DEPT. 20,409_ 11/30/10 CA APPEAL OF PLANNING COMMISSION APPROVAL OF THE EL FUERTE VIEW TENTATIVE MAP AND RELATED APPROVALS CO— RECOMMENDED ACTION: That the City Council continue the public hearing to January 11, 2011 or some other date certain. ITEM EXPLANATION: The appeal by the appellant, La Costa Meadows Unit No. 3 Homeowners Association, was scheduled for a public hearing for November 30, 2010. Appellant filed a timely appeal which requires the City Clerk to schedule it for a public hearing as soon as practicable (CMC section 21.54.150(c)). The appeal was scheduled for a public hearing as soon as practicable, however, in a letter dated November 19, 2010 (Exhibit 1) appellant indicated that it will not be available on this date. It stated any meeting date in January is acceptable and January 11, 2011 is preferred. Staff has checked with the applicant who can accept this date but prefers any earlier one, if possible (see Exhibit 2). Once a date certain for the continued public hearing is selected by the Council, no further noticing is necessary. FISCAL IMPACT: There is no direct fiscal impact from continuing the public hearing. Appellant has paid the appropriate fees. ENVIRONMENTAL IMPACT: There is no environmental impact arising from the Council's decision to continue the public hearing. The underlying environmental impacts of the proposed subdivision and its related approvals will be an issue for determination in the appeal. EXHIBITS: 1. Letter from Appellant 2. I will be in North Carolina for Thanksgiving and will not return until the afternoon of December 1st. It is my understanding that there are no open dates in December. Our Architectural Committee will be available in January 2011.
