RECOMMENDED ACTION:
That the City Council continue the public hearing to January 11, 2011 or some other date
certain.
ITEM EXPLANATION:
The appeal by the appellant, La Costa Meadows Unit No. 3 Homeowners Association, was
scheduled for a public hearing for November 30, 2010. Appellant filed a timely appeal which
requires the City Clerk to schedule it for a public hearing as soon as practicable (CMC section
21.54.150(c)). The appeal was scheduled for a public hearing as soon as practicable, however,
in a letter dated November 19, 2010 (Exhibit 1) appellant indicated that it will not be available
on this date. It stated any meeting date in January is acceptable and January 11, 2011 is
preferred. Staff has checked with the applicant who can accept this date but prefers any earlier
one, if possible (see Exhibit 2).
Once a date certain for the continued public hearing is selected by the Council, no further
noticing is necessary.
FISCAL IMPACT:
There is no direct fiscal impact from continuing the public hearing. Appellant has paid the
appropriate fees.
ENVIRONMENTAL IMPACT:
There is no environmental impact arising from the Council's decision to continue the public
hearing. The underlying environmental impacts of the proposed subdivision and its related
approvals will be an issue for determination in the appeal.

As you requested, this letter is to ask that the appeal to the Carlsbad City
Council on the above noted property currently scheduled for November 30, 2010,
be postponed. I will be in North Carolina for Thanksgiving and will not return until
the afternoon of December 1st. It is my understanding that there are no open
dates in December. Our Architectural Committee will be available in January
2011. The following are the dates we would prefer the appeal be heard in the
order of preference:

EL FUERTE STREET AT CACATUA STREET
The purpose of this letter is to follow-up to the request of Planning Commissioners Michael Schumacher >
and Farrah Douglas that the City install a multi-way stop at the intersection of El Fuerte Street/Cacatua '
Street. As you are aware, Cacatua Street is currently controlled by STOP signs at this intersection.
Staff has completed the traffic studies necessary to conduct an All-Way STOP warrant analysis at
this intersection. The traffic studies included a review of current traffic volumes, traffic collision history
for the past two years, and intersection geometries/sight distance evaluation. The procedure for multi-way
stop warrant analysis is taken directly from the California Manual on Uniform Traffic Control Devices.
Based on the warrant analysis, a multi-way stop is not warranted or justified at this intersection.
A multi-way stop would only be warranted when the traffic volumes and the delay to the side street
(Cacatua Street) are large enough to justify stopping traffic in all directions. Current traffic volumes on
El Fuerte Street and Cacatua Street do not meet the minimum volume and delay requirements needed to
justify stopping all vehicles on El Fuerte Street. The purpose of STOP signs is to assign the right-of-way
at an intersection, not to control vehicle speeds. There are documented cases where STOP signs have
introduced collisions at an intersection when they were installed but not warranted.
Staff also reviewed the traffic collision history for the past five years at this intersection. During this time
period, there have been no reported traffic collisions. The California Manual on Uniform Traffic Control
Devices states that an "accident problem" is typically indicated by five or more reported traffic collisions
within a 12-month period of a type susceptible to correction by a multi-way stop (right-angle collisions).
The installation of stop signs on a street with a low collision history can actually increase the potential for
some types of collisions (rear end). The lack of a traffic collision history is an indication that the
intersection is operating satisfactorily.

The existing corner sight visibility from Cacatua Street was also evaluated at this intersection. Drivers
are required to stop at the stop limit line to check for pedestrians crossing at the crosswalk. After
stopping at the STOP limit line and checking for pedestrians, a motorist on Cacatua Street can then move
forward to a driver position 10 feet back from the curb projection on El Fuerte Street to increase their
sight visibility. From this location on the southbound approach of Cacatua Street, a driver can see
approximately 600 feet to the left up the hill to the intersection at Unicornio Street. Also from this
location, a driver on the southbound approach can see to their right approximately 733 feet for eastbound
vehicles on El Fuerte Street approaching Cacatua Street. From the northbound approach a motorist
positioned 10 feet back from the curb projection can see approximately 609 feet to their left for
approaching eastbound vehicles. El Fuerte Street is posted at 45 miles per hour, which requires stopping
sight distance of 365 feet.

Due to the horizontal curvature of El Fuerte Street east of Cacatua Street, a motorist on the northbound
approach of Cacatua Street positioned 10 feet back from the curb projection can only see approximately
286 feet to the east for approaching westbound vehicles. After moving up to the curb projection, a
motorist on the northbound approach of Cacatua Street can see approximately 317 feet to the east. A
driver crossing to the north side of the intersection or turning left (west) onto El Fuerte Street from the
southerly leg of Cacatua Street should use extra caution and, after checking that no vehicles are
approaching from the west, move past the curb projection into the intersection to see motorists
approaching from the east.
