved as biological resources. Three parcels (21.2 acres) are proposed to be designated as Planned Industrial (P-M)/Office (0). These three parcels are located along the periphery of the golf course. Two are located on College Boulevard (Lots 4 and 5 of CT 09-03) and the third off of The Crossings Drive (Lot 9 of CT 09-03). Future development of these lots is subject to the development standards of the Planned Industrial and/or Office zones (Chapters 21.34 and 21.27 respectively of the Carlsbad Municipal Code). The inclusion of Office as a zoning designation on these properties adds the opportunity to propose banks, educational facilities (other), medical office, and residential real estate offices which are otherwise not permitted uses in the Planned Industrial zone. C. Carlsbad Airport Centre: Specific Plan SP 181(G) Specific Plan 181 was approved as the Carlsbad Airport Centre Specific Plan in August 1982. In association with the creation of the Specific Plan was the subdivision of the 330 acre property into 77 industrial lots per Tentative Map CT 81-46. Since the approval of the Specific Plan and recordation of the Final Map in 1985, Areas One (27 lots) and Two (23 lots) have been improved with build-ready pads, buildings, and a network of public streets, curb, and sidewalk. Areas One and Two are generally located west of El Camino Real between McClellan-Palomar Airport and Palomar Airport Road. Exhibits in SP 181(G) illustrate the locations of Areas One, Two and Three. The Area Three property generally located north of Palomar Airport Road, west of McClellan Palomar Airport, and south of College Boulevard is 118 acres. Within Area 3 are 26 industrial lots, one Open Space lot, and one remainder parcel. All of the industrial lots and the remainder parcel have a General Plan Land Use designation of Planned Industrial (PI). All of the lots are zoned Planned Industrial (P-M) except the 20.27 acre Open Space lot which is zoned as Open Space (OS). Since the Area 3 property of the Carlsbad Airport Centre Specific Plan has been acquired by the City of Carlsbad and developed as part of the City of Carlsbad municipal golf course, there is no longer a need to keep the property in the specific plan and subject to its development standards and land use regulations. SP181 (G) removes all references to Area Three and/or Phase Three of Specific Plan 181 and will release the property from the applicable development standards. (See attached Exhibit SP 181(G)) Future development of lots 4 and 5 of the Golf Course map CT 09-03, which are within the boundaries of CT 81-46, will be subject to the development standards of the Planned Industrial and Office Zone. College Business Park: Specific Plan SP 199(B) Specific Plan 199 was approved as the College Business Park Specific Plan in November 1986 and is generally located north of Palomar Airport Road, east of The Crossings Drive, and west of College Boulevard. In association with the creation of the Specific Plan was the subdivision of the 110 acre property into 23 industrial lots and three detention basin lots per Tentative Map CT 85-17. The subdivision map was recorded as a final map in December 1991. Although the property was approved for subdivision and a Specific Plan was created to guide the development of the property, the property was never improved. All of the Specific Plan area has a General Plan Land Use designation of Planned Industrial (PI) and a zoning of Planned Industrial (P-M). Since all of the College Business Park Specific Plan has been acquired by the City of Carlsbad and developed as part of the City of Carlsbad municipal golf course, there is no longer a need to keep the property in the specific plan and subject to its development standards and land use regulations. Repealing SP199 will release the property from the applicable development standards. E. Subdivision Map Act and City of Carlsbad Subdivision regulations (Title 20 of the Carlsbad Municipal Code) The Subdivision Ordinance, Title 20 of the Municipal Code, requires the filing of a tentative tract map for the division of property into five or more lots. Tentative Tract Map CT 09-03 requests for the division of the property into six golf course lots, three future development lots, and one future park lot on 504.7 acres. Lot 1 (7.5 acres) is defined by the clubhouse and parking lot. Lot 2 (11.1 acres) is defined by the driving range. Lot 3 is a 1.7 acre maintenance yard. The 7.1 acre Lot 4 and 11.4 acre Lot 5 are intended for future development with Planned Industrial/Office uses. No development plans are on file at this time for either lot. Lots 6 and 7 constitute the majority of the golf course, are 268.7 acres together, and include all 18 holes. Lot 8 is a small 0.1 acre preservation property on the north side of Cannon Road. Lot 9 is another future development lot and is 2.7 acres. Lot 10 is defined by the boundaries of the future Veteran's Memorial Park and is 94.4 acres. As designed and conditioned, the Tentative Tract Map complies with all City requirements, including the Subdivision Ordinance and the State Subdivision Map Act. The project as conditioned provides all necessary improvements and all findings required by Title 20 can be made and are contained in the Planning Commission Resolution for CT 09-03. F. Local Coastal Program; Mello II Segment; Coastal Resource Protection Overlay Zone The City of Carlsbad municipal golf course was approved and developed per an approved Coastal Development Permit (A-6-CII-00-087) issued by the California Coastal Commission. This project does not include any further development or changes to the existing physical golf course development. The project does include the creation of lots that coincide with the various physical elements of the existing golf course. Subsequent to the City's action on the legislative GPA 09-06/ZC 09-07/LCPA 09-06/SP 181(G)/SP 199(B)/CT 09-03 - CARLSBAD MUNICIPAL GOLF COURSE MAPPING September 15,2010 PAGE 8 actions and the subdivision, an amendment to the golf course Coastal Development Permit will be submitted to the California Coastal Commission for review along with applications for California Coastal Commission review of the Local Coastal Program Amendments. The development is subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Carlsbad Municipal Code). The Coastal Resource Protection Overlay Zone identifies five areas of protection: a) preservation of steep slopes and vegetation; b) drainage, erosion, sedimentation, and habitat; c) landslides and slope instability; d) seismic hazards, and e) floodplain development. The project's compliance with each of these areas of concern is discussed below: a. Preservation of Steep Slopes and Vegetation. Natural slopes greater than 25% gradient and possessing endangered plant/animal species and/or coastal sage scrub and chaparral plant communities are considered "dual criteria" slopes and are protected in the coastal zone. Topographic and vegetation analysis was prepared for the project when it was approved by the California Coastal Commission. No further development is proposed with this application. All slopes and vegetation within the project site will be further protected through the land use and zoning designation of Open Space. b. Drainage, Erosion, Sedimentation, Habitat. Topographic and vegetation analysis was prepared as part of the project when Coastal Development Permit (A-6-CII-00-087) was approved by the California Coastal Commission. Habitat boundaries were identified, and they were placed into a habitat preserve. A Hydrology Study and Storm Water Management Plan (SWMP) were prepared for the project and are being implemented. The site includes a streambed that is being protected. Best Management Practices (BMPs) are being implemented and pollutants of concern are being addressed through site design, source control, and treatment control BMPs. Landscaping of slopes, consisting of both native and non-native plants reduce erosion. c. Landslides and Slope Instability. A Preliminary Geotechnical Investigation was prepared for the project when Coastal Development Permit (A-6-CII-00-087) was approved by the California Coastal Commission. No further development is proposed with this project that might create a changed circumstance requiring additional study. d. Seismic Hazards. According to the Preliminary Geotechnical Investigation that was prepared for the project, there are no active or potentially active faults known to exist on or in the vicinity of the project site, no significant shear zones were indicated on or near the proximity of the project site; and liquefaction or other ground rupture failures are not anticipated. e. Floodplain Development. Part of the golf course site and development is within the 100 year floodplain. Coastal Development Permit (A-6-CII-00-087), issued by the California Coastal Commission, authorized the existing development of the golf course within the floodplain. No further physical development within the floodplain is proposed with this project. GPA 09-06/ZC 09-07/LCPA 09-06/SP 181(G)/SP 199(B)/CT 09-03 - CARLSBAD MUNICIPAL GOLF COURSE MAPPING September 15, 2010 PAGE 9 The Local Coastal Program Amendment is necessary to change the LCP Land Use designations and zoning for the property from Planned Industrial and Open Space to Planned Industrial/Office and Open Space. The proposed Local Coastal Program Land Use and Zoning designations are consistent with the project's proposed General Plan and proposed Citywide Zoning designations. G. Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code) Development proposals which consist of facilities, or structures constructed by a City, County, Special District, State, or Federal Government or any agency, department, or subsidiary thereof for governmental purposes are excluded from the provisions of Growth Management Chapter 21.90 of the Carlsbad Municipal Code pursuant to Section 21.90.160(a). V. ENVIRONMENTAL REVIEW The proposed project falls within the scope of a previously certified Environmental Impact Report reviewed pursuant to the California Environmental Quality Act (CEQA). Staff has analyzed the project and has concluded that no potentially significant impacts would result with the implementation of the project that were not previously examined and evaluated in the Carlsbad Municipal Golf Course Environmental Impact Report (EIR 97-01), dated January, 2000. EIR 97-01 evaluated the potential environmental effects of development within the golf course site along with the creation of three development pads including analysis of traffic circulation, water resources, cultural resources, biological resources, and land use. The Planning Commission certified EIR 97-01 on June 7, 2000. At that time CEQA Findings of Fact, a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program were approved. The EIR 97-01 "Findings of Fact and Statement of Overriding Considerations" applies to the entire project's proposed actions. The proposed activities would have no effects beyond those analyzed in the EIR, since the project is the subdivision of the existing golf course development and no improvements or further development is proposed. This project is within the scope of Certified EIR 97-01 and no further CEQA compliance is required. EIR 97-01 is available at the Planning Department. ATTACHMENTS: 1. Mr. Neu introduced Agenda Item 1 and stated Senior Planner Christer Westman would make the Staff presentation. Chairperson Douglas opened the public hearing on Agenda Item 1. Mr. Westman gave a brief presentation and stated he would be available to answer any questions. Chairperson Douglas asked if there were any questions of Staff. Commissioner Nygaard inquired as to how many years are remaining for the city to maintain the HMP open space. Mr. Westman stated typically there is a five year management period when habitat is initially created to monitor its success; however, he is unsure of the dates. Commissioner Schumacher asked for clarification regarding the remainder parcel. Mr. Westman stated that at this time there is uncertainty as to what the City would like to do with the lot. The city can continue to lease it to Callaway or the city could eventually sell it to Callaway. Chairperson Douglas asked about the next steps for the project. Mr. Westman stated the majority of the actions will move forward for approval by the City Council. If the Council approves the actions, the LCPA will then move forward to the California Coastal Commission for approval. Commissioner Nygaard asked about the two lots along College Boulevard and if they were included in the original approval of the golf course and if there will be any issue at the Coastal Commission regarding the industrial/office designation. Mr. Westman stated the lots were included in the original approval and he does not foresee any issues. Chairperson Douglas asked for the purpose of these actions. Mr. Westman stated that the subdivision is a follow-up condition of the original golf course approval and ultimately prepares Lots 4, 5 and 9 to be sold as legal lots.
